No. M-22378 of 2009 (O&amp;M)\n\n                                                   Date of decision: 22.9.2009\n\nSunil Kumar and another                                         ...Petitioners\n                                            vs\nState of UT Chandigarh and another                              ...Respondents\n\n\nCoram         Hon'ble Mr. Justice Rajesh Bindal\n\n\n\nPresent       Ms. Sumanjeet Kaur, Advocate, for the petitioners.\n\n              Ms. Ashima Mor, Advocate, for respondent no. 1.\n\n              Mr. ADS Sukhija, Advocate, for respondent no. 2.\n\n\nRajesh Bindal, J.\n<\/pre>\n<p>              Prayer in the present petition is for quashing of FIR No. 90 dated<br \/>\n8.6.2009, registered at Police Station Sector-19, Chandigarh, under Sections 420,<br \/>\n467, 468, 471 IPC and all subsequent proceedings arising therefrom.\n<\/p>\n<p>              Learned counsel for the petitioners submitted that the dispute<br \/>\nbetween the parties has been compromised with the intervention of the well-<br \/>\nwishers and keeping in view that peace and harmony is maintained. Compromise-<br \/>\ndeed has also been placed on record as Annexure P-1. He further submitted that<br \/>\nsince the matter has been compromised, the FIR deserves to be quashed. Reliance<br \/>\nhas been placed upon a five Judge Bench judgment of this Court in Kulwinder<br \/>\nSingh versus State of Punjab 2007 (3) Law Herald (P&amp;H) 2225.\n<\/p>\n<p>              Respondent no.2\/complainant has appeared in Court in person who<br \/>\nadmitted the factum of compromise between the parties and stated that he has no<br \/>\nobjection in case FIR in question is quashed. He has made a statement to this<br \/>\neffect in the court also.\n<\/p>\n<p>              Dealing with issue of quashing of FIR on the basis of compromise, a<br \/>\nBench consisting of five Hon&#8217;ble Judges of this Court in Kulwinder Singh&#8217;s case<br \/>\n(supra) while approving minority view in <a href=\"\/doc\/1718829\/\">Dharambir v. State of Haryana,<\/a> 2005<br \/>\n(2) Law Herald (P&amp;H) (FB) 723, opined as under:-\n<\/p>\n<blockquote><p>              &#8220;27.     To conclude, it can safely be said that there can never be any<br \/>\n                       hard and fast category which can be prescribed to enable the<br \/>\n                       Court to exercise its power under Section 482, of the Cr.P.C.\n<\/p><\/blockquote>\n<blockquote><p> Criminal Misc. No. M-22378 of 2009                      (2)<\/p>\n<p>        The only principle that can be laid down is the one which has<br \/>\n        been incorporated in the Section itself, i.e., &#8220;to prevent abuse<br \/>\n        of the process of any Court&#8221; or &#8220;to secure the ends of<br \/>\n        justice&#8221;.\n<\/p><\/blockquote>\n<p>28.     In Mrs. Shakuntala Sawhney Versus Mrs. Kaushalya<br \/>\n        Sawhney and others, (1980) 1 S.C.C. 63, Hon&#8217;ble Krishna<br \/>\n        Iyer, J. aptly summoned up the essence of compromise in the<br \/>\n        following words:-\n<\/p>\n<p>        &#8220;The finest hour of justice arrives propitiously when parties,<br \/>\n        despite falling apart, bury the hatchet and weave a sense of<br \/>\n        fellowship of reunion.&#8221;\n<\/p>\n<p>        The power to do complete justice is the very essence of every<br \/>\n        judicial justice dispensation system. It cannot be diluted by<br \/>\n        distorted perceptions and is not a slave to anything, except to<br \/>\n        the caution and circumspection, the standards of which the<br \/>\n        Court sets before it, in exercise of such plenary and<br \/>\n        unfettered power inherently vested in it while donning the<br \/>\n        cloak of compassion to achieve the ends of justice.\n<\/p>\n<p>29.     No embargo, be in the shape of Section 320(9) of the<br \/>\n        Cr.P.C., or any other such curtailment, can whittle down the<br \/>\n        power under Section 482 of the Cr.P.C.\n<\/p>\n<p>30.     The compromise, in a modern society, is the sine qua non of<br \/>\n        harmony and orderly behaviour. It is the soul of justice and if<br \/>\n        the power under Section 482 of the Cr.P.C is used to enhance<br \/>\n        such a compromise which, in turn, enhances the social amity<br \/>\n        and reduces friction, then it truly is &#8220;finest hour of justice&#8221;.<br \/>\n        Disputes which have their genesis in a matrimonial discord,<br \/>\n        landlord- tenant matters, commercial transactions and other<br \/>\n        such matters can safely be dealt with by the Court by<br \/>\n        exercising its powers under Section 482 of the Cr.P.C in the<br \/>\n        event of a compromise, but this is not to say that the power is<br \/>\n        limited to such cases. There can never be any such rigid rule<br \/>\n        to prescribe the exercise of such power, especially in the<br \/>\n        absence of any premonitions to forecast and predict<br \/>\n        eventualities which the cause of justice may throw up during<br \/>\n        the course of a litigation.\n<\/p>\n<p>31.     The only inevitable conclusion from the above discussion is<br \/>\n              Criminal Misc. No. M-22378 of 2009                      (3)<\/p>\n<p>                      that there is no statutory bar under the Cr.P.C which can<br \/>\n                      affect the inherent power of this Court under Section 482.<br \/>\n                      Further, the same cannot be limited to matrimonial cases<br \/>\n                      alone and the Court has the wide power to quash the<br \/>\n                      proceedings      even       in   non-compoundable     offences<br \/>\n                      notwithstanding the bar under Section 320 of the Cr.P.C., in<br \/>\n                      order to prevent the abuse of law and to secure the ends of<br \/>\n                      justice.\n<\/p>\n<p>             32.      The power under Section 482 of the Cr.P.C is to be exercised<br \/>\n                      Ex-Debitia Justitia to prevent an abuse of process of Court.<br \/>\n                      There can neither be an exhaustive list nor the defined para-<br \/>\n                      meters to enable a High Court to invoke or exercise its<br \/>\n                      inherent powers. It will always depend upon the facts and<br \/>\n                      circumstances of each case. The power under Section 482 of<br \/>\n                      the Cr.P.C has no limits. However, the High Court will<br \/>\n                      exercise it sparingly and with utmost care and caution. The<br \/>\n                      exercise of power has to be with circumspection and<br \/>\n                      restraint. The Court is vital and an extra-ordinary effective<br \/>\n                      instrument to maintain and control social order. The Courts<br \/>\n                      play role of paramount importance in achieving peace,<br \/>\n                      harmony and ever-lasting congeniality in society. Resolution<br \/>\n                      of a dispute by way of a compromise between two warring<br \/>\n                      groups, therefore, should attract the immediate and prompt<br \/>\n                      attention of a Court which should endeavour to give full<br \/>\n                      effect to the same unless such compromise is abhorrent to<br \/>\n                      lawful composition of the society or would promote<br \/>\n                      savagery.&#8221;\n<\/p>\n<p>             Compromise in modern society is the sine qua non of harmony and<br \/>\norderly behaviour. As observed by Krishna Iyer J., the finest hour of justice arrives<br \/>\npropitiously when parties despite falling apart, bury the hatchet and weave a sense<br \/>\nof fellowship of reunion. Inherent power of the Court under Section 482 Cr.P.C is<br \/>\nnot limited to matrimonial cases alone. The Court has wide powers to quash the<br \/>\nproceedings even in non-compoundable offences in order to prevent abuse of<br \/>\nprocess of law and to secure ends of justice, notwithstanding bar under Section<br \/>\n320 Cr.P.C. Exercise of power in a given situation will depend on facts of each<br \/>\ncase. The duty of the Court is not only to decide a lis between the parties after a<br \/>\nprotracted litigation but it is a vital and extra-ordinary instrument to maintain and<br \/>\n               Criminal Misc. No. M-22378 of 2009                   (4)<\/p>\n<p>control social order. Resolution of dispute by way of compromise between two<br \/>\nwarring groups should be encouraged unless such compromise is abhorrent to<br \/>\nlawful composition of society or would promote savagery, as held in Kulwinder<br \/>\nSingh&#8217;s case (supra).\n<\/p>\n<p>              Keeping in view the enunciation of law as referred to above and<br \/>\napplying the same to the facts and circumstances of the present case, once the<br \/>\nmatter has been compromised between the parties, no useful purpose will be<br \/>\nserved by proceeding with the prosecution.
