S.J. MUKHOPADHAYA)<\/p>\n<p>\tIn<br \/>\nall these appeals, as similar orders are challenged, they have been<br \/>\nheard together and disposed of by this common order.\n<\/p>\n<p>2.\tIt<br \/>\nappears that the adjudicating authority passed different orders under<br \/>\nthe provisions of Section 8(3) of the Prevention of Money Laundering<br \/>\nAct, 2002. Those orders were challenged by different persons,<br \/>\nappellants herein, in their respective writ petitions. One of the<br \/>\npetitioners &#8211; Smt. Narmada Maneklal Panchal died during the<br \/>\npendency of the case, which fact was brought to the notice of the<br \/>\nlearned Single Judge. The counsel for the appellant brought to the<br \/>\nnotice of the Court that the authority had not given any reason for<br \/>\npassing the order and has ignored the contents of the reply though<br \/>\nthe adjudicating authority is under duty to take into consideration<br \/>\nthe same. The learned Single Judge, by order dated 19th<br \/>\nJune, 2009, noticing the aforesaid fact, without any observation,<br \/>\ndismissed the writ petition.\n<\/p>\n<p>3.\tIn<br \/>\nthe case of appellant &#8211; Smt. Pushpa Deepak Shah though the<br \/>\npetitioner had not died, on presumption that the petitioner had died,<br \/>\nthe learned Single Judge, by order dated 19th June, 2009<br \/>\npassed similar order, but somehow observed that the petitioner &#8211;<br \/>\nSmt. Pushpa Deepak Shah would raise the contentions before the<br \/>\nappellate authority. It was reported that the said petitioner has not<br \/>\ndied.\n<\/p>\n<p>4.\tIn<br \/>\nanother case of appellant &#8211; Smt. Roopal Naresh Panchal, similar<br \/>\norder was passed on 22nd July, 2010 wherein, without<br \/>\nexpressing any opinion, the writ petition was dismissed stating that<br \/>\nthe petitioner has alternative remedy.\n<\/p>\n<p>5.\tIn<br \/>\nother case of appellants &#8211; Smt. Smita Rajesh Panchal and others<br \/>\nalso, similar orders have been passed.\n<\/p>\n<p>6.\tWe<br \/>\nhave noticed that in the case of Smt. Narmada Maneklal Panchal, the<br \/>\npetitioner had died. However, without any ground and without giving<br \/>\nany liberty to the heirs, the writ petition was dismissed. Therefore,<br \/>\nthe writ petition preferred by Smt. Narmada Maneklal Panchal i.e.<br \/>\nSpecial Civil Application No.4415 of 2009 is required to be remitted<br \/>\nback to the learned Single Judge for fresh consideration. In other<br \/>\ncases also, having noticed that similar non-speaking orders have been<br \/>\npassed, we are of the opinion that all the cases should be remitted<br \/>\nback to the learned Single Judge for fresh consideration.
