No.12304 of 2010\n                         NITESH SINGH SON OF SHYAM BABU SINGH\n                                             Versus\n                                      STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p>4.   23.6.2010                Heard learned Counsel for the petitioner and the State.<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Sections 25(1-b)A\/26\/35 of the Arms Act.<\/p>\n<p>                              The petitioner was arrested when he was sleeping in<\/p>\n<p>                 the house of one Madho Singh and from under his pillow a loaded<\/p>\n<p>                 country made pistol was recovered, for which he is in custody since<\/p>\n<p>                 16.7.2009.\n<\/p>\n<p>                              Considering the same, let the petitioner above named,<\/p>\n<p>                 be released on bail on furnishing bail bond of Rs.5,000\/- (Five<\/p>\n<p>                 thousand) with two sureties of the like amount each to the<\/p>\n<p>                 satisfaction of Chief Judicial Magistrate, Sitamarhi in Shyampur<\/p>\n<p>                 Bhataha P.S.case No.50 of 2009, subject to the conditions (i) That<\/p>\n<p>                 one of the bailors shall be the father\/mother of the petitioner and<\/p>\n<p>                 the other bailor will be a close relative of the petitioner who will give<\/p>\n<p>                 an affidavit giving genealogy as to how he is related with the<\/p>\n<p>                 petitioner. The bailor will undertake to furnish information to the<\/p>\n<p>                 court about any change in the address of the petitioner, (ii) that the<\/p>\n<p>                 bailor shall also state on affidavit that he will inform the court<\/p>\n<p>                 concerned if the petitioner is implicated in any other case of similar<\/p>\n<p>                 nature after his release in the present case and thereafter the court<\/p>\n<p>                 below will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>                 bail on the ground of misuse, (iii) that the petitioner will give an<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            undertaking that he will receive the police papers on the given date<\/p>\n<p>            and be present on date fixed for charge and if he fails to do so on<\/p>\n<p>            two given dates and delays the trial in any manner, his bail will be<\/p>\n<p>            liable to be cancelled for reasons of misuse and (iv) that the<\/p>\n<p>            petitioner will be well represented on each date and if he fails to do<\/p>\n<p>            so on two consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p>                                   ( Anjana Prakash, J. )<\/p>\n<p>Narendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nitesh Singh vs State Of Bihar on 23 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
