By the said order, the learned Judge was pleased to permit<br \/>\namendment of the plaint as prayed for in application Exh.46.  In the<br \/>\nsaid application, it is stated, inter alia, that the plaintiff had<br \/>\nfiled the suit on 14.06.2005 and notice thereof was served on the<br \/>\ndefendant at 06:30 in the evening of the same day. The Court<br \/>\nCommissioner was to draw the Panchnama on 15.06.2005 in the morning.<br \/>\nAfter service of notice, but before drawing of the Panchnama, the<br \/>\ndefendant has illegally by taking law in his hands broken a 6 ft.<br \/>\ndoor and had damaged the belongings of the plaintiff in order to<br \/>\ncreate evidence that the possession of Vada is with the<br \/>\ndefendant.\n<\/p>\n<p>\t\tOn<br \/>\naccount of the above events, the plaintiff sought to add certain<br \/>\nadditional prayers in the pending suit for a declaration that the<br \/>\ndefendant is not entitled to create hindrance in the plaintiff&#8217;s Vada<br \/>\nland and further that the status-quo ante be restored as obtained on<br \/>\n14.06.2005 when the suit was filed.\n<\/p>\n<p>\t\tIt<br \/>\nmay be noted that both the above prayers are sought to be added in<br \/>\nthe main suit and are in the nature of final relief.  It is this<br \/>\namendment which the learned Judge granted by the impugned order.\n<\/p>\n<p>3.\t\tIt<br \/>\nis not in dispute that so far the issues have not been framed.  Grant<br \/>\nof amendment before commencement of trial is normally considered<br \/>\nliberally, particularly, when by granting such an amendment, the<br \/>\nCourt does not permit the plaintiff to change the nature of the suit<br \/>\nbut in fact avoids duplication of litigation and multiplicity of<br \/>\nproceedings.  When I find that the amendment was necessitated on<br \/>\naccount of certain events which took place after filing of the suit,<br \/>\nI am of the opinion that the learned Judge committed no error in<br \/>\ngranting such an amendment.  It is true that there was some delay on<br \/>\nthe part of the plaintiff in seeking such amendment and the Court<br \/>\nperhaps would have been justified in awarding cost to the defendant<br \/>\nwhile still granting the amendment.  However, only on this score, it<br \/>\nwould not be appropriate to entertain this petition, particularly,<br \/>\nwhen admittedly the trial had not commenced.\n<\/p>\n<p>4.\t\tLearned<br \/>\nadvocate for the petitioner, however, submitted that by granting of<br \/>\namendment, the very nature of the suit gets changed.  He further<br \/>\nsubmitted that the plaintiff had prayed for mandatory injunction for<br \/>\nrestoration of status-quo ante which came to be turned down by the<br \/>\nTrial Court while rejecting application Exh.5 as well as application<br \/>\nExh.22 by a common order and that such order has been confirmed by<br \/>\nthe District Court also.  He, therefore, submitted that the present<br \/>\namendment cannot be allowed.\n<\/p>\n<p>5.\t\tI<br \/>\nam afraid neither of two contentions can be accepted.  I do not find<br \/>\nthat by permitting the plaintiff to amend the suit, nature of suit<br \/>\nchanges.  As noted, such amendment was necessary to bring on record<br \/>\ncertain events which according to the plaintiff took place after<br \/>\nfiling of the suit.  Secondly, the<br \/>\nTrial Court dealt with the prayers of the plaintiff for status-quo<br \/>\nante by way of interim mandatory relief.  Non-granting of such<br \/>\nrelief cannot disentitle the plaintiff from amending the suit and<br \/>\npursuing such a prayer by way of final prayer.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above observations, the petition is dismissed.
