By consent of parties, the appeal is\n\nheard on merits.\n\n3. The appellants were claimants in M\ufb02\u00e9 lg\n\nNo.1402\/05 before the M;A.c.:=:....pi.e.;..ge1e:ei,e.\n\nwhich petition was lodged xhy_ them tclaiming*l\n\ncompensation on account&#039;=  the ._  of one\nG.C. Shivakumaraiah, fehef died in ia road\ntraffic accident occurred on 23.12.2005. He\n\nwas aged about 50 years and was working in\n\nAcconntant Genera1{s Office, in Bangalore. At\nthe time of accident. he was drawing a salary\n\nof_\u00e9Rs.9,123[e per month. The Tribunal\n\n.considering the net salary of him at\n\nuRg}4.3\u00a7i[e &quot;per month and considering the\n\nfuture prospectus held that his income has to\n\nxdif be tahen as Rs.13,173\/m per month and 50% has\n\nate he taken as the salary for the purpose of\n\nVmcomputing the compensation and the same was\n\narrived. at Rs.6,586\/*- per- month and. out of\n\nwhich 1\/3 has been deducted towards the\n\nfv&quot;\n\n\n\npersonal expenses and considering that he wash\n\naged about 50 years by applying the \ufb01ultiplier.Vi\n\nof 12, awarded a compensation of Rs\ufb025;79\ufb015\u00a7O(\u00a7\n\ntowards loss of dependency and while conputingi;\n\nconsidering his length cf service fgr a period\nof 10_Years, combensationii5l\u00a73lculated based\non the loss of dependency at as 4,391\/u per\nmonth and tor the renaini\ufb01d two years, 1\/2 of\nthe &quot;saga. has Lbe\u00e9\ufb02f eaten? into account and\nthereafter awarded the compensation under the\nconventional heads and a total compensation of\n\nRs\u00a7\u00a7s34,60b%\u00a7v is awarded. Out of which\n\n&#039;;Rs,3Q;QO\ufb01f~_ is awarded towards the medical\n\n&#039;e\u00a3penses,@d3 Being not satisfied with the\n\nquantumd\ufb01 of compensation awarded by the\n\nid: Tribunal, the present appeal is filed.\n\n4. The main contention of the appellants\n\ncounsel before us is that the compensation\n\nawarded by the Tribunal is not in accordance\n\nwith the ruling of the Hon&#039;ble Supreme Court.\n\n8%\n\n\n\nThe learned counsel for the appellants \u00a3e;\u00a7;ng_\n\nupon the Judgment of the Supreme pgogrt Vinyl-\n\nSARLA vsauzvs case contend&quot;  \n\nshould have taken into account ,the\u00b0 actual&quot;g\n\nsalary, the gross salary of the deceased and\nthereafter 30% &#039;shouldwQ\ufb01%Y\u00a5rnbee\ufb01i included\ntowards future p;\u00a7sp\u00a7\u00a7\u00a3egj agr he was a\npermanent \u00e9splsggg of the s\u00a3a\u00a3e Government and\nthereafter fhby &quot;;\u00a7\u00a7iyine} wthe appropriate\nmultiplierp sf y13}:WEompensation should have\nbeen a\ufb01arded]_xKyiherefore, he requests the\n\nCourt to reconsider the matter and allow the\n\n&#039;5;.72\u00a2:&quot; contra, the learned. counsel for\n\nthe respondent--Insurance Company contends the\n\n&#039;&quot;~trialH court is justified in awarding the\n\neo\ufb01pensation based on the take home salary and\n\n&#039;he also contends that after considering the\n\ntake home salary, the same is doubled by the\n\n&quot;Tribunal in order to compute the compensation\n\n(Lv\/\n\n\n\nconsidering the future prospects. V&#039;. &quot;l\n\n7: ____ _hfter\u00a7Eheari%gip%heVlparties and on\nperusipg,ot the order, we are of the opinion\n\nthat theg_Tribuna.1:.&#039; .-has\u00e9\u00e9inot followed the ruling\n\n__ of thezsupreme Court in SARLA VERMA&#039;s case.\n\n3 .13 we consider the case of the parties based\n\ni\u00a2n&quot;,;h\u00e97?zuiihg of the Apex Court in SARLA\n\nr VERHA&quot;s case, we have to consider the income\n\n&#039;&quot;o].\u00a2f=,;h\u00e9 deceased at Rs.ll,700\/-- per month.\n\nt Considering his gross salary as Rs.9,000\/-- per\n\nVm\ufb01onth on the date of the death and adding 30%\n\nof the same towards future prospects, out of\n\nRs.1l,700\/~ per month, we are inclined to\n\nex\n\n\n\ndeduct a sum of Rs.700\/~ towards professional\n\ntax and income tax, if any. Thereior\u00e9\ufb01 the _\n\nnet salary of the deceasedmhas \n\ninto account for the purpose oi computing t\ufb01e\n\ncompensation at Rs.1\u00a3yQQO\/eF.tar \ufb02nonthH}and,l\n\nRs.1,32,000\/* p.ar oug \ufb01g which, we have to\ndeduct l\/3 towards his personal expenses. If\nwe deduct has.44;050{\u00a5t_;p:a;y#5towards the\npersonal _d%\u00a7\ufb01ensesy:3qth%\u00a7d actual loss of\n .w\u00a7;z1d be Rs.88,000\/--~.\nConsidering as he was aged about 50 years, we\n\nhave to a\ufb01plydnultiplier of 13 since he was in\n\nia,securedZjob as he could have attained the\n\n&quot;&#039;a._ge__Vof:&#039;\u00abV...gu};$erannuation at the age of 60, we\n\nhare to a\ufb01ply multiplier of 10 considering the\n\nhl\ufb01 annual loss of dependency at Rs.88,000\/~. But\n\nit we&quot; apply multiplier of 10, it would be\n\ndu&quot;Rs,8,80,000\/&quot;. In addition to that for the\n\nremaining 13 nmltiplier, half&#039; of the annual\n\ndependency has to be reduced on account of his\n\n\u00abV\n\n\n\nsuperannuation. By doing so, for the remainin\u00a7_\n\n3 multiplier compensation has to be awarded at\u00a7_i%\n\nRs.1,32,000\/--. Thus, in all the claimants arew\n\nentitled for a sum of Rs.,_10,l.2,&quot;000\/e..&quot;.&#039;ul;!d\u00e9r\n\nhead of loss of dependency} _\n\n3. The Tribunal p  Rage, 000\/-\ntowards medi\ufb01hl 9K?\u00a7\ufb02\u20aces,i \ufb01hidhtlwe are not\ninclined _toi\u00a2enhahce,d:pp\ufb01herefore, the said\namount &quot;&quot;&quot; &quot;of i\ufb01\u00a7:\u00a7C,6d\ufb01i\u00a7l is&quot; confirmed. In\naddition to that the.claimants are entitled\n\nfor gaplsum-t{\u00a2f&quot;adR$.4o,coo\/-- under the\n\ncon\ufb01entional &quot;heads. Thus in all, the\n\n,claimants&quot;, are entitled for a total\n\ni&quot;\u00a25epah\u00e9ag1\u00a7nf of IRs.l0,82,000\/-- with interest\n\nas&quot;-5%  \n\n9} In the result, the appeal is allowed-\n\nlin+part. The compensation awarded by the\n\nu\ufb02hfribunal is enhanced from Rs.6,34,600\/-- to\n\nRs.10,82,000\/--. The enhanced compensation\n\nshall carry interest at 6% p.a.
