BASANT, J.\n\n              -------------------------------------------------\n\n                        B.A.NO.4005 OF  2007\n\n              -------------------------------------------------\n\n                Dated this the 4th  day of July, 2007\n\n\n\n                                  ORDER\n<\/pre>\n<p>      Application for anticipatory bail.   The petitioner is the 1st<\/p>\n<p>accused in a crime registered, inter alia, under Sec.420 of the<\/p>\n<p>IPC.    The crux of the allegations against the petitioner is that<\/p>\n<p>he,   using   bogus   and   non-genuine   pattas,   had   defrauded   the<\/p>\n<p>banks   and   induced   them   to   part   with   loan   amounts.       The<\/p>\n<p>pattas were not genuine and were obtained fraudulently by the<\/p>\n<p>1st accused in collusion with the 2nd accused.   A crime has been<\/p>\n<p>registered on the basis of a complaint filed after the fraud was<\/p>\n<p>discovered in  the course of the revenue recovery proceedings<\/p>\n<p>by   the   officials.   Investigation   is   in   progress.     The   petitioner<\/p>\n<p>apprehends   imminent   arrest.       The   2nd  accused   is   allegedly   a<\/p>\n<p>person employed in the Land Tribunal.   In collusion with him,<\/p>\n<p>the   petitioner   is   alleged   to   have   brought   into   existence   the<\/p>\n<p><span class=\"hidden_text\">  B.A. NO. 4005 of 2007                 -: 2 :-<\/span><\/p>\n<p>non-genuine pattas.\n<\/p>\n<\/p>\n<p>       2.   The learned counsel for the petitioner   submits that the<\/p>\n<p>petitioner   is   absolutely   innocent.       The   learned   counsel   points<\/p>\n<p>out   that   the   pattas   in   question   are   not   the   ones   issued   in   his<\/p>\n<p>name.   They are issued in the name of the father and the brother<\/p>\n<p>of the petitioner.   The petitioner had only acted as the holder of<\/p>\n<p>their  Power-of-Attorney to pledge the documents and avail  loan<\/p>\n<p>from   the   financial   institutions.       In   these   circumstances,     the<\/p>\n<p>petitioner   does  not  deserve   to   suffer  the   trauma   of  undeserved<\/p>\n<p>arrest and   detention.     Anticipatory bail may be granted to the<\/p>\n<p>petitioner, prays the learned counsel for the petitioner.<\/p>\n<p>       2.    The learned Public Prosecutor opposes the application.<\/p>\n<p>The   learned   Public   Prosecutor   submits   that  the   investigation   is<\/p>\n<p>at a very  early stage.     It  would be  puerile  now to assume that<\/p>\n<p>the   petitioner   &#8211;   the   Power-of-Attorney   holder,   has   no<\/p>\n<p>contumacious   responsibility   for   the   culpable   indiscretion<\/p>\n<p>committed   and   that   all     blame   can   be   left   at   the   doors   of   the<\/p>\n<p>father   and   brother   of  the   petitioner   in  whose  names   the  pattas<\/p>\n<p>now stand.     At any rate, the petitioner may not be permitted to<\/p>\n<p>arm   himself   with   an   order   of   anticipatory   bail   which   would<\/p>\n<p>effectively frustrate the ability of the Investigator to discover and<\/p>\n<p>arrive   at   the   truth.     Custodial   interrogation   is   absolutely<\/p>\n<p><span class=\"hidden_text\">  B.A. NO. 4005 of 2007                  -: 3 :-<\/span><\/p>\n<p>essential   in   a   case   like   this   to   unravel   the   truth,   submits   the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<\/p>\n<p>        3.     Having considered all the relevant inputs, I find merit<\/p>\n<p>in   the   opposition   by   the   learned   Public   Prosecutor.     This,   I   am<\/p>\n<p>satisfied,   is   a   fit   case   where   the   extraordinary   equitable<\/p>\n<p>discretion   under   Sec.438   of   the   Cr.P.C.   can   or   ought   to   be<\/p>\n<p>invoked in favour of the petitioner.    This is an eminently fit case<\/p>\n<p>where   the   petitioner   must   resort   to   the   normal   and   ordinary<\/p>\n<p>procedure of appearing before the  Investigating Officer  or the<\/p>\n<p>learned   Magistrate   having   jurisdiction.       He   must   then   seek<\/p>\n<p>regular bail in the ordinary course.\n<\/p>\n<\/p>\n<p>        4.     In   the   result,   this   petition   is   dismissed.     But   I   may<\/p>\n<p>hasten   to   observe   that  if   the   petitioner   surrenders   before   the<\/p>\n<p>Investigating Officer  or the learned Magistrate and seeks bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the   case,   the   learned   Magistrate   must   proceed   to   pass<\/p>\n<p>appropriate orders on merits and expeditiously &#8211; on the date of<\/p>\n<p>surrender itself.\n<\/p>\n<\/p>\n<p>                                                                       Sd\/-<\/p>\n<pre>\n\n                                                         (R.
