THE DISTRICT SUPERINTENDENT OF EDUCATION, KATIHAR\n                                  -----------\n<\/pre>\n<p>4\/   27\/08\/2010                Heard learned counsel for the petitioner<\/p>\n<p>                  and learned counsel for the State.\n<\/p>\n<p>                               The petitioner is aggrieved by the order of<\/p>\n<p>                  his transfer dated 19.3.2010 from Katihar to Gaya.<\/p>\n<p>                               Learned counsel for the petitioner submits<\/p>\n<p>                  that from the recitals in the impugned order it is<\/p>\n<p>                  apparent that the transfer was in the form of<\/p>\n<p>                  punishment. There had been no proceedings indicting<\/p>\n<p>                  him and holding him guilty after enquiry. He has been<\/p>\n<p>                  condemned unheard and visited with a punishment.<\/p>\n<p>                               Learned counsel for the State rightly<\/p>\n<p>                  points     out   that   the   transfer   was    considered<\/p>\n<p>                  conducive to good administration in an otherwise<\/p>\n<p>                  vitiated    office   atmosphere.   The    law      stands<\/p>\n<p>                  explained in (2004) 4 SCC 245 (UNION OF INDIA<\/p>\n<p>                  AND OTHERS Versus JANARDHAN DEBANATH AND<br \/>\n<span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>ANOTHER) that if the transfer is considered expedient<\/p>\n<p>in the interest of good administration in a vitiated<\/p>\n<p>officer atmosphere that does not operate to the<\/p>\n<p>prejudice of the employee as he cannot be visited with<\/p>\n<p>any adverse consequences in service career unless<\/p>\n<p>and until a proper proceeding is held in accordance<\/p>\n<p>with   law   to    pronounce   him   guilty.   This   was<\/p>\n<p>completely different from the limited consideration of<\/p>\n<p>the alleged incident       leading the administrator to<\/p>\n<p>opine that it was both in the interest of the person<\/p>\n<p>concerned and good administration to avoid a vitiated<\/p>\n<p>office atmosphere to transfer a person.<\/p>\n<p>             The petitioner has remained stationed at<\/p>\n<p>Katihar on        his own showing since 2004 till the<\/p>\n<p>present order of transfer. That is an aspect which also<\/p>\n<p>cannot be lost sight of.\n<\/p>\n<p>             This Court holds that the order dated<\/p>\n<p>19.3.2010, insofar as it refers to any conduct of the<\/p>\n<p>petitioner cannot be held to cast any aspersion or to<\/p>\n<p>ascribe him a guilt of misbehaviour or otherwise<\/p>\n<p>which are matters to be proved in a proper proceeding<\/p>\n<p>after due liberty to him.
