No. 207\/04<br \/>\n\talleging that the petitioners had produced false and fabricated<br \/>\n\tdocuments for availing of a loan of Rs.4 lacs from the Bank and had<br \/>\n\tnot repaid the outstanding amount of Rs.14,22,439.51 due and payable<br \/>\n\tto the Bank and thereby committed the offence punishable under<br \/>\n\tsections 406, 420, 467, 471 and 120-B of the Indian Penal Code. Upon<br \/>\n\tculmination of the investigation, charge sheet was filed by the<br \/>\n\tInvestigating Officer and the proceedings are pending before the<br \/>\n\tlearned Metropolitan Magistrate, Court No.16, Ahmedabad vide<br \/>\n\tCriminal Case No.364 of 2004. According to the petitioners, they<br \/>\n\thave repaid the entire amount due and payable to the respondent No.2<br \/>\n\tBank, pursuant to which, the Bank has issued a no due certificate on<br \/>\n\t27th March, 2006, which is annexed as Annexure C to the<br \/>\n\tpetition. It is the case of the petitioners that in view of the<br \/>\n\tsettlement arrived at between the petitioners and the complainant<br \/>\n\tBank, the complainant and other officers of the Bank are no longer<br \/>\n\tinterested in the compliant and therefore, do not attend the<br \/>\n\tproceedings before the learned Magistrate. That in the<br \/>\n\tcircumstances, the petitioners are required to attend the Court on<br \/>\n\tall dates when the matter is fixed. However, in absence of the<br \/>\n\tofficers of the respondent Bank, the case is not proceeding any<br \/>\n\tfurther. It is submitted that in the circumstances, when the Bank is<br \/>\n\tno longer interested in pursuing the complaint, the First<br \/>\n\tInformation Report in question deserves to be quashed.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tDipen K. Dave, learned advocate for the petitioners has submitted<br \/>\n\tthat in view of the fact that the petitioners have paid all the dues<br \/>\n\tof the Bank, the grievance of the respondent No.2 ?  original<br \/>\n\tcomplainant no longer survives, hence the complainant is no longer<br \/>\n\tinterested in pursuing the matter any further, due to which, the<br \/>\n\tproceedings before the learned Metropolitan Magistrate are<br \/>\n\tunnecessarily dragged on. It is submitted that in the circumstances,<br \/>\n\twhen the complainant is no longer interested in pursuing the<br \/>\n\tcomplaint any further, continuation of the proceedings against the<br \/>\n\tpresent petitioners is an abuse of the process of Court.\n<\/p>\n<p>In<br \/>\n\tresponse to the issuance of Rule in the matter, the respondent No.2<br \/>\n\tBank has filed appearance through learned advocate Mr. L.M. Zala.<br \/>\n\tThe learned advocate for the respondent No.2 has reiterated the<br \/>\n\tsubmissions advanced by the learned advocate for the petitioners. He<br \/>\n\thas submitted that as the dues of the Bank are fully repaid, the<br \/>\n\tBank is no longer interested in pursuing the complaint any further<br \/>\n\tand has no objection if the complaint in question is quashed.\n<\/p>\n<p>This<br \/>\n\tCourt in the case of <a href=\"\/doc\/8769951\/\">Rajeshbhai<br \/>\n\tNatwarlal Agrawal and Ors. v. State of Gujarat<\/a><br \/>\n\t(2005) 3 GLH 504 has, after considering various decisions on the<br \/>\n\tissue, held that it would not be just and proper nor it would be in<br \/>\n\tthe interest of justice to compel the parties to face trial despite<br \/>\n\tthere being settlement.  The Punjab and Haryana High Court in the<br \/>\n\tcase of Inderjitsinh v. State of U.T.,<br \/>\n\tChandigarh &amp; Anr. III<br \/>\n\t(2006) CCR 24 has held that continuation of proceedings will be an<br \/>\n\texercise in futility where the parties have amicably settled the<br \/>\n\tdispute and have compromised the matter.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe facts of the present case in the light of the decisions cited<br \/>\n\thereinabove, the parties to the dispute have settled the matter<br \/>\n\tbetween them. Evidently, the Bank is no longer interested in<br \/>\n\tpursuing the complaint any further, which has resulted into the<br \/>\n\tpetitioners being put to undue harassment, as on behalf of the<br \/>\n\tcomplainant, nobody remains present before the learned Metropolitan<br \/>\n\tMagistrate. In the circumstances, the ends of justice would best be<br \/>\n\tserved if the complaint in question is quashed. This is therefore, a<br \/>\n\tfit case for exercise of powers under section 482 of the Code, with<br \/>\n\ta view to prevent the abuse of the process of Court.\n<\/p>\n<p>\tFor<br \/>\n\tthe foregoing reasons, the application succeeds and is accordingly<br \/>\n\tallowed. The First Information Report being Kalupur Police Station I<br \/>\n\tC.R. No. 207\/04 as well as the proceedings of Criminal Case No.364<br \/>\n\tof 2004 pending before the learned Metropolitan Magistrate, Court<br \/>\n\tNo.16, Ahmedabad, are hereby quashed. Rule is made absolute.
