No. I-42\/2001<br \/>\nregistered at Salabatpura police Station may be quashed and set<br \/>\naside.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr. Hardik Dave for the applicant, learned APP Mr.<br \/>\nRaval for respondent No. 1-State as well as learned advocate Mr. DK<br \/>\nPuj for respondent No.2 original complainant.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr. Dave referred to the papers and submitted that the<br \/>\ncomplaint was filed with regard to the outstanding amount for the<br \/>\ngoods supplied in a commercial transaction.  Learned advocate Mr.<br \/>\nDave submitted that the matter has been settled for which an<br \/>\naffidavit has been produced on record recording the<br \/>\ncompromise\/settlement having been arrived at. Learned advocate Mr.<br \/>\nPuj appears for respondent No.2 original complainant and confirms the<br \/>\nsame.  Therefore, leaned advocate Mr Dave has stated that in view of<br \/>\nthe judgment of the Honorable Apex Court reported in (2008) 15 SCC<br \/>\n704 in the case of <a href=\"\/doc\/1936939\/\">Jagdish Chanana and ors. v. State of Haryana<br \/>\nand<\/a> anr., the present application may be allowed.\n<\/p>\n<p>5.\tAs<br \/>\nit transpires from the record, the dispute is with regard to a<br \/>\ncommercial transaction regarding outstanding dues and the parties<br \/>\nhave amicably settled their dispute for which a writing is executed<br \/>\nand the affidavits have been filed.  Respondent No.2 complainant is<br \/>\npresent in the court through his lawyer learned advocate Mr. DK Puj<br \/>\nand he has confirmed about having settled the matter.  Therefore, in<br \/>\nview of the observations made by the Hon&#8217;ble Apex Court in the<br \/>\naforesaid judgment in the case of Jagdish Chanana (supra) as<br \/>\nwell as the judgment in the case of <a href=\"\/doc\/1442974\/\">Madan<br \/>\nMohan Abbot v. State of Punjab,<\/a><br \/>\n reported in (2008) 4 SCC 582,<br \/>\nwherein the Hon&#8217;ble Apex Court has observed in para in para 6 as<br \/>\nunder, the present petition deserves to be allowed.\n<\/p>\n<p>\t&#8220;We<br \/>\n\tneed to emphasize that it is perhaps advisable that in disputes<br \/>\n\twhere the question involved is of a purely personal nature, the<br \/>\n\tCourt should ordinarily accept the terms of the compromise even in<br \/>\n\tcriminal proceedings as keeping the matter alive with no possibility<br \/>\n\tof a result in favour of the prosecution is a luxury which the<br \/>\n\tCourts, grossly overburdened as they are, cannot afford and that the<br \/>\n\ttime so saved can be utilized in deciding more effective and<br \/>\n\tmeaningful litigation. This is a common sense approach to the matter<br \/>\n\tbased on ground of realities and bereft of the technicalities of the<br \/>\n\tlaw.&#8221;\n<\/p>\n<p>6.\tTherefore,<br \/>\nas the dispute is of a private nature and the parties have amicably<br \/>\nsettled the same, the FIR is required to be quashed and set aside in<br \/>\nlight of the compromise\/settlement which has been arrived at and in<br \/>\nview of the observations made by the Hon&#8217;ble Apex Court laying down<br \/>\nguidelines with regard to the approach. It has been specifically<br \/>\nobserved that the approach of the court should be pragmatic and time<br \/>\nshould be utilised for  deciding effective and meaningful litigation.<br \/>\n Therefore, when there are no  chances and when the complainant has<br \/>\nno objection having settled with the accused, the prayer deserves to<br \/>\nbe granted.\n<\/p>\n<p>7.\tIn<br \/>\nthe circumstances, the present application stands allowed. Prayer in<br \/>\nterms of para 9b is granted. The FIR begin C.R. No. I-42\/2011<br \/>\nregistered at Salabatpura Police Station is hereby quashed and set<br \/>\naside.  Rule is made absolute accordingly. DS permitted.\n<\/p>\n<p>(Rajesh<br \/>\nH.
