The \u00a0 Applicant \u00a0 filed \u00a0 his \u00a0 RTI\u00adapplication \u00a0 dated \u00a0 27.01.2011 \u00a0 with \u00a0 the \u00a0 PIO, \u00a0 East \u00a0 Central \u00a0 Railway,\u00a0<\/p>\n<p>        Mugalsarai,\u00a0seeking\u00a0following\u00a0information\u00a0in\u00a0respect\u00a0of\u00a0the\u00a0benefits\u00a0given\u00a0to\u00a0the\u00a0family\u00a0of\u00a0late\u00a0Shri\u00a0<\/p>\n<p>        Ganesh,\u00a0who\u00a0served\u00a0the\u00a0public\u00a0authority\u00a0as\u00a0Khalasi\u00a0Helper,\u00a0by\u00a0the\u00a0public\u00a0authority:\n<\/p>\n<p>        &#8220;1.        Copy\u00a0of\u00a0the\u00a0document,\u00a0showing\u00a0the\u00a0total\u00a0amount\u00a0paid\u00a0to\u00a0the\u00a0wife\u00a0(Smt.\u00a0Sita\u00a0Devi)\u00a0of\u00a0the \u00a0<\/p>\n<p>                   deceased\u00a0employee.\n<\/p>\n<p>        2.         Copy\u00a0of\u00a0the\u00a0pension\u00a0payment\u00a0order.\n<\/p>\n<p>        3.         Copies \u00a0 of \u00a0 all \u00a0 the \u00a0 documents, \u00a0 including \u00a0 service \u00a0 book, \u00a0 related \u00a0 to \u00a0 the \u00a0 compassionate \u00a0<\/p>\n<p>                   appointment\u00a0given\u00a0to\u00a0the\u00a0son\u00a0of\u00a0the\u00a0deceased\u00a0employee.\n<\/p>\n<p>        4.         Whether\u00a0the\u00a0above\u00a0deceased\u00a0employee\u00a0has\u00a0left\u00a0any\u00a0minor\u00a0son\/daughter,\u00a0personal\u00a0house, \u00a0<\/p>\n<p>                   and\u00a0land\u00a0behind\u00a0him.&#8221;\n<\/p>\n<p>   2. The\u00a0PIO,\u00a0vide\u00a0his\u00a0communication\u00a0dated\u00a001.03.2011,\u00a0declined\u00a0the\u00a0disclosure\u00a0of\u00a0the\u00a0above\u00a0information\u00a0<\/p>\n<p>        to\u00a0the\u00a0Applicant\u00a0citing\u00a0exemption\u00a0under\u00a0Section\u00a08(1)(j)\u00a0of\u00a0the\u00a0RTI\u00adAct.\u00a0The\u00a0Applicant\u00a0thereafter\u00a0filed\u00a0<\/p>\n<p>        his\u00a01st\u00adappeal\u00a0dated\u00a023.03.2011with\u00a0the\u00a0Appellate\u00a0Authority\u00a0(AA)\u00a0against\u00a0deemed\u00a0refusal\u00a0of\u00a0his\u00a0RTI\u00ad<\/p>\n<p>        request\u00a0since\u00a0the\u00a0said\u00a0reply\u00a0of\u00a0the\u00a0PIO\u00a0had\u00a0not\u00a0reached\u00a0him\u00a0by\u00a0this\u00a0time.\u00a0This\u00a0appeal,\u00a0however,\u00a0was\u00a0<\/p>\n<p>        not \u00a0 apparently \u00a0 decided \u00a0 by \u00a0 the \u00a0 AA. \u00a0 The \u00a0 Appellant, \u00a0 therefore, \u00a0 filed \u00a0 the \u00a0 present \u00a0 petition \u00a0 dated\u00a0<\/p>\n<p>        01.07.2011 \u00a0 before \u00a0 the \u00a0 Commission \u00a0 alleging \u00a0 that \u00a0 the \u00a0 PIO \u00a0 has \u00a0 furnished \u00a0 &#8220;wrong \u00a0 and \u00a0 misleading\u00a0<\/p>\n<p>        information\u00a0to\u00a0him\u00a0after\u00a088\u00a0days&#8221;.\u00a0He,\u00a0therefore,\u00a0demanded\u00a0that\u00a0the\u00a0penal\u00a0action\u00a0be\u00a0initiated\u00a0against\u00a0<\/p>\n<p>        the\u00a0PIO.\n<\/p>\n<p>Decision<\/p>\n<p>   3.   During\u00a0the\u00a0hearing,\u00a0the\u00a0Appellant\u00a0stated\u00a0that\u00a0he\u00a0is\u00a0not\u00a0happy\u00a0with\u00a0the\u00a0decision\u00a0of\u00a0the\u00a0public\u00a0authority\u00a0<\/p>\n<p>        giving\u00a0appointment\u00a0to\u00a0the\u00a0son\u00a0of\u00a0the\u00a0third\u00a0party\u00a0(deceased\u00a0employee)\u00a0on\u00a0compassionate\u00a0grounds\u00a0and\u00a0<br \/>\n          that, \u00a0 therefore, \u00a0 he \u00a0 has \u00a0 demanded \u00a0 the \u00a0 present \u00a0 set \u00a0 of \u00a0 information. \u00a0 The \u00a0 Appellant&#8217;s \u00a0 request \u00a0 for\u00a0<\/p>\n<p>         information\u00a0(para\u00a01)\u00a0was\u00a0accordingly\u00a0discussed\u00a0as\u00a0given\u00a0below:\n<\/p>\n<p>Item\u00a0Nos.\u00a01,\u00a02\u00a0&amp;\u00a04:\n<\/p>\n<blockquote><p>    4.   In\u00a0the\u00a0light\u00a0of\u00a0the\u00a0Appellant&#8217;s\u00a0submission,\u00a0I\u00a0am\u00a0entirely\u00a0in\u00a0agreement\u00a0with\u00a0the\u00a0PIO\u00a0that\u00a0the\u00a0information\u00a0<\/p>\n<p>         sought\u00a0by\u00a0the\u00a0Appellant\u00a0here\u00a0is\u00a0purely\u00a0personal\u00a0to\u00a0the\u00a0third\u00adparty,\u00a0disclosure\u00a0of\u00a0which\u00a0does\u00a0not\u00a0serve\u00a0<\/p>\n<p>         any \u00a0 public \u00a0 interest. \u00a0 It \u00a0 is \u00a0 accordingly\u00a0 directed\u00a0 that\u00a0 there\u00a0 shall\u00a0 be\u00a0 no\u00a0 disclosure\u00a0 obligation\u00a0 on\u00a0 the\u00a0<\/p>\n<p>         Respondents\u00a0with\u00a0regard\u00a0to\u00a0these\u00a0items\u00a0of\u00a0information.\u00a0\u00a0\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>Item\u00a0No.\u00a03:\n<\/p>\n<blockquote><p>    5.   Here\u00a0the\u00a0Appellant\u00a0has\u00a0requested\u00a0for\u00a0copies\u00a0of\u00a0documents\u00a0related\u00a0to\u00a0the\u00a0appointment\u00a0given\u00a0to\u00a0the\u00a0<\/p>\n<p>         son\u00a0of\u00a0the\u00a0deceased\u00a0employee(third\u00a0Party)\u00a0 \u00a0on\u00a0compassionate\u00a0grounds\u00a0including\u00a0copy\u00a0of\u00a0service\u00a0<\/p>\n<p>         record.\n<\/p><\/blockquote>\n<blockquote>\n<p>         It\u00a0has\u00a0been\u00a0the\u00a0Commission&#8217;s\u00a0decisions\u00a0that\u00a0the\u00a0information,\u00a0which\u00a0deals\u00a0with\u00a0the\u00a0appointment\u00a0of\u00a0a\u00a0<\/p>\n<p>         person\u00a0in\u00a0a\u00a0public\u00a0authority,\u00a0cannot\u00a0be\u00a0construed\u00a0as\u00a0personal\u00a0to\u00a0that\u00a0appointee\u00a0since\u00a0it\u00a0relates\u00a0to\u00a0the\u00a0<\/p>\n<p>         functioning\u00a0of\u00a0the\u00a0public\u00a0authority.\u00a0However,\u00a0the\u00a0information\u00a0such\u00a0as\u00a0deductions\u00a0made\u00a0in\u00a0the\u00a0salary;\u00a0<\/p>\n<p>         details\u00a0of\u00a0Provident\u00a0Fund;\u00a0nomination\u00a0details,\u00a0etc.\u00a0are\u00a0indeed\u00a0personal\u00a0to\u00a0an\u00a0employee\u00a0which\u00a0attracts\u00a0<\/p>\n<p>         exemption\u00a0under\u00a0Section\u00a08(1)(j)\u00a0of\u00a0the\u00a0RTI\u00adAct.\u00a0\n<\/p><\/blockquote>\n<blockquote>\n<p>         In \u00a0 view \u00a0 of \u00a0 the \u00a0 above, \u00a0 it \u00a0 is \u00a0 directed\u00a0 that\u00a0the\u00a0PIO\u00a0 shall\u00a0 furnish\u00a0 information\u00a0against\u00a0 point\u00a03\u00a0 to\u00a0 the\u00a0<\/p>\n<p>         Appellant\u00a0after\u00a0excising\u00a0from\u00a0it\u00a0the\u00a0portion(s),\u00a0under\u00a0Section\u00a010(1)\u00a0of\u00a0the\u00a0RTI\u00adAct),\u00a0which\u00a0are\u00a0exempt\u00a0<\/p>\n<p>         under\u00a0Section\u00a08(1)(j)\u00a0of\u00a0the\u00a0Act.\u00a0The\u00a0information\u00a0should\u00a0be\u00a0furnished\u00a0to\u00a0the\u00a0Appellant\u00a0within\u00a02\u00a0weeks\u00a0<\/p>\n<p>         of\u00a0receipt\u00a0of\u00a0this\u00a0order.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>    6.
