ABUDULLA HAJAM.                     ......PETITIONERS.\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2   20.04.2011               Heard learned counsel for the petitioners and learned<\/p>\n<p>                 counsel for the State.\n<\/p>\n<p>                             Unbelievable rather apparently false allegation is<\/p>\n<p>                 levelled that complainant was robbed in lane then after taken in a<\/p>\n<p>                 house for ransom, robbed and attempted to be rapped by the father,<\/p>\n<p>                 his sons, his son-in-law and his son. While three police cases on<\/p>\n<p>                 behalf of accused party are filed against family members of the<\/p>\n<p>                 complainant. Present case is complaint case. The difference between<\/p>\n<p>                 police case and complaint case is that in complaint case accused<\/p>\n<p>                 persons have no opportunity to place their case while such<\/p>\n<p>                 opportunity is their in the police case before the I.O.<\/p>\n<p>                             Considering the facts and circumstances of the case,<\/p>\n<p>                 prayer of the petitioners are allowed.\n<\/p>\n<p>                             In the event of arrest or surrender within one month<\/p>\n<p>                 from the date of receipt\/production of a copy of this order in<\/p>\n<p>                 connection with Complaint Case No. 499 of 2010 above named<\/p>\n<p>                 petitioners shall be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                 10,000\/- (ten thousand) each with two sureties of the like amount<\/p>\n<p>                 each to the satisfaction of the learned S.D.J.M., Bikramganj, Rohtas,<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>           subject to the conditions as laid down under Section 438(2) of<\/p>\n<p>           Cr.P.C.\n<\/p>\n<\/p>\n<pre>Bhardwaj                                       (Mandhata Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rojddin Hajam And Ors. vs The State Of Bihar on 20 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
