SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/04\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tPresent<br \/>\nRevision Application under section 115 of the Code of Civil Procedure<br \/>\nhas been preferred by the applicants herein   original opponents<br \/>\nchallenging the impugned interim order dated 08.01.2001  passed by<br \/>\nthe learned Assistant District Judge, Sabarkantha Camp at Modasa<br \/>\nbelow Exh.4 and Exh.17 in Guardian Application No.8 of 2000 by which<br \/>\nthe learned Trial Court has granted interim custody of the minor Smit<br \/>\nto the respondent herein.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe outset it is required to be noted that by order dated 17.04.2001<br \/>\nwhile admitting present Revision Application learned Single Judge has<br \/>\ngranted interim relief in terms of para 7(C) staying further<br \/>\nimplementation and operation of the impugned order passed by the<br \/>\nlearned Trial Court granting interim custody of the minor Smit to the<br \/>\nrespondent herein and said interim relief has been continued till<br \/>\ndate.\n<\/p>\n<p>3.\t\tMr.Dagli,<br \/>\nlearned Advocate for the respondent herein   original applicant has<br \/>\nsubmitted that because of pendency of present Revision Application,<br \/>\nlearned Trial Court is not proceeding further with the hearing of<br \/>\nGuardian Application No.8 of 2000. Therefore, it is submitted that<br \/>\nwithout prejudice to the rights and contentions of the respective<br \/>\nparties to the main application, if interim relief granted by this<br \/>\nCourt is directed to be continued till final disposal of Guardian<br \/>\nApplication No.8 of 2000 and learned Trial Court is directed to<br \/>\ndecide and dispose of Guardian Application No.8 of 2000 at the<br \/>\nearliest and within stipulated time and with a suitable observation<br \/>\nthat the learned Trial Court to decide and dispose of Guardian<br \/>\nApplication No.8 of 2000 in accordance with law and on merits without<br \/>\nin any way being influenced by the present order, respondent herein<br \/>\nwill be satisfied.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of above, more particularly when main Guardian Application No.8<br \/>\nof 2000 is pending before the learned Trial Court reported to be<br \/>\npending in the District Court, Sabarkantha, and when impugned order<br \/>\npassed by the learned Trial Court passed below Exh.4 and 17 is stayed<br \/>\nby this Court which is in operation since 2001, without further<br \/>\nentering into merits of the case and without expressing any opinion<br \/>\nin favour of either parties, present Revision Application is disposed<br \/>\nof by continuing interim order dated 17.04.2001 passed by this Court<br \/>\ntill final disposal of Guardian Application No.8 of 2000 pending<br \/>\nbefore the District Court, Sabarkantha.\n<\/p>\n<p>5.\t\tLearned<br \/>\nTrial Court is directed to decide and dispose of Guardian Application<br \/>\nNo.8 of 2000 at the earliest but not later than 31st<br \/>\nDecember, 2010.  Learned Trial Court to decide and dispose of said<br \/>\nGuardian Application No.8 of 2000 in accordance with law and on<br \/>\nmerits without in any way being influenced by the present order. All<br \/>\nconcerned are directed to cooperate learned Trial Court in early<br \/>\ndisposal of aforesaid Guardian Application and within stipulated time<br \/>\nstated herein above.  Learned Principal District Judge, Sabarkantha<br \/>\nis hereby directed to see that Guardian Application No.8 of 2000 is<br \/>\ndecided and disposed of in accordance with law and on merits at the<br \/>\nearliest but not later than 31st December, 2010. With<br \/>\nthese, present Revision Application is disposed of.\n<\/p>\n<p>6.\t\tSo<br \/>\nfar as Civil Application No.4797 of 2009 in Civil Revision<br \/>\nApplication No.225 of 2001  is concerned, it will be open for the<br \/>\nsaid applicant   original respondent in main Civil Revision<br \/>\nApplication to submit an appropriate application before the learned<br \/>\nTrial Court and as and when such an application is made, same shall<br \/>\nbe considered in accordance with law and on merits. However, it is<br \/>\nobserved and clarified that on aforesaid ground, learned Trial Court<br \/>\nmay not stay further proceedings of Guardian Application No.8 of 2000<br \/>\nand so far as main Guardian Application is concerned, same is<br \/>\nrequired to be decided and disposed of on or before 31st<br \/>\nDecember, 2010.
