Petition No. 299 of<br \/>\n\t1980 and M.A.C. Petition No. 300 of 1980, has preferred these<br \/>\n\tappeals assailing the common award in judgment dated 1\/5\/1982. The<br \/>\n\tfact remains to be noted that the award impugned was subject matter<br \/>\n\tof challenge in group of First Appeals being First Appeal No.<br \/>\n\t1945\/1982 &amp; 1949\/1982, and First Appeal No.1950\/1982 &amp;<br \/>\n\t1952\/1982, which came to be disposed of by this Court (Coram: K.S.<br \/>\n\tJhaveri, J) vide order dated 24\/7\/2006 and 7\/8\/2006 respectively.<br \/>\n\tThese two appeals were left out.\n<\/p>\n<p>Shri<br \/>\n\tSheth, learned counsel appearing for respondent no.6 in both the<br \/>\n\tappeals fairly submitted that, in view of the fact that these two<br \/>\n\tappeals have been left out of the group which were placed before the<br \/>\n\tCourt, and when there is judgment allowing those appeals, these<br \/>\n\tappeals would be governed by the same reasoning &amp; orders of<br \/>\n\tthose appeals also, and therefore present appeals may accordingly be<br \/>\n\tallowed, and there is no need for elaborate reasoning.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate for the parties. In view of Apex Court&#8217;s<br \/>\n\tobservation  in case of SMT.\n<\/p>\n<p>\tMALLAWWA etc. Appellants V. Oriental Insurance Co. Ltd and others,<br \/>\n\tRespondents, reported in AIR 1999 Supreme Court, 589, wherein<br \/>\n\tApex Court was absolutely clear with regard to liability of the<br \/>\n\tinsurer in such a situation.\n<\/p>\n<p>\tIn<br \/>\n\tparagraph no.13 of the Judgment, the Apex Court has observed as<br \/>\n\tunder:-\n<\/p>\n<p> 13.<br \/>\n\tThe 1939 Act is now replaced by the 1988 Act. Section 147 which<br \/>\n\tcorresponds to old Section 95 has been substantially altered by the<br \/>\n\tLegislature. Therefore, the above interpretation of Section 95 of<br \/>\n\tthe 1939 Act will govern the cases which have arisen under the 1939<br \/>\n\tAct. According to our interpretation of Section 95(1) (b) (i) and<br \/>\n\tthe proviso, the appeals filed by the Insurance Company are allowed.<br \/>\n\t&#8230;.\n<\/p>\n<p>In<br \/>\n\tview of this, both the appeals are allowed as they are governed by<br \/>\n\tthe reasonings given in the judgments of this Court in the above<br \/>\n\treferred group of appeals in which these appeals are also forming<br \/>\n\tpart.
