ABDUL REHIM, J\n                -------------------------------\n               WP(C) NO. 37075 OF 2010\n              -------------------------------------\n        Dated this the 21st day of December, 2010\n\n\n                        JUDGMENT\n<\/pre>\n<p>     Challenge is against coercive steps of recovery<\/p>\n<p>initiated under the provisions of the Securitisation and<\/p>\n<p>Reconstruction of Financial Assests and Enforcement of<\/p>\n<p>Security Interest Act, 2002 (SARFAESI Act). Consequent<\/p>\n<p>to default committed in repayment of a housing loan<\/p>\n<p>availed by the petitioner from the respondent Bank,<\/p>\n<p>immovable property which is the secured asset, was<\/p>\n<p>proceeded against. On receipt of demand under Section<\/p>\n<p>13(2), the petitioner had approached the Bank seeking<\/p>\n<p>permission to regularise the account. But, according to<\/p>\n<p>the petitioner, the Bank has not acceded to such request.<\/p>\n<p>Hence the petitioner seeks interference of this Court.<\/p>\n<p>     2. Learned counsel appearing for the respondent<\/p>\n<p>Bank, on the basis of instructions, submitted that the<\/p>\n<p>housing loan in question was availed in the year 2008 to<\/p>\n<p>the tune of Rs.30 lakhs. However it is conceded that the<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><br \/>\nWP(C) No. 37075\/2010<\/p>\n<p>repayment period will expire only in the year 2015. It is<\/p>\n<p>further submitted that the amount in default itself will come<\/p>\n<p>around Rs.7.25 lakhs, as on today. Since the account is in<\/p>\n<p>chronic default the Bank is proposing to proceed with<\/p>\n<p>further coercive steps.\n<\/p>\n<p>     3.     Considering the fact that the proceedings is only<\/p>\n<p>at the stage of issuing notice under Section 13(2) and also<\/p>\n<p>considering the fact of availability of effective remedy for<\/p>\n<p>the petitioner, I am of the view that it is not proper for this<\/p>\n<p>Court to interfere at this stage. However, learned counsel<\/p>\n<p>made an appeal to this Court to permit regularisation of the<\/p>\n<p>account on the basis that the defaulted amount will be paid<\/p>\n<p>within a short period in a phased manner.          He further<\/p>\n<p>undertakes that the petitioner is not intending to pursue<\/p>\n<p>any of the statutory remedies and that he is relinquishing all<\/p>\n<p>challenges against the proceedings.\n<\/p>\n<p>     4.     Considering the limited prayer sought for, I am of<\/p>\n<p>the view that indulgence can be shown in permitting the<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><br \/>\nWP(C) No. 37075\/2010<\/p>\n<p>petitioner to regularise the account in view of the fact that<\/p>\n<p>the repayment period will expire only in the year 2015.<\/p>\n<p>     5.     Accordingly, the Writ Petition is disposed of<\/p>\n<p>directing the respondents to keep in abeyance further<\/p>\n<p>coercive steps of recovery, provided the petitioner remits<\/p>\n<p>the amounts in default (defaulted monthly instalments along<\/p>\n<p>with interest and expenses if any due) in 4 (four) equal<\/p>\n<p>monthly instalments, falling due on or before 31.12.2010<\/p>\n<p>and on or before the last day of the three succeeding<\/p>\n<p>months.     The petitioner shall also make payment of the<\/p>\n<p>regular instalments due with respect to the months<\/p>\n<p>concerned, along with the above said payments.<\/p>\n<p>     6.     If the payment of the amounts in default is<\/p>\n<p>regularised as directed above, the respondent shall permit<\/p>\n<p>the petitioner to make payment of future monthly<\/p>\n<p>instalments in accordance with the original schedule of<\/p>\n<p>repayment.\n<\/p>\n<p>     7.     It is further made clear that on the event of<\/p>\n<p><span class=\"hidden_text\">                              4<\/span><br \/>\nWP(C) No. 37075\/2010<\/p>\n<p>default in payment of any one of the instalments as<\/p>\n<p>stipulated above, the respondents will be free to proceed<\/p>\n<p>with further steps on the basis of notices already issued. It<\/p>\n<p>is further made clear that the relief granted above is subject<\/p>\n<p>to condition that the petitioner is precluded from raising<\/p>\n<p>any subsequent challenge against such proceedings.<\/p>\n<p>                                    C.K.
