JEEVAN REDDY, J.\n<\/p>\n<p>This appeal is preferred against the judgement of the<br \/>\nCentral Administrative Tribunal, Ernakulam Bench, allowing<br \/>\nO.A. No 391 of 1991 filed by the respondents herein.<br \/>\nThe respondents are Tool Room Assistants in the Integrated<br \/>\nFisheries Project [I.F.P.] which is a wing of the Fisheries<br \/>\ndepartment, the other wing being Central Institute of<br \/>\nFisheries nautical and Engineering Training Department<br \/>\n[CIFNET]. The pay-scale of Tool Room Assistant in I.F.P. was<br \/>\ninitially Rs 85-128\/- , revised to Rs. 210-290\/-.  The IVth<br \/>\nPay Commission prescribed a uniform pay scales, viz., Rs.<br \/>\n210-270\/- and Rs. 210-290\/-. the respondents thus came into<br \/>\nthe pay scale Rs. 800-1150\/-.\n<\/p>\n<p>The Central Government issued a notification under Rule 6 of<br \/>\nCCS [CC&amp;A] Rules classifying various posts into Groups A,B,C<br \/>\nAND D.\tGroup-C comprised Central civil posts &#8220;carrying a<br \/>\npay or a scale of pay with a maximum of over Rs. 1150\/- but<br \/>\nless than Rs. 2900\/-&#8220;.\tGroup-D comprised Civil posts<br \/>\n&#8220;carrying a pay or a scale of pay, the maximum of which is<br \/>\nRs. 1150\/- or less&#8221;.  It is stated by the respondents that<br \/>\ntheir post comes under &#8220;skilled&#8221; group and that as per the<br \/>\nNotification aforesaid, this category is placed in Group-C.<br \/>\nReliance is placed upon Annexure A-8 to the writ petition<br \/>\nwhich was a list of names of the posts in the integrated<br \/>\nFisheries department.  Item 58 of the said List, it was<br \/>\nstated, includes the post carrying pay scale of Rs. 210-<br \/>\n290\/- [which scale was later revised to Rs 800-1150\/-] in<br \/>\nGroup-C.  The appellants, who were respondents in the<br \/>\nOriginal Application, opposed the respondents&#8217; claim.  The<br \/>\nTribunal held that inasmuch the post held by the respondents<br \/>\nis included in Group-C, They are entitled to the pay scale<br \/>\nof Rs. 1150-2900\/-.  The Original application filed by the<br \/>\nrespondents was allowed accordingly.\n<\/p>\n<p>We are unable to appreciate the reasoning or approach of the<br \/>\nTribunal.  The pay scale of tool Room Assistant in I.F.P. is<br \/>\nRs 800-1150\/-.\tIn other words, the maximum of the said pay<br \/>\nscale is not &#8220;over Rs. 1150\/-&#8221; so as to fall within Group-C.<br \/>\nThe post properly fell under Group-D because it carried a<br \/>\npay, the maximum of which was &#8220;Rs.1150\/-or less&#8221;. &#8220;Over Rs.<br \/>\n1150\/-&#8221; means Rs.1151\/- and above.  &#8220;Rs.1150\/-&#8221; cannot be<br \/>\ncharacterized as &#8220;over Rs.1150\/-&#8220;. The said post, therefore,<br \/>\nproperly fell under Group-D and not under Group-C.  Assuming<br \/>\nthat the said post was mentioned under Group-C, it may be &#8211;<br \/>\nor may not &#8211; an error.\tWhat is material is that the<br \/>\nclassification cannot result in change of pay scale from  Rs<br \/>\n800-1150\/- to rs 1150-2900\/-.  This is simply unimaginable.<br \/>\nPay scales are what are prescribed for each post by the<br \/>\ngovernment which is very often done on the basis of<br \/>\nrecommendations of a pay Commission or a similar expert<br \/>\nbody.  Classification of posts has nothing to do with<br \/>\nfixation of Pay scales; it only classifies posts into<br \/>\nseveral grounds based upon the pay  Scales already fixed.<br \/>\nClassification and prescribing pay scales for several posts<br \/>\nare two different and distinct functions.  The Tribunal&#8217;s<br \/>\norder is, in our opinion, wholly unsustainable in law.\tThe<br \/>\nreasons given in support of the impugned order are ambiguous<br \/>\nand vague.  The impugned order of the Tribunal is<br \/>\naccordingly set aside.,\t Sri Nambiar, learned counsel for<br \/>\nthe respondents. however, submitted that the respondents had<br \/>\nalso raised the plea of &#8220;equal pay for equal work&#8221; on the<br \/>\nbasis of the pay scale granted to Tool Room Assistants in<br \/>\nthe CIFNET, but that the Tribunal has not dealt with it.<br \/>\nWe, therefore, remit the matter to deal with the said ground<br \/>\naccording to law and pass final orders in the Original<br \/>\nApplication.\n<\/p>\n<p>Before parting with appeal, we feel impelled to make a few<br \/>\nobservations.  Over the past few weeks, we have come across<br \/>\nseveral\t matters decided by Administrative Tribunals on the<br \/>\nquestion of pay scales.\t We have noticed that quite often<br \/>\nthe Tribunals are interfering with pay scales without proper<br \/>\nreasons and without being conscious of the fact that<br \/>\nfixation of pay is not their function.\tIt is the function<br \/>\nof the Government which normally acts on the recommendations<br \/>\nof a pay Commission.  Change of Pay scale of a category has<br \/>\ncascading effect.  Several other categories similarly<br \/>\nsituated, as well as those situated above the below, put<br \/>\nforward their claims on the basis of such change.  The<br \/>\nTribunal should realises that interfering with the<br \/>\nprescribed pay scales is a serious matter.  the pay<br \/>\nCommission, which goes into the problem at great depth and<br \/>\nhappens to have a full picture before it, is the proper<br \/>\nauthority to decide upon this issue.  Very often, the<br \/>\ndoctrine of &#8220;equal pay for equal work&#8221; is all being mis-<br \/>\nunderstood and mis-applied, freely revising and enhancing<br \/>\nthe pay scales across the board.  We hope and trust  that<br \/>\nthe Tribunals will exercise due restraint in the matter.<br \/>\nUnless a clear case of hostile discrimination  is made out,<br \/>\nthere would be no justification for interfering with the<br \/>\nfixation of pay scales.\t We have come across orders passed<br \/>\nby single Members and that too quite often Administrative<br \/>\nMembers, allowing such claims.\tThese orders have a serious<br \/>\nimpact on the public exchequer too.  it would be in the<br \/>\nfitness of the things if all matters relating to pay Scales,<br \/>\nI.E. matters asking for a higher pay scale or an enhanced<br \/>\npay scale, as the case may be n one or the other ground, are<br \/>\nheard by a Bench comprising at least one Judicial Member.<br \/>\nThe Chairman of the Central Administrative Tribunal and the<br \/>\nChairmen of the State Administrative Tribunals shall<br \/>\nconsider issuing appropriate instructions in the matter.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India &amp; Anr vs P.V.Hariharan &amp; Anr on 12 March, 1997 Author: B J Reddy Bench: B.P.
