SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/03\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tPresent<br \/>\nSecond Appeal under Section 100 of the Code of Civil Procedure has<br \/>\nbeen preferred by the appellants   original defendants challenging<br \/>\njudgment and order dated 29.07.2006 passed by the learned 5th<br \/>\nAdditional Senior Civil Judge, Sabarkantha at Himatnagar in Special<br \/>\nCivil Suit No.61 of 1995 confirmed by the learned Appellate Court<br \/>\nvide judgment and order dated 16.03.2009 passed in Civil Appeal No.38<br \/>\nof 2006 by which learned Trial Court decreed the Suit instituted by<br \/>\nrespondent herein   original plaintiff for recovery of<br \/>\nRs.3,21,429.25 paise with interest at the rate of 18% p.a. with<br \/>\ncosts.\n<\/p>\n<p>2.\t\tRespondent<br \/>\nherein   original plaintiff instituted Special Civil Suit No.61 of<br \/>\n1995 in the Court of learned Civil Judge, Senior Division at<br \/>\nHimatnagar for recovery of Rs.3,21,429.25 paise with interest at the<br \/>\nrate of 18% per annum which was due and payable by the applicants<br \/>\nherein towards bills on minimum charge with effect from 15.03.1993.<br \/>\nLearned Trial Court framed issues at Exh.15. On behalf of the<br \/>\nplaintiff one affidavit affirmed by partner of appellant no.1<br \/>\nBhikabhai Sagar was filed. On appreciation of evidence, documentary<br \/>\nand oral, learned Trial Court i.e. learned 5th Additional<br \/>\nSenior Civil Judge, Sabarkantha at Himatnagar by judgment and decree<br \/>\ndated 29.07.2006 allowed the said Suit and decreed the suit for an<br \/>\namount of Rs.3,21,429.25 paise with interest at the rate of 18% per<br \/>\nannum. Being aggrieved and dissatisfied with judgment and order dated<br \/>\n29.07.2006 passed in Special Civil Suit No.61 of 1995, appellants<br \/>\nherein   original defendants preferred Civil Appeal No.38 of 2006<br \/>\nbefore the District Court at Himatnagar at Sabarkantha and learned<br \/>\nAppellate Court by impugned judgment and order dated 16.03.2009<br \/>\ndismissed the said Appeal and confirmed the judgment and order passed<br \/>\nby the learned Trial Court. Hence, appellants herein   original<br \/>\ndefendants have preferred present Second Appeal under Section 100 of<br \/>\nthe Code of Civil Procedure.\n<\/p>\n<p>3.\t\tOnly<br \/>\nsubmission made on behalf of the appellants herein is that as such<br \/>\nappellants herein were never served with any bills claiming minimum<br \/>\ncharges with effect from 15.03.1993 and\/or no notice was given to<br \/>\nappellants herein   original defendants that sub station is ready.<br \/>\nHowever, considering affidavit filed on behalf of the defendants,<br \/>\nmore particularly affirmed by one Bhikhabhai Sagar partner of<br \/>\nappellant no.1 herein   original defendant no.1 it is crystal clear<br \/>\nthat as such appellants herein were served with bills claiming<br \/>\nminimum charges with effect from 15.03.1993. Therefore, it cannot be<br \/>\nsaid that appellants were earlier never informed \/ served with the<br \/>\nbills claiming minimum charges. It is required to be noted that on<br \/>\nappreciation of evidence, both the Courts below have concurrently<br \/>\nheld against appellants herein   original defendants on finding of<br \/>\nfact arrived at by both the Courts below.\n<\/p>\n<p>4.\t\tThis<br \/>\nAppeal is under section 100 of the Code of Civil Procedure and unless<br \/>\nany substantial question of law arise to be considered by this Court,<br \/>\npresent Second Appeal is not required to be entertained and admitted.<br \/>\nAs stated above, learned Advocate for the appellants has failed to<br \/>\nshow any substantial question of law arise in the present Second<br \/>\nAppeal.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of above, there is no substance in the present Second Appeal,<br \/>\nwhich deserves to be dismissed and accordingly dismissed.\n<\/p>\n<p>[M.R.Shah,J.]<\/p>\n<p>satish<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vimco vs Uttar on 10 March, 2010 Author: M.R.
