No.17678 of 2011\n                              Shiv Shankar Thakur And Ors.\n                                            Versus\n                                     The State Of Bihar\n                                          -----------\n<\/pre>\n<p>2.   29.06.2011.              Heard      the    learned      counsel       for   the<\/p>\n<p>                   petitioners and Mr. Umanath Mishra, learned<\/p>\n<p>                   A.P.P. for the State.\n<\/p>\n<p>                              The     petitioners           are   apprehending<\/p>\n<p>                   their    arrest       in    a    case    registered          under<\/p>\n<p>                   Sections    302,       379,      380     and   120B     of     the<\/p>\n<p>                   Indian Penal Code.\n<\/p>\n<p>                              The   accusation         against       the    entire<\/p>\n<p>                   in-laws family of the deceased is to assault<\/p>\n<p>                   the victim as a result of which he died on<\/p>\n<p>                   04.02.2010 for which the complaint was filed<\/p>\n<p>                   on 26.04.2010 which ultimately came to be<\/p>\n<p>                   registered as police case on 15.05.2010.<\/p>\n<p>                              It    is    submitted          by   the      learned<\/p>\n<p>                   counsel for the petitioners that not only<\/p>\n<p>                   the   accusation       is       absurd    since    the       wife,<\/p>\n<p>                   father-in-law,             mother-in-law          and        other<\/p>\n<p>                   family   members       have       been    alleged       to    have<\/p>\n<p>                   killed the husband of petitioner no.3 but it<\/p>\n<p>                   appears that the victim died on 04.02.2010<\/p>\n<p>                   due to illness and his ritual was performed<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>at that point of time and a certificate to<\/p>\n<p>that effect has been issued by the Panchayat<\/p>\n<p>Mukhiya.\n<\/p>\n<p>            It is further submitted that since<\/p>\n<p>the    petitioners&#8217;          side     refused       to    return<\/p>\n<p>certain animal as demanded by the informant<\/p>\n<p>as a result of which the present case has<\/p>\n<p>been     filed.     The       unexplained          delayed      in<\/p>\n<p>lodging of the complaint clouds the bonafide<\/p>\n<p>of accusation and considering the same other<\/p>\n<p>accused          persons        have        been         granted<\/p>\n<p>anticipatory bail by this court.<\/p>\n<p>            Considering the aforesaid facts, let<\/p>\n<p>the petitioners, Shiv Shankar Thakur, Shyama<\/p>\n<p>Devi, Prema Kumari and Shyam Nandan Singh @<\/p>\n<p>Ram Nandan Singh @ Mohan Singh, be released<\/p>\n<p>on bail in the event of arrest or surrender<\/p>\n<p>before      the   learned       court       below    within       a<\/p>\n<p>period      of    twelve       weeks        from     today       in<\/p>\n<p>connection with Tajpur (Bangra)P.S. Case No.<\/p>\n<p>157    of   2010    on       furnishing       bail       bond   of<\/p>\n<p>Rs.10,000\/-(Ten          Thousand)          each     with       two<\/p>\n<p>sureties     of    the       like    amount    each       to    the<\/p>\n<p>satisfaction            of     the      learned           C.J.M.<\/p>\n<p>Samastipur,        subject      to    the     conditions        as<\/p>\n<p>laid down under Section 438(2) of the Code<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>        of Criminal Procedure.\n<\/p>\n<\/p>\n<pre>U.
