Justice K.T.SANKARAN\n\n Dated :28\/07\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 3417 OF 2009\n             ------------------------------------------------------\n                  Dated this the 28th July, 2009\n\n\n                                O R D E R\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioners are accused Nos.1<\/p>\n<p>and 2 in Crime No.138 of 2009 of Sakthikulangara Police Station.<\/p>\n<p>       2.   The offence alleged against the petitioners are under<\/p>\n<p>Section 498A read with Section 34 of the Indian Penal Code.<\/p>\n<p>       3. I have perused the case diary.\n<\/p>\n<\/p>\n<p>       4.  Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of the<\/p>\n<p>view that anticipatory bail can be granted to the petitioners. There<\/p>\n<p>will be a direction that in the event of the arrest of the petitioners, the<\/p>\n<p>officer in charge of the police station shall release them on bail on<\/p>\n<p>their executing bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>for the like amount to the satisfaction of the officer concerned,<\/p>\n<p>subject to the following conditions:<\/p>\n<p>B.A. NO. 3417 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<\/p>\n<p>      a)   The first petitioner shall report before the investigating<br \/>\n            officer between 9 A.M.        and 11 A.M. on alternate<br \/>\n            Mondays, till the final report is filed or until further<br \/>\n            orders;\n<\/p>\n<p>      b)   The petitioners shall appear before the investigating<br \/>\n            officer for interrogation as and when required;<\/p>\n<p>      c)   The petitioners shall not try to influence the prosecution<br \/>\n            witnesses or tamper with the evidence;<\/p>\n<p>      d)   The petitioners shall not commit any offence or indulge<br \/>\n            in any prejudicial activity while on bail;<\/p>\n<p>      e)   In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                   (K.T.SANKARAN)<br \/>\n                                                          Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Atul Renjithlal vs State Of Kerala on 28 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3417 of 2009() 1.
