Heard learned counsel for the petitioners and<\/p>\n<p>                       learned counsel for the State.\n<\/p>\n<p>                                  2. The petitioners are apprehending their arrest<\/p>\n<p>                       in connection with Gandhi Maidan P.S. Case No. 346 of<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>2008, registered under Sections 409, 420, 120 (B) and 201<\/p>\n<p>of the Indian Penal Code.\n<\/p>\n<p>          3. The four anticipatory bail petitions have been<\/p>\n<p>heard together and being disposed of by a common order<\/p>\n<p>as all the four bail petitions arising out of Gandhi Maidan<\/p>\n<p>P.S. Case No. 346 of 2008.\n<\/p>\n<p>          4. The prosecution case as alleged that main<\/p>\n<p>branch of H.D.F.C. has a current account in the Punjab<\/p>\n<p>National Bank, Exhibition Road Branch linked with the<\/p>\n<p>currency chest. The cash used to be deposited through<\/p>\n<p>authorised agency M\/S Securitrans India Pvt. Ltd. a<\/p>\n<p>secured cash remitter.      On 19. 09. 2008, the H.D.F.C.<\/p>\n<p>Branch remitted Rs. 4.70 crores through M\/S Securitrans<\/p>\n<p>India Pvt. Ltd. to the Punjab National Bank, but only Rs.<\/p>\n<p>1.70 crores credited on different dates from 20. 09. 2008 to<\/p>\n<p>03. 10. 2008 and rest was not credited. Again on 21. 10.<\/p>\n<p>2008, Rs. 4.90 crores deposited through M\/S Securitrans<\/p>\n<p>India Pvt. Ltd. with specified denomination, the Head<\/p>\n<p>Cashier received the amount but has not credited and Rs.<\/p>\n<p>7.90 crores has been fraudulently misappropriated in<\/p>\n<p>conspiracy with others.\n<\/p>\n<p>          5. The learned counsel for the petitioner of Cr.<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>Misc. No. 16093 of 2009 submits that petitioner had no<\/p>\n<p>concern with deposit at Punjab National Bank, Exhibition<\/p>\n<p>Road Branch as he was not posted at that Branch, but went<\/p>\n<p>to Punjab National Bank, Exhibition Road Branch for the<\/p>\n<p>first time on 21. 10. 2008 on direction of Circle head on<\/p>\n<p>intimation about shortage of currency chest. There is no<\/p>\n<p>pay-in-slip issued by Head Cashier for alleged deposit and<\/p>\n<p>receipt of payment on forwarding letter is not permissible<\/p>\n<p>so the official of Punjab National Bank has been falsely<\/p>\n<p>implicated.\n<\/p>\n<p>          6.   Learned counsel for the petitioner of Cr.<\/p>\n<p>Misc. No. 16116 of 2009 submits that no act of<\/p>\n<p>commission or omission has been alleged against the<\/p>\n<p>petitioner Mr. Shailendra Kishore Sharma and this<\/p>\n<p>petitioner only went with Mr. Malvinder Singh at his<\/p>\n<p>request to Punjab National Bank Branch on 21. 08. 2008.<\/p>\n<p>          7. The learned counsel for the petitioner in Cr.<\/p>\n<p>Misc. No. 34077 of 2009 submits that the petitioner Mr.<\/p>\n<p>Subodh Prasad Kumar not posted at Punjab National<\/p>\n<p>Bank, Exhibition Road Branch of current banking system<\/p>\n<p>but was posted as Chest Officer R.B.I. current chest within<\/p>\n<p>Punjab National Bank, Exhibition Road Branch and is<br \/>\n<span class=\"hidden_text\">                   4<\/span><\/p>\n<p>separate Section where certain percentage of deposit<\/p>\n<p>amount in Punjab National Bank are to be transmitted and<\/p>\n<p>hence no concern with receipt of money by Head Cashier<\/p>\n<p>of the Bank.\n<\/p>\n<p>          8.   Learned counsel for the petitioner of Cr.<\/p>\n<p>Misc. No. 23323 of 2009 submits that petitioner Md.<\/p>\n<p>Shaique Hussain joined as a Routine Manager and is<\/p>\n<p>Incharge of routine work. However, he held the chest key<\/p>\n<p>jointly of the Chest Officer and the Chest Officer and<\/p>\n<p>Cashier are only persons incharge of receiving and<\/p>\n<p>divesting in cash surplus.\n<\/p>\n<p>          9. Learned counsel for the State and learned<\/p>\n<p>counsel for the H.D.F.C. referred paragraphs 57, 66, 69,<\/p>\n<p>130, 131, 140, 162, 165, 167, 168 and 170 of the case<\/p>\n<p>diary and submits that account of H.D.F.C. has its current<\/p>\n<p>account with currency chest facility and Rs. 4.70 crores<\/p>\n<p>and Rs. 4.90 crores was received on 19. 09. 2008 and 21.<\/p>\n<p>10. 2008 respectively through M\/S. Securitrans Pvt. Ltd.<\/p>\n<p>by Shri R. K. Narayan, Head Cashier, Punjab National<\/p>\n<p>Bank and issued receipt on forwarding letter as usual. The<\/p>\n<p>delay in crediting the cash is well founded on earlier<\/p>\n<p>communication between Punjab National Bank and<br \/>\n<span class=\"hidden_text\">                    5<\/span><\/p>\n<p>H.D.F.C. and further crediting of money in account of<\/p>\n<p>H.D.F.C. in Punjab National Bank in between 20.09.2008<\/p>\n<p>to 29. 09. 2008 to extent of Rs. 1.70 crores when no<\/p>\n<p>money deposited in between establish the deposits of<\/p>\n<p>money by H.D.F.C. on 19.09.2008. The case diary further<\/p>\n<p>shows the Audit Inspector found deficiency in currency<\/p>\n<p>chest to the tune of Rs. 4.49 crores and odd and on his<\/p>\n<p>intimation Mr. Malvinder Singh and other sent on<\/p>\n<p>21.10.2008 when deficiency in currency chest was<\/p>\n<p>fulfilled by the money sent by H.D.F.C received by Shri<\/p>\n<p>R. K. Narayan, Head Cashier on 21.10.2008 and was<\/p>\n<p>misappropriated to fulfill the deficit in chest in conspiracy<\/p>\n<p>with Mr. Malvinder Singh amd Mr. Shailendra Kishore<\/p>\n<p>Sharma and others present at the Punjab National Bank on<\/p>\n<p>21.10.2008 followed with cutting in chest register about<\/p>\n<p>the denomination of currency note.\n<\/p>\n<p>          10. Hence having regard to the submission and<\/p>\n<p>going through the case diary and paras referred by the<\/p>\n<p>State and counsel for H.D.F.C. there is prima facie<\/p>\n<p>material too suggest that Rs. 4.70 crores and Rs. 4.90<\/p>\n<p>crores received by Shri R. K. Narain on 19.09. 2008 and<\/p>\n<p>21.10.2008 and during the audit inspection, the Auditor<br \/>\n<span class=\"hidden_text\">                          6<\/span><\/p>\n<p>       found a deficient of Rs. 4.49 crores and odd in currency<\/p>\n<p>       chest and said deficiency fulfilled by misappropriating the<\/p>\n<p>       amount sent by H.D.F.C. which could well be inferred by<\/p>\n<p>       cutting in the register of currency chest in presence of the<\/p>\n<p>       petitioners who were present in Punjab National Bank,<\/p>\n<p>       Exhibition Road Branch since 3 P.M to 9 P.M. on 21.<\/p>\n<p>       10.2008 and hence their involvement may not be ruled out.<\/p>\n<p>                 11. Hence having regard to the facts and<\/p>\n<p>       circumstances of the case, since the matter concerned with<\/p>\n<p>       defalcation and misappropriation of huge amount of<\/p>\n<p>       Government money, hence I am not inclined to grant bail<\/p>\n<p>       to these petitioners. Hence, the anticipatory bail petitions<\/p>\n<p>       of these petitioners are hereby dismissed.<\/p>\n<pre>m.p.
