Justice P.S.GOPINATHAN\n\n Dated :09\/09\/2009\n\n O R D E R\n                       P.S.GOPINATHAN, J\n                ----------------------------------------\n                    R.P.(F.C.)No.337 of 2009\n                ----------------------------------------\n          Dated this the 9th day of September, 2009\n\n                               ORDER\n<\/pre>\n<p>      Revision petitioner is the respondent in M.C.No.181 of<\/p>\n<p>2008, a petition under section 125 Code of Criminal Procedure.<\/p>\n<p>The respondents herein are the wife and children of the revision<\/p>\n<p>petitioner. Seeking an order to pay separate maintenance, the<\/p>\n<p>above petition was prefered by the respondents. The lower court<\/p>\n<p>after due enquiry, by a common order in O.P.No.494\/2008 &amp;<\/p>\n<p>M.C.No.181\/2008 dated 1\/6\/2009 allowed the petition in part.<\/p>\n<p>The prayer for maintenance to the first respondent was<\/p>\n<p>disallowed. Whereas maintenance to respondents 2 and 3 was<\/p>\n<p>ordered at the rate of Rs.5,000\/- each per month. Assailing the<\/p>\n<p>legality, correctness and propriety of that order this revision<\/p>\n<p>petition was prefered. The following are the grounds urged in<\/p>\n<p>revision memorandum;-\n<\/p>\n<blockquote><p>           1.   The judgment of the court below to the extent<\/p>\n<p>                it is sought to be revised is against law, weight<\/p>\n<p>                of evidence, incorrect, etc.<\/p>\n<\/blockquote>\n<blockquote><p>           2.   The court below ought to have found that the<\/p>\n<p>                first respondent is paid a sum of Rs.7,11,000\/-<\/p><\/blockquote>\n<p>                by the revision petitioner for the maintenance<\/p>\n<p>R.P.(F.C.)No.337 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>                of the children and it has come out in<\/p>\n<p>                evidence that this fact is true.\n<\/p>\n<\/p>\n<p>           3.   The Family Court ought to have ordered<\/p>\n<p>                adjustment of Rs.7,11,000\/-, the amount<\/p>\n<p>                entrusted with the first respondent by<\/p>\n<p>                the revision petitioner for the maintenance<\/p>\n<p>                of the children against his liability under<\/p>\n<p>                the impugned judgment.\n<\/p>\n<\/p>\n<p>      2.   The revision petitioner is not at all assailing the<\/p>\n<p>correctness of the maintenance awarded or the quantum<\/p>\n<p>thereon. But his case is one for adjustment of the amount said to<\/p>\n<p>have been already deposited in the name of the first respondent.<\/p>\n<p>It is seen that petitioner has not applied before the lower court<\/p>\n<p>for making any such adjustment. So, there is no order also.
