The<br \/>\nrespondent was charged for the offences punishable under Sections<br \/>\n366, 342, 376 of the Indian Penal Code.\n<\/p>\n<p>3.\tWhat<br \/>\nemerges is that there is evidence on record that the respondent and<br \/>\nthe prosecutrix stayed together at Agra as husband and wife, and the<br \/>\nprosecutrix had preferred an application under Section 125 of Cr.P.C<br \/>\nfor maintenance from the respondent as his wife. The defence has<br \/>\nexamined the advocate, who represented the prosecutrix in those<br \/>\nproceedings, as a defence witness. The photographs of both, the<br \/>\nrespondent and the prosecutrix, were also produced. The prosecutrix<br \/>\nwas not minor. Keeping in mind these aspects the trial Court has<br \/>\nrecorded the acquittal. These aspects are not controverted. Under the<br \/>\ncircumstances, we are of the view that the trial Court was justified<br \/>\nin recording acquittal. Hence, leave to appeal is refused.
