   Rs.35,000\/– awarded by the Tribunal with<\/p>\n
interest  per annum from the date of petition till the<\/p>\n
 date 55.. deposit as against the claim of the appeilant for<\/p>\n

3. The brief facts of the case are:\n<\/p>\n
That on 10.05.2001, when the appellant waslililzifaiting<\/p>\n
for the bus near Lalbagh bus stand, a<\/p>\n
registration No. MYC 357 came in a  <\/p>\n
manner and dashed against the ap;f;ella.nt’A.’andlicaused<\/p>\n
accident due to which he sustained ‘injuries’.rit’isVVthe case *<\/p>\n
of the appellant that he considerabiie amount
\ntowards hospitalizatioiilidl  -the \ufb01led a claim
\npetition, clairnigng  Vt:i”[\u00a7\u00e93ii.%%.,oo,oo0\/–. The
\nsaid claimi.  the Tribunal and
\nthe  oral and documentary
\nevidence and  rnaterial available on the \ufb01le,<\/p>\n
allowed the”c1:aim’v”petitVion in part awarding compensation<\/p>\n
0 V.'”*of \u00ab~ Withddinterest at 6% pa. from the date of<\/p>\n
   date of deposit. The appellant presented<\/p>\n
  appeal on the ground that the said<\/p>\n
  cornpensation awarded by the Tribunal is inadequate and<\/p>\n
0   ‘1’e<:;uires enhancement.\n<\/p>\n

4. We have heard the learned Counsel appearing on<\/p>\n
both sides.\n<\/p>\n
5. After careful perusal of the judgment””ai1dif_iaiiirart1;edlV’<\/p>\n
passed by the Tribunal what  that  <\/p>\n
has committed error in award gl–obal compensati’on’l of<\/p>\n
Rs.35,000\/- towards pain an’d.:agony,V”rnedical
\nexpenses etc.,   the
\nnature of injuries  ‘Af’lappel1ant such as
\nBimalluar  ” accident register
\nextract shoiszs right foot ankle joint
\nwith ah-rasion.slV”3’:’inpj’nu’r:filje-r’nieasuring l X. 1 c.m etc., on<\/p>\n
the righta\ufb01ootvv  aspect with pain and restricted<\/p>\n
…..pmoVe\u00a7rriVe\ufb01t. of Hfo’at____and ankle joint and the duration of<\/p>\n
 tre’at.1nent~ iun\u00e9de.rgone by him for a period of 21 days in the<\/p>\n
hoshpitall as’cj~:inpatient. The said compensation awarded<\/p>\n
 towardslepain and sufferings is inadequate. Therefore we<\/p>\n
if lC_’dee1i1,it fit to award Rs.20,000\/~ towards pain and<\/p>\n
it ‘   npsu\u00e9fferings. L\/2<\/p>\n

8. The Tribunal is not justified in not awarding<\/p>\n
separate compensation towards medical -4e’xp_’en”sses,<\/p>\n
conveyance, nourishing food and attendant:Chaifg\u00a7es.ol’.’lle”.p<\/p>\n
was inpatient in the hospital fory2’1′–days. ‘h\ufb011_i\u00a7l1ti’ha%(ell 9 j <\/p>\n
spent reasonable amount towardsQcon\\}eyance,’~ nourishtiiig<\/p>\n
food and attendant charges.’-v..oEl’herefore itll \ufb01t to<\/p>\n
award Rs.5,000\/– under’ theo.isa1dlso1;\u00e9aa:<\/p>\n
7. The Tribpunpal   compensation
\ntowards loss   It is not in
\ndispute xivith an accident and
\nsustained-.1IijAtii’li’e’s inpatient in the hospital for 21<\/p>\n
days as lstated’  Taking these factors into<\/p>\n
 \u00a2on’.s;i;ieif’ati’on,l.l “W.e____’deern it fit to award Rs.20,000\/–<\/p>\n
