JOSEPH, JJ.\n              ================================\n                    M.F.A.No.993 of 2001 - D\n                                and\n                   Cross Objection 82 of 2004\n                                in\n                    M.F.A.No.993 of 2001 - D\n                                and\n                   M.A.C.A.No.1699 of 2006 - D\n               ===============================\n            Dated this the 20th day of November, 2008.\n\n                         J U D G M E N T\n<\/pre>\n<p>KOSHY, J.\n<\/p>\n<p>     Husband of the 1st petitioner sustained injuries in a motor<\/p>\n<p>accident on 24.1.1997.      He succumbed to the injuries on<\/p>\n<p>27.1.1997. His wife and three minor children filed application for<\/p>\n<p>compensation under Section 163-A of the Act.       The insurance<\/p>\n<p>company    though   admitted    coverage   of   insurance  policy,<\/p>\n<p>contended that the accident occurred due to the negligence of the<\/p>\n<p>deceased himself and therefore, no compensation is payable.<\/p>\n<p>The motor cycle which the deceased was riding capsized and<\/p>\n<p>death was caused. Merely because of the fact that the motor<\/p>\n<p>cycle capsized and death was caused, it cannot be said that the<\/p>\n<p>deceased was negligent. There can be speedy crossing of the<\/p>\n<p>road by an animal, skidding etc. and the vehicle capsized. Since<\/p>\n<p>the rider of the motor cycle died, he cannot come and give<\/p>\n<p>evidence regarding the cause of accident.           There is no<\/p>\n<p>independent witness regarding the accident.       So, we cannot<\/p>\n<p>M.A.C.A.No.1699 of 2006 &#8211; D<br \/>\n            and<br \/>\n M.F.A.No.993 of 2001 &#8211; D<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>presume negligence of the deceased.              Under Section 163A,<\/p>\n<p>negligence need not also be proved. In this connection, we refer to<\/p>\n<p>the decision of the Full Bench decision of this Court in <a href=\"\/doc\/568313\/\">National<\/p>\n<p>Insurance Co. Ltd. v. Malathi C. Salian<\/a> (2003(3) KLT 460 FB). A<\/p>\n<p>similar matter was considered by this Court in <a href=\"\/doc\/1667378\/\">Oriental<\/p>\n<p>Insurance Company v. Smt.Baby and Others<\/a> (2008(4) KHC<\/p>\n<p>103). It was held as follows:\n<\/p>\n<blockquote><p>                &#8220;The need for Section 163-A was explained by<br \/>\n         the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/190580\/\">Oriental Insurance Co.<br \/>\n         v. Hansrajbhai<\/a> (2001(5) SCC 175). The Supreme<br \/>\n         Court in the above case held that if the Insurance<br \/>\n         Company is permitted to prove that insured is not at<br \/>\n         fall, though his vehicle is involved then the whole<br \/>\n         purpose of Legislature in introducing Section 163-A<br \/>\n         will be frustrated.  It was further held that if the<br \/>\n         insurance company is permitted to prove the<br \/>\n         negligence even of the victim or no negligence of the<br \/>\n         insured, then the purpose for which the Legislature<br \/>\n         introduced Section 163-A would be frustrated.<br \/>\n         Sections 140 and 163-A are based on strict liability<br \/>\n         principle formulated in Rylands v. Fletcher (1861-73<br \/>\n         All ER (Reprint) 1). A joint reading of sections would<br \/>\n         show that for death or permanent disablement<br \/>\n         suffered due to accident arising out of the use of<br \/>\n         motor vehicles, the claimants need not prove the<br \/>\n         wrongful act or neglect or default of anyone. So,<br \/>\n         third party need not be involved in this case. The<br \/>\n         Apex Court in <a href=\"\/doc\/1516682\/\">Kaushnuma Begum and Others v. New<br \/>\n         India Assurance Co. Ltd., (AIR<\/a> 2001 SC 485)<br \/>\n         awarded compensation where the accident occurred<br \/>\n         due to the bursting of tyres. A Full Bench of this<br \/>\n         Court has considered the matter in detail in <a href=\"\/doc\/568313\/\">National<br \/>\n         Insurance Co. Ltd. v. Malathi C. Salian<\/a> (2003 (3) KLT<br \/>\n         460 (FB))&#8221;.\n<\/p><\/blockquote>\n<p>M.A.C.A.No.1699 of 2006 &#8211; D<br \/>\n            and<br \/>\n M.F.A.No.993 of 2001 &#8211; D<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>      2.    In the above referred Division Bench Decision,<\/p>\n<p>difference between claims under Sections 166, 163-A and 140 is<\/p>\n<p>also mentioned.        In this case, since the appellants filed claim<\/p>\n<p>petition under 163-A, they did not adduce any evidence regarding<\/p>\n<p>the accident, as negligence need not be proved. In fact, no<\/p>\n<p>evidence was adduced by the insurance company to prove that<\/p>\n<p>the deceased was negligent. They only produced the policy. In<\/p>\n<p>the above circumstances, we are of the opinion that the Tribunal<\/p>\n<p>ought to have considered the claim for compensation based on<\/p>\n<p>Section 163-A. Against the award of the Motor Accidents Claims<\/p>\n<p>Tribunal, the insurance company filed the appeal M.F.A.No.993 of<\/p>\n<p>2001. According to the appellant when a claim petition was filed<\/p>\n<p>under Section 163-A, the Tribunal cannot award compensation<\/p>\n<p>under Section 140.         The claimants did not file any application<\/p>\n<p>under Section 140. It is well settled law that when claim petition<\/p>\n<p>is filed under Section 163-A, compensation cannot be granted<\/p>\n<p>under Section 140 as both are entirely different. It is true that,<\/p>\n<p>after granting compensation under Section 140, Section 166 will<\/p>\n<p>lie. The Tribunal went wrong in awarding compensation under<\/p>\n<p>Section 140. Therefore, we allow the appeal preferred by the<\/p>\n<p>M.A.C.A.No.1699 of 2006 &#8211; D<br \/>\n            and<br \/>\n M.F.A.No.993 of 2001 &#8211; D<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>insurance company so far as the award allowed under Section<\/p>\n<p>140.<\/p>\n<p>      3.    One of the claimants filed cross objection 82 of 2004<\/p>\n<p>and another claimant, who at the time of accident was minor son,<\/p>\n<p>on becoming major filed the appeal as M.A.C.A.No.1699 of 2006.<\/p>\n<p>We are of the opinion that the Tribunal went in wrong in not<\/p>\n<p>awarding compensation under Section 163-A, for the reasons<\/p>\n<p>already stated.        In the above circumstances, the matter is<\/p>\n<p>remanded to the Tribunal. Both the appeal and cross objection<\/p>\n<p>are allowed to the above extent. We are of the opinion that the<\/p>\n<p>Tribunal ought to have granted compensation under Section 163-<\/p>\n<p>A. It is true that if the owner (insurer) himself was a rider, the<\/p>\n<p>claim under Section 163-A will not lie against insurance company<\/p>\n<p>as essentially the liability is on the owner of the vehicle. Here,<\/p>\n<p>the deceased was not the owner of the vehicle and the insurance<\/p>\n<p>company is liable to deposit the amount under Section 163-A.<\/p>\n<p>For calculating compensation, monthly income of the claimants at<\/p>\n<p>the time of filing the application and age of the accident victim<\/p>\n<p>have to be found out. If the annual income of the deceased was<\/p>\n<p>more than Rs.40,000\/-, claim under Section 163-A will not lie.<\/p>\n<p>M.A.C.A.No.1699 of 2006 &#8211; D<br \/>\n            and<br \/>\n M.F.A.No.993 of 2001 &#8211; D<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>But the income claimed was only Rs.3,000\/- per month<\/p>\n<p>(Rs.36,000\/- per year).      Both sides are allowed to adduce<\/p>\n<p>evidence only regarding age of the victim and income so as to<\/p>\n<p>calculate compensation payable to the claimants. The parties are<\/p>\n<p>directed to appear before the Tribunal on 3.1.2009.<\/p>\n<p>      Both appeals and cross objection are allowed to the above<\/p>\n<p>extent.\n<\/p>\n<p>                                               J.B.KOSHY, JUDGE<\/p>\n<p>                                     THOMAS P.
