Civil Application No. 5463 of 2001\n           GOVERNMENT PLEADER for Petitioner No. 1-2\n           .......... for Respondent No. 1\n           MR JB PARDIWALA for Respondent No. 1\/1-1\/2,2\n           RULE SERVED for Respondent No. 1\/3\n\n\n      --------------------------------------------------------------\n\n\n                   CORAM : MR.JUSTICE A.M.KAPADIA\n\n\n                   Date of Order: 25\/11\/2002\n\n\n ORAL ORDER<\/pre>\n<p>      By filing this application under Section 5 of the<br \/>\n      Limitation   Act,   applicants,   State of Gujarat and<br \/>\n      Mamlatdar Shree, Navsari have prayed to condone the delay<br \/>\n      of 20 days caused in filing the above First Appeal (Stamp<br \/>\n      Number) 7274 of 2000 which is directed against the<br \/>\n      judgement and decree dated June 30, 2000 rendered in<br \/>\n      Special Civil Suit No. 37 of 1991 by the learned Civil<br \/>\n      Judge (S.D.), Navsari, by which the suit filed by the<br \/>\n      applicants came to be dismissed, on the grounds stated in<br \/>\n      the application.\n<\/p>\n<p>      2.The reason as to why the appeal could not be<br \/>\n      filed in time are detailed in paragraph 1 of the<br \/>\n      application    which    talk    about    intra-department<br \/>\n      inter-department procedure which has caused the delay in<br \/>\n      filing the application. There was no negligence on the<br \/>\n      part of the appellants in prosecuting the matter. The<br \/>\n      appellants have never abandoned the lis and therefore, it<br \/>\n      is prayed to condone the delay.\n<\/p>\n<p>       3.Respondents are duly served. Mr. J.B.Pardiwala,<br \/>\n      learned advocate appears for them and states          that<br \/>\n      appropriate order may be passed having regard to the<br \/>\n      settled law enunciated by the Supreme Court in the<br \/>\n      matters of; (i) <a href=\"\/doc\/644440\/\">State of Bihar &amp; Others v. Kamleshwar<br \/>\n      Prasad Singh &amp;<\/a> another, 2000 AIR SCW 2388 (para 11 to 14<br \/>\n      of the reported judgement, (ii) <a href=\"\/doc\/1240908\/\">N.Balakrishnan v. M<br \/>\n      Krishnanmurthy, Judgement Today<\/a> 1998 (6) SC 242, (iii)<br \/>\n      <a href=\"\/doc\/852301\/\">State of Haryana v. Chandra Mani &amp; Others, AIR<\/a> 1996 SC<br \/>\n      1623, (iv) <a href=\"\/doc\/1909040\/\">Spl. Tehsildars, Land Acquisition, Kerala v.<br \/>\n      K.V.Ayisumma,   AIR<\/a>   1996 SC 2750, (v) Punjab Small<br \/>\n      Industries and Export Corporation Ltd.     and others v.<br \/>\n      Union of India and others, 1995 Suppl. (4) SCC 681, (vi)<br \/>\n      P.K.Ramachandran v.     State of Kerala &amp; another (1997) 7<br \/>\n      SCC 566 and (vii) <a href=\"\/doc\/1117226\/\">Collector, Land Acquisition, Anantnag<br \/>\n      v. Mst.     Katiji, AIR<\/a> 1987 SC 1353 and other relevant<br \/>\n      decisions on the point.\n<\/p>\n<p>      4.Applying the principles laid down by the Supreme<br \/>\n      Court to the facts of the present case, and more<br \/>\n      particularly uncontroverted versions on which the delay<br \/>\n      is sought to be condoned, I am satisfied that sufficient<br \/>\n      cause is made out by the applicants for condonation of<br \/>\n      delay. The record does not indicate that there was any<br \/>\n      inaction or negligence on the part of the applicants in<br \/>\n      prosecuting the appeal.     The explanation for     delay<br \/>\n      offered by the applicants is not only plausible but<br \/>\n      acceptable and, therefore, the application deserves to be<br \/>\n      granted.\n<\/p>\n<p>      5.For the foregoing reasons,     the   application<br \/>\n      succeeds.    Delay caused in filing the above numbered<br \/>\n      appeal is condoned.
