Civil Application<br \/>\n\tNo.5719 of 2010 is hence adjourned to 28-7-2010.\n<\/p>\n<p>As<br \/>\n\tfar as Civil  Applications  Nos.5717\/2010, 5718\/2010, 5720 to 5730<br \/>\n\tof 2010 are concerned, they have  been  filed by the present<br \/>\n\tapplicants for condoning the  delay  of 196 days  caused  in<br \/>\n\tpreferring First Appeals.\n<\/p>\n<p>I<br \/>\n\thave heard learned counsel for  the  applicants. Though notice of<br \/>\n\trule was served to the respondents, nobody appeared on their behalf.<br \/>\n\tI have also gone through the reasons mentioned in the Civil<br \/>\n\tApplications  on  oath  regarding  condonation of delay. Reasons  as<br \/>\n\t to why appeals could not be filed in time are  stated in paras 2<br \/>\n\tand 3 of the applications.\n<\/p>\n<p>In<br \/>\n\t view  of  the fact that the reasons stated in the  applications<br \/>\n\thave  not  been  controverted  by the otherside  by filing an<br \/>\n\taffidavit and also in view of the principles governing the<br \/>\n\tdiscretionary exercise of  power under Sec.5 of the Limitation Act,<br \/>\n\t1963, I am of the view that  sufficient cause has been stated for<br \/>\n\tnot filing the appeals in time and hence, delay caused in  filing<br \/>\n\tappeals is to be condoned and the Civil Applications Nos.5717\/2010,<br \/>\n\t5718\/2010, 5720 to 5730 of 2010 are required to be allowed.\n<\/p>\n<p>For<br \/>\n\t the  aforesaid   reasons,   Civil Application Nos.5717\/2010,<br \/>\n\t5718\/2010, 5720 to 5730 of 2010 are allowed.   Delay of 196 days<br \/>\n\tcaused in filing First Appeals is condoned.
