Heard the learned Advocates.\n<\/p>\n<p>                              Though served, respondent no. 2 has not entered<br \/>\n                   appearance.\n<\/p>\n<p>                              Re. I.A. No. 5549 of 2010.\n<\/p>\n<p>                              This application under Section 5 of the<br \/>\n                   Limitation Act is filed by the appellants for condonation of<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>delay of 33 days occurred in filing the Letters Patent<br \/>\nAppeal.\n<\/p>\n<p>            On the facts and in the circumstances of the case,<br \/>\nthe delay is condoned.\n<\/p>\n<p>            The Interlocutory Application stands disposed of.<br \/>\n            Re. LPA No. 1014 of 2010.\n<\/p>\n<p>            This Appeal preferred under Clause 10 of the<br \/>\nLetters Patent arises from the order dated 18.03.2010 made<br \/>\nby the learned single Judge in the above CWJC No. 3476<br \/>\nof 2010.\n<\/p>\n<p>            The matter at issue is whether the respondent no.<br \/>\n2-writ     petitioner,   an   Amin    in   the   Gandak   Area<br \/>\nDevelopment Agency, is required to pass the examination<br \/>\nin Hindi language; whether on failure of the writ petitioner<br \/>\nto pass such examination he would lose right to annual<br \/>\nincrement and whether on passing the examination he will<br \/>\nhave right to remittance of the increments withheld.\n<\/p>\n<p>            It is admitted that the State Government has<br \/>\nissued circular that Amins are not required to make noting<br \/>\nand drafting. Hence, they are not required to pass the Hindi<br \/>\nlanguage examination.         Besides, the writ petitioner has<br \/>\npassed Seventh Standard Examination with Hindi as one of<br \/>\nthe subjects. The mother tongue of the writ petitioner is<br \/>\nalso Hindi.\n<\/p>\n<p>            In above view of the matter, we find that the<br \/>\nlearned single Judge has rightly allowed the Writ Petition<br \/>\nand rightly restrained the appellant-agency from recovering<br \/>\nthe amount of increments paid to the writ petitioner.\n<\/p>\n<p>            For the aforesaid reason, the Letters Patent<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>        Appeal is dismissed in limine.\n<\/p>\n<p>                               ( R.M.
