    Revision petitioner is the accused and first<\/p>\n
respondent the complainant in S.T.2109\/2007 on the<\/p>\n
file  of   Judicial   First   Class   Magistrate-II<\/p>\n
(Mobile), Kozhikode.   First respondent filed the<\/p>\n
complaint contending that on 10.4.2005 petitioner<\/p>\n
borrowed  Rs.25,000\/- and   towards  its  repayment<\/p>\n
issued Ext.P1 cheque dated 23.5.2005 drawn in his<\/p>\n
account maintained in Kozhikode Branch of State<\/p>\n
Bank of India and when the cheque was presented<\/p>\n
under  Ext.P2  it  was  dishonoured  for  want   of<\/p>\n
sufficient funds   and  inspite  of  Ext.P3  notice<\/p>\n
served on the petitioner under Ext.P4,  he did not<\/p>\n
repay the amount and thereby committed the  offence<\/p>\n
under section 138 of Negotiable Instruments Act.<\/p>\n
Petitioner pleaded not guilty.    First respondent<\/p>\n
examined as PW1 and Ext.P1 to P4 were marked. On<\/p>\n
the side of the petitioner  a witness was examined<\/p>\n
CRRP 3666\/2008              2<\/span><\/p>\n
as DW1.      Learned Magistrate on the evidence found<\/p>\n
the evidence of PW1        credible and reliable and<\/p>\n
convicted the petitioner for the offence under<\/p>\n
section 138 of Negotiable Instruments Act.      He was<\/p>\n
sentenced to imprisonment till rising of     court and<\/p>\n
a compensation of Rs.25,000\/- and in default simple<\/p>\n
imprisonment for two months.     Petitioner challenged<\/p>\n
the conviction and sentence before Sessions Court,<\/p>\n
Kozhikode     in  Crl.A.506\/2007.  Learned  Additional<\/p>\n
Sessions     Judge  on   reappreciation  of   evidence<\/p>\n
confirmed the conviction and sentence and dismissed<\/p>\n
the appeal.     It is challenged in this revision.<\/p>\n
    2.      Learned counsel appearing for petitioner<\/p>\n
was heard.\n<\/p>\n
    3.    The argument of the learned counsel is that<\/p>\n
courts    below   did  not  properly   appreciate  the<\/p>\n
evidence.     It was argued that DW1 who is none other<\/p>\n
than the brother-in-law of first respondent was<\/p>\n
examined and       evidence of DW1 establishes that<\/p>\n
revision petitioner borrowed Rs.5,000\/- in 2000 and<\/p>\n
a cheque was issued as security which was not<\/p>\n

returned     and  on  the  request  of  the   revision<\/p>\n
petitioner, DW1 had intervened and first respondent<\/p>\n
had admitted that some amount towards interest is<\/p>\n
due    and     therefore  the    conviction   is   not<\/p>\n
sustainable.    It was also argued that Ext.P1 cheque<\/p>\n
is a typewritten cheque which may not     the case in<\/p>\n
the   normal course and if the evidence is properly<\/p>\n
appreciated it can only be found that Ext.P1 cheque<\/p>\n
was not issued to first respondent, much less<\/p>\n
towards    discharge of any legally recoverable debt.<\/p>\n
    4.     On hearing the learned counsel and going<\/p>\n
through the judgments, I cannot agree with the<\/p>\n
submission      of    the   learned    counsel    that<\/p>\n
appreciation     of  evidence   was   not  proper   or<\/p>\n
perverse.     When first respondent was examined there<\/p>\n
was no case for the revision petitioner that his<\/p>\n
brother-in-law DW1 had intervened in the dispute or<\/p>\n
any incident as spoken to by DW1 had taken place.<\/p>\n
If in fact Ext.P1 cheque was not issued to first<\/p>\n
respondent towards      repayment of the amount, and<\/p>\n
was issued as security for a loan obtained in 2000,<\/p>\n
CRRP 3666\/2008             4<\/span><\/p>\n
on receipt of Ext.P4 notice, in the ordinary course<\/p>\n
revision petitioner would have sent a reply.      The<\/p>\n
fact that no reply was sent cast serious doubt on<\/p>\n
the   genuineness    of   the  plea  raised  by   the<\/p>\n
petitioner.     Moreover a reading of the deposition<\/p>\n
of DW1, which was read over by the learned counsel,<\/p>\n
makes it clear that he is only deposing in favour<\/p>\n
of first respondent either because of his affinity<\/p>\n
towards the revision petitioner or enmity towards<\/p>\n
the first respondent.      In any case his evidence<\/p>\n
cannot be relied on especially when such a case was<\/p>\n
not put to PW1 while he was cross examined.      When<\/p>\n
the entire evidence is appreciated, the view taken<\/p>\n
by the courts below, is the only possible and<\/p>\n
reasonable view that could be taken.        As it is<\/p>\n
proved    that   Ext.P1  cheque  was  issued  towards<\/p>\n
repayment     of  the  amount  borrowed and   it  was<\/p>\n
dishonoured    for want of sufficient funds and first<\/p>\n
respondent has complied with all the        statutory<\/p>\n
formalities provided under section 138 and 142 of<\/p>\n
Negotiable     Instruments  Act,  his  conviction  is<\/p>\n
CRRP 3666\/2008              5<\/span><\/p>\n
perfectly legal.\n<\/p>\n
    5. Then the only question is regarding the<\/p>\n
sentence.     Learned Magistrate sentenced  petitioner<\/p>\n
only to imprisonment till rising of         court, in<\/p>\n
addition to      compensation which is also only for<\/p>\n
the amount covered by the dishonoured cheque.       In<\/p>\n
such circumstance, I find no reason to interfere<\/p>\n
with the sentence also.\n<\/p>\n
    Revision is dismissed.\n<\/p>\n<\/p>\n
