Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :05\/08\/2010\n\n O R D E R\n<\/pre>\n<p>          THOTTATHIL B.RADHAKRISHNAN, J.\n<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>            W.P.(C).No.36175 of 2008-F<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>      Dated this the 5th day of August, 2010.<\/p>\n<p>                     Judgment<\/p>\n<p>1.The petitioner is the widow of Augustine Thomas<\/p>\n<p> who retired from Government service on 30.11.2002<\/p>\n<p> on    superannuation.   He    worked   as    Store<\/p>\n<p> Superintendent in the District Medical Stores,<\/p>\n<p> Thiruvananthapuram. He died on 13.10.2007.<\/p>\n<p>2.On 29.6.2004, the VACB registered a case under<\/p>\n<p> Section 13(2) read with Section 13(1)(d) of the<\/p>\n<p> Prevention of Corruption Act, 1988 and Section<\/p>\n<p> 120B  IPC  against  the  six   persons,  including<\/p>\n<p> Augustine  Thomas.   Former  Director  of   Health<\/p>\n<p> Services, Former Additional Director of Health<\/p>\n<p> Services and former District Medical Officer of<\/p>\n<p> Health Services were among the six accused.<\/p>\n<p>3.The counter affidavit tries to show that on<\/p>\n<p> conclusion  of   investigation,  the  matter   was<\/p>\n<p><span class=\"hidden_text\">WPC36175\/08            -: 2 :-<\/span><\/p>\n<p> pending    with  the Government    for   issuance of<\/p>\n<p> sanction for prosecution of the officers. The<\/p>\n<p> respondents have, quite rightly, conceded in the<\/p>\n<p> counter affidavit that no action in criminal<\/p>\n<p> jurisdiction    could  be    had  against   Augustine<\/p>\n<p> Thomas since the proceedings against him in that<\/p>\n<p> regard stands abated on his death.<\/p>\n<p>4.The aforesaid facts would disclose that if at all<\/p>\n<p> the Government could have taken any action for<\/p>\n<p> recovery of any amounts from the DCRG or other<\/p>\n<p> retiral benefits as amounts due to Government on<\/p>\n<p> account of liabilities, the same cannot be had at<\/p>\n<p> this point of time in view of the different<\/p>\n<p> provisions     of   Kerala     Service   Rules,   in<\/p>\n<p> particular, Rule 116 of Part III thereof. It is<\/p>\n<p> the     admitted  case,     going  by   the   counter<\/p>\n<p> affidavit,    that  no   action   for  recovery  was<\/p>\n<p> initiated    at  any point     of  time,  though  the<\/p>\n<p> respondents have averred in the counter affidavit<\/p>\n<p> that Augustine Thomas was liable to make good the<\/p>\n<p> loss    sustained  by the     Government. While  the<\/p>\n<p><span class=\"hidden_text\">WPC36175\/08           -: 3 :-<\/span><\/p>\n<p> Government   would  be       at   liberty  to   take<\/p>\n<p> appropriate   action,      if   any   available  in<\/p>\n<p> accordance  with   law      before  the  appropriate<\/p>\n<p> authorities or courts, the petitioner is entitled<\/p>\n<p> to be paid all withheld outstandings by way of<\/p>\n<p> pension, arrears of pension, balance DCRG etc.<\/p>\n<p> In    the  result,  without      prejudice  to  the<\/p>\n<p> Government&#8217;s  contention      as  against  Augustine<\/p>\n<p> Thomas&#8217;s estate for any loss, recoverable in<\/p>\n<p> accordance  with  law,      this  writ  petition is<\/p>\n<p> allowed directing that all outstandings due to<\/p>\n<p> late Augustine Thomas by way of DCRG, Commuted<\/p>\n<p> Value of Pension, leave surrender, any life time<\/p>\n<p> arrears   of pension   etc.    be  released  to  the<\/p>\n<p> petitioner, with interest thereon in terms of the<\/p>\n<p> Rules and Government Decisions in that regard,<\/p>\n<p> provided her claim is otherwise in accordance<\/p>\n<p> with law.
