It is submitted by Mr.Sunit Shah, learned<br \/>\nAdvocate that he will file his Vakalatnama to appear on behalf of<br \/>\nrespondent no.2. Mr.Sunit Shah, learned Advocate waives service of<br \/>\nrule on behalf of respondent no.2.&#8221;\n<\/p>\n<p>3.\tToday,<br \/>\nthe learned advocates for the respective parties have jointly<br \/>\nrequested to dispose of the matter in view of two affidavits placed<br \/>\non record affirmed by the original complainant which indicate that<br \/>\nthe dispute is amicably settled between the parties. Learned counsel<br \/>\nMr.B.K. Raj for the original complainant &#8211; respondent No.2 has<br \/>\nstated that the complainant has no objection if the complaint is<br \/>\nquashed, as it was filed in a circumstances where,<br \/>\nhe was not otherwise go to file the complaint. The affidavit<br \/>\nis placed on record by the learned advocate for the<br \/>\ncomplainant-respondent No.2.\n<\/p>\n<p>4.\tThe<br \/>\nrequest of the learned counsel for quashing the complaint needs to be<br \/>\nconsidered in view of the fact that in case, if the complaint is not<br \/>\nquashed and is permitted to be taken to its logical end, then also,<br \/>\nin view of the facts and circumstances, it would rather be contrary<br \/>\nto the settled principles of law and would go against the interest of<br \/>\nall, including the society. The<br \/>\npeace and harmony which is now prevailing between the parties on<br \/>\naccount of settlement to the dispute, if the complaint is permitted<br \/>\nto be proceeded to in its course, it would not entail the desired<br \/>\nresult and would not serve end of justice in any manner. In<br \/>\nview of the decision of the Hon&#8217;ble Apex Court in case of Nikhil<br \/>\nMerchant V\/s. Central Bureau of Investigation and Anr. reported in<br \/>\n2009(1) GLH 31, I am of the view that though the offences are not<br \/>\nstrictly compoundable but looking to the nature of dispute and the<br \/>\naverments of the complaint, it can safely be said that, in fact, the<br \/>\ndispute originally was that of the civil nature and the lodgment of<br \/>\nthe complaint was indeed not called for.\n<\/p>\n<p>5.\tIn<br \/>\nview of this conclusion, I am of the view that the complaint impugned<br \/>\nin this proceedings is required to be quashed in the interest of<br \/>\njustice and is accordingly quashed.
