A.G., Haryana,<br \/>\n             for the respondents.\n<\/p>\n<p>\nJASBIR SINGH, J (Oral).\n<\/p>\n<p>             This writ petition has been filed with a prayer to issue<\/p>\n<p>directions to respondent Nos. 1 and 2 to hand over the<\/p>\n<p>investigations in F.I.R. No.136 dated 19.5.2007, registered under<\/p>\n<p>Section 302\/34\/460 IPC, at Police Station Palam Vihar Gurgaon, to<\/p>\n<p>the C.B.I.\n<\/p>\n<p>             Upon notice, reply has been filed. In paragraphs 2 &amp; 3 of<\/p>\n<p>the reply, filed by respondent Nos.1 to 4, it has been mentioned as<\/p>\n<p>under:-\n<\/p>\n<blockquote><p>                  &#8220;It is submitted that previously the investigation of<br \/>\n                  case   F.I.R. No.136 dated 19.5.2007, under Section<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.4882 of 2009                                  -2-<\/span><\/p>\n<p>                302\/460 IPC, PS Palam Vihar, Gurgaon was previously<br \/>\n                conducted by SHO PS Palam Vihar, CIA-1st and CIA 2nd<br \/>\n                Gurgaon fairly diligently and during investigation the<br \/>\n                accused Lallan Dass was found to be the accused who<br \/>\n                committed the offence.\n<\/p><\/blockquote>\n<blockquote><p>                      It is further submitted that after conducting the<br \/>\n                investigation the challan of the case has been filed in<br \/>\n                the court of Illaka Magistrate, Gurgaon and the now<br \/>\n                trial is pending in the court of Sh. B.L. Singhal Addl.<br \/>\n                Session Judge,         Fast Trace court and is fixed on<br \/>\n                18.5.2009 for Prosecution Witnesses. The charged has<br \/>\n                already been framed against the accused Lallan during<br \/>\n                the course of trial.\n<\/p><\/blockquote>\n<blockquote><p>                      Thereafter, the investigation of the case was also<br \/>\n                conducted under the supervision of Sh. Maharaj Singh<br \/>\n                HPS, the then Superintendent of Police, Faridabad<br \/>\n                (Rural) at Patwal. The investigation of the case has<br \/>\n                also been conducted by the CIA-III Sohna under the<br \/>\n                supervision of Sh. Inder Singh Saini HPS DCP South<br \/>\n                Gurgaon. Now the investigation of the case has been<br \/>\n                transferred by the Commissioner of Police, Gurgaon<br \/>\n                from CIA-III Sohna to Crime Branch Gurgaon and the<br \/>\n                DCP Crime has entrusted the investigation to Inspector<br \/>\n                Veer Singh CIA-1st Sector-46, Gurgaon and the<br \/>\n                investigation is being conducted by him.         During the<br \/>\n                investigation conducted till now none other than Lallan<br \/>\n                Dass has been found to be involved in the offence.\n<\/p><\/blockquote>\n<blockquote><p>                3.    That as per directions of the Hon&#8217;ble High Court<br \/>\n                vide order dated 18.11.2008 the representation made<br \/>\n                by   the   petitioner     has   been   decided     by   the<br \/>\n                Commissioner of Police, Gurgaon vide order Endst.<br \/>\n                No.10946-500\/CC dated 18.4.2009 after getting the<br \/>\n                matter enquired through DCP Crime, Gurgaon.             The<br \/>\n                copy of the same is annexed as R-1. Thus the plea<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.4882 of 2009                                  -3-<\/span><\/p>\n<p>                  taken by the petitioner that no enquiry has been<br \/>\n                  conducted so far is vague.        During the course of<br \/>\n                  enquiry none of the allegations leveled by the<br \/>\n                  petitioner in her representation have been found to be<br \/>\n                  true. However, three separate copies of original will<br \/>\n                  and casual leave application having the signatures of<br \/>\n                  deceased Saroj Bala were sent to FSL Madhuban for<br \/>\n                  comparing the signatures. The result dated 28.4.2009<br \/>\n                  of the same has been received and as per result<br \/>\n                  admitted signature of Saroj Bala and her Questioned<br \/>\n                  signature on will has been found same.&#8221;<\/p><\/blockquote>\n<p>            Perusal of paper book indicates that after death of the<\/p>\n<p>son and other relatives of the petitioner, property dispute has arisen<\/p>\n<p>between the parties, because daughter-in-law of the petitioner had<\/p>\n<p>executed a Will in favour of her brother. It is also apparent from the<\/p>\n<p>record that till such time, the Will was not disclosed, no suspicion<\/p>\n<p>was raised against brother of the deceased, in whose favour Will<\/p>\n<p>was executed. Otherwise also, it is clear that the investigation was<\/p>\n<p>conducted by several officer and nothing was found against<\/p>\n<p>respondent No.5 as alleged by the petitioner. It is an admitted fact<\/p>\n<p>that signatures of daughter-in-law of the petitioner on the Will were<\/p>\n<p>found to be genuine by the FSL Madhuban. It is a fact that earlier<\/p>\n<p>also, the petitioner filed a writ petition for similar relief, however, that<\/p>\n<p>writ petition was got dismissed as withdrawn.<\/p>\n<p>            In view of above facts, this writ petition is dismissed.<\/p>\n<pre>\n\n\n\n10th August, 2009.
