JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/06\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.Jaswant K.Shah, learned Assistant Government Pleader, waives<br \/>\n\tservice of notice of Rule on behalf of the respondents. In the facts<br \/>\n\tand circumstances of the case and with the consent of the learned<br \/>\n\tcounsel for the parties, the matter is taken up for final hearing<br \/>\n\ttoday.\n<\/p>\n<p>This<br \/>\n\tpetition under Article 226 of the Constitution of India has been<br \/>\n\tfiled with the following prayers:\n<\/p>\n<p>\u00fdS(A)\tYour<br \/>\n\tLordships may be pleased to admit this petition.\n<\/p>\n<p>(B)\tYour<br \/>\n\tLordships may be pleased to issue a writ in nature of mandamus or<br \/>\n\twrit in nature of certiorari or any other appropriate, writ\/s<br \/>\n\torder\/s, and\/or direction\/s quashing and setting aside the undated<br \/>\n\tnotice (Annexure-A) issued by the respondent no.1 on 24.05.2007.\n<\/p>\n<p>(C)\tPending<br \/>\n\tadmission hearing and final disposal of this petition, Your Lordship<br \/>\n\tmay be pleased to grant interim\/ ad-interim relief\/ staying the<br \/>\n\toperation, implementation and execution of the undated notice<br \/>\n\t(Annexure-A) issued by the respondent no.1 on 24.05.2007.\n<\/p>\n<p>(D)\tYour<br \/>\n\tLordships may be pleased to pass any such other and\/or further<br \/>\n\torder\/s, thought just and proper, in the interest of justice.\u00fd\u00fd<\/p>\n<p>Briefly<br \/>\n\tstated, the facts of the case are that the petitioners are the<br \/>\n\toriginal owners and in possession of the land bearing Block No.2070,<br \/>\n\tOld Revenue Survey No.1464\/3 of Village Sadakpor, Taluka: Chikhli,<br \/>\n\tDistrict: Navsari, admeasuring approximately 1518 Sq.Mtrs.<br \/>\n\t(hereinafter referred to as the land in question). The respondent<br \/>\n\tNo.3, i.e. the Mamlatdar and ALT, Chikhli, passed an order dated<br \/>\n\t29.10.2002, annexed as Annexure-B to the petition in Tenancy case<br \/>\n\tNo.70-O\/50\/2002 under Section 70(o) of the Bombay Tenancy and<br \/>\n\tAgricultural Lands Act, 1948 (hereinafter referred to as \u00fdSthe Act\u00fd\u00fd<br \/>\n\tfor short), declaring that the petitioners are occupying the land in<br \/>\n\tquestion as permanent tenants. The restrictions under the provisions<br \/>\n\tof Section 43 of the Act were removed by the respondent No.3. In<br \/>\n\tpursuance of the above said order, the necessary effect was given in<br \/>\n\tthe relevant revenue records by Mutation Entry No.11531 dated<br \/>\n\t30.10.2002, which was certified on 30.11.2002. A copy of the same is<br \/>\n\tannexed as Annexure-C to the petition. Thereafter, the petitioner<br \/>\n\tNo.3 purchased the land in question from the petitioners No.1 and 2<br \/>\n\tby way of a registered Sale Deed No.20 dated 6.1.2003, a copy of<br \/>\n\twhich is annexed as Annexure-D to the petition. The name of the<br \/>\n\tpetitioner No.3 was entered in the revenue records by Mutation Entry<br \/>\n\tNo.11580 dated 6.1.2003, a copy of which is annexed as Annexure-E to<br \/>\n\tthe petition.\n<\/p>\n<p>The<br \/>\n\tcase of the petitioners is that the respondent No.2 has not<br \/>\n\tchallenged the order dated 29.10.2002 (Annexure-B to the petition)<br \/>\n\tpassed by the respondent No.3 till today. However, the State<br \/>\n\tGovernment issued a Circular dated 7.10.2005 empowering the District<br \/>\n\tCollector (respondent No.1) to decide the cases under the provisions<br \/>\n\tof Section 43 of the Act. Pursuant thereto, the District Collector<br \/>\n\tissued an undated notice on 24.5.2007 (Annexure-A to the petition)<br \/>\n\tstating that the respondent No.3, i.e. the Mamlatdar and ALT,<br \/>\n\tChikhli, had no authority to decide the question of permanent<br \/>\n\ttenancy but the said power has been vested with the respondent No.1<br \/>\n\tin view of the Circular dated 7.10.2005. It is also the case of the<br \/>\n\tpetitioners that the Circular dated 7.10.2005 was challenged by a<br \/>\n\tnumber of persons by filing Special Civil Application No.9609 of<br \/>\n\t2006 and other allied matters and this Court, vide judgment dated<br \/>\n\t17\/18\/23.01.2007, has quashed and set aside the Circular dated<br \/>\n\t7.10.2005 as being ultra-vires the provisions of the Act. The<br \/>\n\tpetitioners are, therefore, aggrieved by the notice issued by the<br \/>\n\trespondent No.1 on 24.5.2007 (Annexure-A to the petition), pursuant<br \/>\n\tto the Circular dated 7.10.2005 and have, therefore approached the<br \/>\n\tCourt by filing the present petition.\n<\/p>\n<p>I<br \/>\n\thave heard Mr.K.K.Trivedi, learned counsel for the petitioners and<br \/>\n\tMr.Jaswant K.Shah, learned Assistant Government Pleader for the<br \/>\n\trespondents and have gone through the averments made in the petition<br \/>\n\tas well as the documents annexed thereto.\n<\/p>\n<p>A<br \/>\n\tperusal of the impugned notice dated 24.5.2007 makes it clear that<br \/>\n\tit is issued by placing reliance upon the Circular dated 7.10.2005,<br \/>\n\twhich has already been quashed and set aside by this Court vide<br \/>\n\tjudgment dated 17\/18\/23.01.2007 rendered in Special Civil<br \/>\n\tApplication No.9609 of 2006.\n<\/p>\n<p>Mr.Jaswant<br \/>\n\tK.Shah, learned Assistant Government Pleader, has submitted that the<br \/>\n\tState Government has filed a Letters Patent Appeal against this<br \/>\n\tjudgment but the same is lying in the Registry of the High Court for<br \/>\n\tremoval of office objections.\n<\/p>\n<p>Be<br \/>\n\tthat as it may, the fact remains that the judgment of this Court<br \/>\n\tdated 17\/18\/23.01.2007 in Special Civil Application No.9609 of 2006,<br \/>\n\twhereby the Court has dealt with the rights of a person claiming<br \/>\n\tprotection as a protected or permanent tenant, and whereby the<br \/>\n\tCircular dated 7.10.2005 of the State Government has been quashed<br \/>\n\tand set aside, still holds the field. Since the Circular dated<br \/>\n\t7.10.2005 has not yet been restored, it cannot be made applicable to<br \/>\n\tthe case of the petitioners.\n<\/p>\n<p>In<br \/>\n\tview of the above facts and circumstances, the notice issued by the<br \/>\n\trespondent No.1 on 24.5.2007 (Annexure-A to the petition) insofar as<br \/>\n\tit relates to the Circular dated 7.10.2005 of the State Government,<br \/>\n\tis quashed and set aside, with the clarification that the present<br \/>\n\tdirection shall not operate as a bar to the Collector in exercising<br \/>\n\tother statutory powers, as may be available under the Act, and nor<br \/>\n\tshall the bar operate for other remedial measures against the order<br \/>\n\tof the Mamlatdar and ALT dated 29.10.2002, if otherwise permissible<br \/>\n\tin law.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of in the above terms.
