Shukla, petitioner who is a member of Saraspur Nagrik Co-operative<br \/>\nBank Ltd., respondent No. 3 since more than 15 years and his<br \/>\nmembership is 6744, has filed this petition with a prayer that this<br \/>\nCourt may issue a writ of mandamus and order or direction directing<br \/>\nrespondent No. 1, Reserve Bank of Inda and respondent No. 2,<br \/>\nRegistrar, Co-operative Societies, to take appropriate action<br \/>\nforthwith against respondent No. 3 Bank and further direct them to<br \/>\nmake a detailed investigation regarding irregularities committed by<br \/>\nthe management of the aforesaid bank and take prompt proper legal<br \/>\naction including filing of criminal complaints against the persons<br \/>\nwho are found to be responsible for the mismanagement.\n<\/p>\n<p>Heard<br \/>\nMr. Mehta, learned advocate for the petitioner. He has pointed out<br \/>\nthat originally the petitioner addressed a letter dated 14.9.2004<br \/>\nwhich is produced at annexure-B on page No. 42. Thereafter, further<br \/>\nletter dated 3.11.2004 was addressed by the petitioner which is<br \/>\nproduced at page 44. It is true that the bank has replied to the said<br \/>\nnotice on 1.12.2004. Thereafter, again the petitioner addressed a<br \/>\nletter dated 18.12.2004 to the learned advocate for the bank which is<br \/>\non page 48 of the petition. He has also addressed a letter to the<br \/>\nRegistrar of Co-operative Societies which is on page 55 of the<br \/>\npetition. The petitioner has also addressed a legal notice dated<br \/>\n23.2.2005 to the Registrar of Co-operative Societies which is<br \/>\nproduced at page 57 of the petition. Thereafter, he has also pointed<br \/>\nout that R.B.I., has also addressed a letter dated 26.4.2005 to the<br \/>\nRegistrar, Co-operative Societies with a copy to the petitioner. He<br \/>\nhas stated that the Registrar, Co-operative Societies has still not<br \/>\nreplied to the legal notice as well as to the letter of the RBI.<br \/>\nHence notice returnable on 27.6.2005.
