Learned Advocate for the petitioner<br \/>\nsubmitted that the learned Judge has committed an error in ordering<br \/>\n20% back wages till the date of superannuation, which is 28.02.2006<br \/>\nwith all consequential benefits, which has aggravated the adverse<br \/>\neffect.\n<\/p>\n<p>2.1\t\tLearned<br \/>\nAdvocate for the petitioner submitted that out of 74 defaults, for<br \/>\none of the defults, the respondent-workman was awarded punishment of<br \/>\ndismissal, but later on, the same was varied and he was continued in<br \/>\nservice.  Learned Advocate for the petitioner submitted that the<br \/>\nrespondent-workman was punished by stoppage of increments, which some<br \/>\nwere with future effect and others were without future effect.\n<\/p>\n<p>2.3\t\tLearned<br \/>\nAdvocate for the petitioner submitted that in light of that, to award<br \/>\n20% back wages till the date of superannuation is too harsh an order,<br \/>\ncausing loss to the public exchequer.  Learned Advocate for the<br \/>\npetitioner submitted that the defaults are of &#8216;financial<br \/>\nirregularities&#8217; as the respondent-workman was serving as &#8216;Conductor&#8217;.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned Advocate for the parties, this Court is of the<br \/>\nopinion that it will be in fitness of things if the award and order<br \/>\ndated 03.09.2010 is modified to the effect that the<br \/>\nrespondent-workman be allowed to retire from service on 17.01.1996,<br \/>\nthat will be without any stigma and the respondent-workman will be<br \/>\nentitled to receive whatever benefits he is entitled to on his<br \/>\nwalking out of the service on 17.01.1996.  This will be as a part of<br \/>\nexercise of balancing the interest of both the parties.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe result, the petition is partly allowed.  Award and order dated<br \/>\n03.09.2010 is modified. The petitioner-GSRTC is directed to allow the<br \/>\nrespondent-workman to retire with effect from 17.01.1996.  Rule is<br \/>\nmade absolute to the aforesaid extent.
