Swatantra Rao  has appeared  in person and has<br \/>\nfiled an  affidavit. He\t is examined. On his attention being<br \/>\ndrawn to  what finds place in the order of this Court passed<br \/>\non 1.9.1995,  he states that what has been mentioned therein<br \/>\nas regards  his meeting\t one of\t us (K.\t Ramaswamy,  J.)  is<br \/>\ncorrect. On  being further asked as to whether he had met on<br \/>\nhis own\t or at the instance of anybody, his reply is that he<br \/>\nhad done  so on\t his own  and then  brings to our notice the<br \/>\nstatements made by him in the affidavit.\n<\/p>\n<p>2.   We have  perused the  affidavit which  was verified  at<br \/>\nBangalore on  7.9.1995. It  has mentioned  the &#8220;sequence  of<br \/>\nevents&#8221; leading\t to  his  meeting  Hon&#8217;ble  Mr.\t Justice  K.<br \/>\nRamaswamy. It  states that  having read\t in  the  newspaper,<br \/>\nwhile on  tour to  West Bengal,\t about the  judgment of this<br \/>\nCourt imposing\tsentence on Shri J. Vasudevan, on his return<br \/>\nto Bangalore  he tried\tto contact Shri Vasudevan to console<br \/>\nhim. He\t was informed  that Shri Vasudevan was not available<br \/>\nin Bangalore and that he was still in Delhi.\n<\/p>\n<p>3.   On 29.8.1995  it was  told to  the deponent  that\tShri<br \/>\nVasudevan was  in a  shock and despair and that the sentence<br \/>\nimposed would  be implemented  within a day or two. This led<br \/>\nthe deponent  to feel that Shri Vasudevan might not bear the<br \/>\npunishment and\tsomething untoward  could happen  during his<br \/>\nimprisonment.  Being   a  colleague   and  friend   of\tShri<br \/>\nVasudevan,  he\tcould  not  curb  his  concern\tand  started<br \/>\nwondering whether something could be done to help him.\n<\/p>\n<p>4.   The  affidavit   then  mentions   about  the  long\t and<br \/>\ncherished desire of the deponent to meet Hon&#8217;ble Mr. Justice<br \/>\nK. Ramaswamy  to seek  his good wishes and blessings whom he<br \/>\nhad met\t about last  four decades ago. It is the concern for<br \/>\nShri Vasudevan and long and cherished desire to meet Hon&#8217;ble<br \/>\nRamaswamy, J.  which prompted  him to  come to\tDelhi and he<br \/>\nleft Bangalore\tby East West Airlines on 30.8.1995 which was<br \/>\nscheduled to  depart at 8 P.M. As the flight was delayed, he<br \/>\nreached Delhi around mid-night and being of the view that if<br \/>\nhe were to go to Karnataka Bhavan, he might have to wait for<br \/>\nlong as\t its employees\twould be  asleep,  he  proceeded  to<br \/>\nKanishka, an ITDC Hotel, and checked in. Next day morning he<br \/>\nrang up\t Shri Vasudevan\t at Karnataka Bhavan but he was told<br \/>\nthat Shri  Vasudevan had left the room around 7 A.M. As such<br \/>\nthere was no chance for him to get in touch with him.\n<\/p>\n<p>5.   The deponent  states that thereafter he met Hon&#8217;ble Mr.<br \/>\nJustice K. Ramaswamy at his residence and the object of this<br \/>\nvisit was  to seek  his Lordship&#8217;s blessings and good wishes<br \/>\nand also  &#8220;to beg  some mercy  for Shri\t J.  Vasudevan&#8221;.  No<br \/>\nsooner did  he realise that Hon&#8217;ble Mr. Justice K. Ramaswamy<br \/>\nresented the  prayer for mercy, than he sincerely apologised<br \/>\nand left the place and left for Bangalore in the afternoon.\n<\/p>\n<p>6.   It\t is  reiterated\t that  neither\tShri  Vasudevan\t nor<br \/>\nanybody else  had suggested  him  to  approach\tHon&#8217;ble\t Mr.<br \/>\nJustice K. Ramaswamy and it was his &#8220;un-subdued concern as a<br \/>\ncolleague&#8221; which,  inter alia,\thad  prompted  him  to\tmeet<br \/>\nHon&#8217;ble Mr. Justice K. Ramaswamy.\n<\/p>\n<p>7.   The further  averments made  in the  affidavit are that<br \/>\nthe deponent  had no  intention of influencing the judiciary<br \/>\nand he\tsought\tapology\t for  the  embarrassment  caused  to<br \/>\nHon&#8217;ble Mr. Justice K. Ramaswamy and for the violations made<br \/>\non the\tjudicial ethics.  The affidavit\t ends by saying that<br \/>\nthe deponent  would be\tcareful in future and has prayed &#8220;to<br \/>\npardon him  for the improprieties&#8221; committed under the above<br \/>\ncircumstances.\n<\/p>\n<p>8.   The affidavit  thus is clear on one aspect and the same<br \/>\nis that the deponent had not met one of us (K. Ramaswamy, J)<br \/>\nat the instance of Shri Vasudevan. There cannot however, two<br \/>\nopinions that  the act\tof meeting K. Ramaswamy, J. was most<br \/>\nreprehensible and  has to  be disapproved  in the  strongest<br \/>\nterms. As,  however, the  deponent has\trealised  the  gross<br \/>\nmistake committed by him, we are of the view that we may not<br \/>\nproceed further\t with the  matter  and\tclose  the  same  by<br \/>\nordering that  an entry\t would be  made in his CCR about the<br \/>\ngross impropriety  committed by him in meeting K. Ramaswamy,<br \/>\nJ.\n<\/p>\n<p>9.   We have  heard Shri Nariman, learned senior counsel for<br \/>\nthe petitioner,\t to at\tleast remit  the sentence, for which<br \/>\npurpose our mercy jurisdiction has been invoked, and invoked<br \/>\nvery forcibly  and fervently.  We are  aware that even under<br \/>\nthe proviso  to Section\t 12 of\tthe Contempt  of Courts Act,<br \/>\n1971, the  punishment awarded  may be  remitted\t on  apology<br \/>\nbeing made  to the  satisfaction of  the Court. He mentioned<br \/>\nabout this  legal provision  despite the  fact that  we\t had<br \/>\ninvoked our  constitutional power  in the matter at hand. We<br \/>\nwould agree  with Shri\tNariman that  in an appropriate case<br \/>\nthe prayer  for remission of sentence imposed on a contemnor<br \/>\nmay be\tconsidered when the Court is satisfied, on the facts<br \/>\nof that case, that it requires to be done.\n<\/p>\n<p>10.  The  entire  emphasis  of\tShri  Nariman  is  that\t the<br \/>\npetitioner had\tacted the  way he  had done on legal advice;<br \/>\nmore so, in the background of the judgment of the High Court<br \/>\nof Karnataka passed in W.P. No.15458\/1991 and batch rendered<br \/>\non 31.3.1994. Shri Nariman has taken us through the relevant<br \/>\npart of\t that judgment in which the High Court accepted that<br \/>\nthe claim  of one  M. Venkatesh was fully protected, despite<br \/>\nthe order  which had  been passed by this Court on 26.7.1993<br \/>\nin I.A.\t No.3. In the order which we had passed on 24.8.1995<br \/>\nthis fact  had been  noted, to which our attention was drawn<br \/>\nby Shri\t Santosh  Hegde,  who  had  then  appeared  for\t the<br \/>\npetitioner. In\tthe order we stated that after Venkatesh had<br \/>\nbeen promoted nothing could have reasonably stood in the way<br \/>\nof T.R.\t Dhananjaya to\tget appointed  to the  supernumerary<br \/>\npost which  had been  created by  the Bangalore\t Corporation<br \/>\npursuant to  the order\tpassed\tby  this  Court.  That\twas,<br \/>\nhowever, not  done. Shri  Nariman&#8217;s submission\tis that this<br \/>\nwas not\t done by  the petitioner,  not because\the  did\t not<br \/>\ndesire to comply with this Court&#8217;s order, but because he had<br \/>\nbeen advised  by his  counsel to act the way he subsequently<br \/>\ndid and\t which ultimately  resulted in\tthe proceeding dated<br \/>\nJuly 10,  1995, the purport of which has been noted by us in<br \/>\nthe order in question.\n<\/p>\n<p>11.  Shri Nariman  strenuously urges  that the\tpetitioner&#8217;s<br \/>\nsentence for imprisonment be remitted because he acted under<br \/>\nwrong legal advice, and not mala fide. It may be pointed out<br \/>\nthat in\t our order  we had  not attributed  mala fide to the<br \/>\npetitioner but\thad concluded that he was quality of willful<br \/>\ndisobedience. As to the advice by the counsel, which is said<br \/>\nto be available in the file, may we mention, as noted in our<br \/>\nearlier order,\tthat a\tsubmission had been made before this<br \/>\nCourt itself  on May  10, 1995\tby Shri\t Hegde to grant time<br \/>\ntill after  vacation for implementation of the order. We had<br \/>\nallowed this prayer. According to us, therefore, nothing was<br \/>\nleft except  to implement the order which had not been done.<br \/>\nThe fact  that the  order has  been implemented subsequently<br \/>\nhas no relevance.\n<\/p>\n<p>12.  Shri Nariman urges that in the aforesaid background his<br \/>\nsubmission is  only to remit the sentence in exercise of our<br \/>\nmercy jurisdiction.  It is mentioned that the petitioner has<br \/>\nonly few  years to  retire and imprisonment would affect him<br \/>\nadversely. According  to us, this cannot be a ground to show<br \/>\nmercy because  in every case of government servant this plea<br \/>\nwould be advanced and in no case a government servant who is<br \/>\nfound to  have wilfully\t disobeyed the\torders of  the court<br \/>\nwould be sentenced to imprisonment.\n<\/p>\n<p>13.  It may  be stated\tthat while  awarding the sentence of<br \/>\nimprisonment we\t had considered the submission of Shri Hegde<br \/>\nto show\t leniency so  far as  the question  of\tsentence  is<br \/>\nconcerned and  it was  stated in  the order passed on August<br \/>\n25, 1995 there were no &#8220;extenuating circumstances&#8221;, as after<br \/>\npromoting Venkatesh  nothing at\t all could  have  reasonably<br \/>\nstood in  the way of T.R. Dhananjaya to get appointed to the<br \/>\nsupernumerary post  of Addl.  Chief Engineer  created by the<br \/>\nCorporation.\n<\/p>\n<p>14.  Coming to\tthe mercy  jurisdiction,  let  it  be  first<br \/>\nstated that  while awarding  sentence on  a  contemnor,\t the<br \/>\ncourt does so to uphold the majesty of law, and not with any<br \/>\nidea of\t vindicating the  prestige of the Court or to uphold<br \/>\nits dignity.  It is  really to see that unflinching faith of<br \/>\nthe people in the courts remain intact. But, if the order of<br \/>\neven the highest court of the land is allowed to be wilfully<br \/>\ndisobeyed and  a person\t found guilty of contempt is let off<br \/>\nby remitting  sentence on  plea of  mercy, that\t would\tsend<br \/>\nwrong signals to everybody in the country. It has been a sad<br \/>\nexperience that\t due regard  is not always shown even to the<br \/>\norder of  the highest  court of\t the country.  Now, if\tsuch<br \/>\norders are  disobeyed, the effect would be that people would<br \/>\nlose faith  in the  system of  administration of justice and<br \/>\nwould desist  from approaching\tthe court, by spending time,<br \/>\nmoney and  energy to  fight their legal battle. If in such a<br \/>\nsituation mercy\t is shown,  the effect\twould be that people<br \/>\nwould not  knock the door of the courts to seek justice, but<br \/>\nwould settle  score on\tthe streets,  where muscle power and<br \/>\nmoney power  would win,\t and the  weak and  the\t meek  would<br \/>\nsuffer. That  would be\ta death knell to the rule of law and<br \/>\nsocial justice would receive a fatal blow. This Court cannot<br \/>\nbe a  party to\tit and, harsh though it may look, it is duty<br \/>\nbound to  award proper punishment to uphold the rule of law,<br \/>\nhow so\thigh a person may be. It may be stated, though it is<br \/>\ntrite, that  nobody is\tabove the  law. The  fact  that\t the<br \/>\npetitioner is an I.A.S. officer is of no consequence, so far<br \/>\nas the\tsentence is concerned. We would indeed think that if<br \/>\na high\tofficer indulges  in an act of contempt, he deserves<br \/>\nto be punished more rigorously, so that nobody would take to<br \/>\nhis head  to violate  court&#8217;s order.  May we also say that a<br \/>\npublic officer,\t being a  part of  Government,\towes  higher<br \/>\nobligation than\t an ordinary citizen to advance the cause of<br \/>\npublic interest,  which requires maintenance of rule of law,<br \/>\nto protect which contemnors are punished.\n<\/p>\n<p>15.  In the  aforesaid circumstances,  we are constrained to<br \/>\nreject the  prayer fervently advanced by Shri Nariman in his<br \/>\nusual vehemence and dismiss the petitions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India J.
