DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tInspite<br \/>\nof the communication sent by the office of the Public Prosecutor,<br \/>\nHigh Court of Gujarat, Ahmedabad, about listing and hearing of the<br \/>\ncase before this Court today, concerned Investigating officer has not<br \/>\nremained present.  In view of the above, the Court has no other<br \/>\noption but to proceed on the material available on record.\n<\/p>\n<p>\tThe<br \/>\nDistrict Superintendent of Police, Jamnagar, is directed to order<br \/>\ninquiry against the concerned Investigating Officer for not sending<br \/>\nany communication to the office of the Public Prosecutor so as to<br \/>\nassist the Court with regard to the subject matter of the case and<br \/>\nreport to the Registrar of this Court in due course within a period<br \/>\nof four weeks.\n<\/p>\n<p>2.\tRule.\n<\/p>\n<p>Learned APP waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p>3.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.II-595 of 2010 with Jamnagar City &#8220;A&#8221; Division<br \/>\nPolice Station for the offences punishable under Sections 306, 506,<br \/>\n506(2) and 1214 etc. of the Indian Penal Code.\n<\/p>\n<p>4.\tLearned<br \/>\ncounsel for the applicants submits that if allegations formed the<br \/>\nbasis for initiating machinery of criminal law in motion against the<br \/>\nofficers like the applicants, it would be difficult for them to<br \/>\nperform their duties efficiently and without fear and favour besides,<br \/>\nthey are available for investigation and not likely to flee from<br \/>\ncourse of justice by imposing suitable conditions, the applicants be<br \/>\ngranted anticipatory bail.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned APP for the respondent &#8211; State.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and considering the facts that the applicants are serving as<br \/>\nofficers of the Sales Tax and allegations levelled against them are<br \/>\nof threatening and abusing the complainant to transfer and suspend<br \/>\nhim in case if he continued to make baseless allegations against<br \/>\nthem.  It further appears that the complainant, a union leader had<br \/>\ntaken an extreme step of committing suicide by consuming the poison<br \/>\nand ultimately succeeded to the ill effects of consuming poison.<br \/>\nConsidering the law laid down by the Apex Court in the case of (1)<br \/>\n<a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre vs. State of Maharashtra &amp; Ors.<\/a> in<br \/>\nCriminal Appeal No.2271\/2010 and (2) Ravindra Saxena vs. Stateo f<br \/>\nRajasthan [2010 (1) GLH 382],   I am inclined to grant<br \/>\nanticipatory bail to the applicants.\n<\/p>\n<p>7.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>8.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicants herein being arrested pursuant to FIR being<br \/>\nCR No.II-595 of 2010 with Jamnagar City &#8220;A&#8221; Division<br \/>\nPolice Station,  the applicants shall be released on bail on<br \/>\nfurnishing a bond of Rs.5,000\/- (Rupees Five Thousand only) each with<br \/>\none surety of like amount on following conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 30th<br \/>\n\tDecember, 2010 at 11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file application\/s for<br \/>\n\tremand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicants are arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicants shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>9.\tWith<br \/>\nthese directions, this Criminal Misc.
