THAKUR, J.\n<\/p>\n<\/p>\n<p>1.    In this petition for special leave to appeal the petitioners<\/p>\n<p>call in question the correctness of an order dated 20th July,<\/p>\n<p>2009 passed by a Division Bench of the High Court of Delhi<\/p>\n<p>whereby L.P.A. No.1307 of 2007 filed by the petitioners has<\/p>\n<p>been dismissed with costs assessed at Rs.75,000\/- and<\/p>\n<p>directions issued by the learned Single Judge of the High<\/p>\n<p>Court in W.P.(C) No. 11778 of 2006 affirmed.<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>2.   The facts giving rise to the filing of the writ petition and<\/p>\n<p>the Letters Patent Appeal have been set out in detail by the<\/p>\n<p>High Court making it unnecessary for us to state them over<\/p>\n<p>again. Suffice it to say that W.P.(C) 11778 of 2006 was filed by<\/p>\n<p>the teachers employed with the petitioner society running a<\/p>\n<p>neighbourhood school at Tis January Lane, New Delhi falling<\/p>\n<p>within the NDMC area. With the allotment of an area<\/p>\n<p>measuring 2.284 acres at Sadiq Nagar in favour of the<\/p>\n<p>petitioner &#8211; society the temporary allotment made in favour of<\/p>\n<p>the petitioner&#8217;s society at Tis January Lane came to an end on<\/p>\n<p>31st of March, 1997. The society was accordingly asked to<\/p>\n<p>hand over the possession of the land but since the school was<\/p>\n<p>catering to the needs of about 500 students and several<\/p>\n<p>teachers had been employed by the society to impart<\/p>\n<p>education   to        the   students,    practical   difficulties   were<\/p>\n<p>encountered      in     handing   over    the   site.   After   detailed<\/p>\n<p>deliberations and prolonged correspondence the NDMC offered<\/p>\n<p>to take over the school on &#8220;as is where is&#8221; basis. A letter to<\/p>\n<p>that effect was issued by the L&amp;DO on 1st April, 2002. The<\/p>\n<p>possession of the school was pursuant to that letter handed<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>over to the L&amp;DO on 8th March, 2006, who on the same day<\/p>\n<p>delivered the possession of the school building to the NDMC.<\/p>\n<p>3.   In the meantime the society filed Writ Petition (Civil)<\/p>\n<p>17889-90 of 2005 seeking permission to construct a building<\/p>\n<p>for a senior secondary school at Sadiq Nagar over the site<\/p>\n<p>allotted in its favour. The High Court allowed that writ petition<\/p>\n<p>by its order dated 16th March, 2006. It is note-worthy that in<\/p>\n<p>the said proceedings the society had made a categorical<\/p>\n<p>statement that students studying in the Tis January Lane<\/p>\n<p>school can be accommodated by the society in the school<\/p>\n<p>being run by it at Andrews Ganj on freeship basis and if fees<\/p>\n<p>are charged, the same shall not be in excess of what they were<\/p>\n<p>paying in the Tis January Lane school.\n<\/p>\n<\/p>\n<p>4.   W.P.(C) No.11778 of 2006 was at that stage filed by the<\/p>\n<p>teachers employed by the society for its Tis January Lane<\/p>\n<p>school in which they prayed for the following reliefs:-<\/p>\n<p>          a) issue a writ in the nature of mandamus to<br \/>\n     respondent No.1 to cancel the allotment of the Sadiq<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>Nagar site of school measuring 2.34 acres allotted to<br \/>\nrespondent Nos. 4 &amp; 5 vide dated 27.08.1975;<\/p>\n<p>      (b) issue appropriate writ, orders and<br \/>\ndirections to the respondent No.3 to immediately<br \/>\nand forthwith to take over the possession of the said<br \/>\nIndian school\/site from the respondent Nos. 4 &amp; 5<br \/>\nand to seize all the records of the public school with<br \/>\nfreezing of the bank accounts of respondent No. 4 &amp;<br \/>\n5;\n<\/p>\n<p>     c) issue appropriate writ, orders or directions<br \/>\nto respondent No. 3 to de-recognize the said public<br \/>\nschool at Sadiq Nagar, New Delhi and to make<br \/>\narrangements for shifting the existing school at Tis<br \/>\nJanuary Lane to the Sadiq Nagar site;\n<\/p>\n<p>      (d)   issue appropriate orders\/directions to<br \/>\nrespondent No. 3 to ensure the protection of the<br \/>\nservices of the petitioners and the payment of the<br \/>\narrears of their salaries at the earliest;<\/p>\n<p>      (e) issue appropriate writ, order or directions<br \/>\nfor holding an enquiry under the direct supervision<br \/>\nof this Hon&#8217;ble Court to fix the responsibilities of the<br \/>\nconcerned officials of the State whereby the Sadiq<br \/>\nNagar site of the school located at Josip Broz Tito<br \/>\nMarg, New Delhi was misused for running a public<br \/>\nschool in the name and style of &#8220;Indian School&#8221; on<br \/>\nthe site allotted for shifting the existing Smt. R.K.K.<br \/>\nGyan Mandir Middle School from Tis January Lane,<br \/>\nNew Delhi and<\/p>\n<p>     (f)     issue      such        other      writ,<br \/>\norder\/orders\/directions, which this Hon&#8217;ble Court<br \/>\nmay deem fit and proper in the facts and<br \/>\ncircumstances of the case in the light of the above<br \/>\naverment and in order to secure the ends of justice<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>     for which acts the humble petitioners shall remain<br \/>\n     grateful to this Hon&#8217;ble Court.\n<\/p>\n<\/p>\n<p>5.   A Single Bench of the High Court allowed the above writ<\/p>\n<p>petition by its order dated 20th September, 2007 with the<\/p>\n<p>following directions :-\n<\/p>\n<blockquote><p>     (1)   The Respondent Nos. 4 and 5 shall ensure that<br \/>\n           the Petitioner Nos. 2 to 16 are accommodated<br \/>\n           appropriately in its unaided school, i.e. Indian<br \/>\n           School, within four weeks from today; the said<br \/>\n           teachers shall be absorbed on permanent basis;<br \/>\n           their salary, allowances and other conditions<br \/>\n           shall be preserved with continuity of service.<br \/>\n           The arrears of 5% contribution for the last one<br \/>\n           year, payable to the petitioner Nos.2 to 16, shall<br \/>\n           be paid by the society within 6 weeks, to them.<br \/>\n           This shall be over and above the Rs.1,00,000\/-<br \/>\n           amount volunteered to be paid by the society,<br \/>\n           as a good will gesture to them. That amount too<br \/>\n           shall be paid, if not already paid.\n<\/p><\/blockquote>\n<blockquote><p>     (2)   Simultaneously, the said respondents shall take<br \/>\n           steps to effectuate their statement about<br \/>\n           assimilating all the existing students (from the<br \/>\n           aided school in the Tis January Lane) in the<br \/>\n           Indian school, on &#8220;freeship basis&#8221;. The said<br \/>\n           students shall not be required to pay any<br \/>\n           amount over and above what has been paid by<br \/>\n           them all this while.\n<\/p><\/blockquote>\n<blockquote><p>     (3)   The society and fourth respondent shall ensure<br \/>\n           that the students of the aided school are given<br \/>\n           free transportation to the unaided school, and<br \/>\n           back to the Tis January Lane area as long as<br \/>\n           the students of the aided school study in the<br \/>\n<span class=\"hidden_text\">                                6<\/span><\/p>\n<p>           Indian school. It shall do all things necessary<br \/>\n           to meaningfully assimilate such children in the<br \/>\n           Indian school.\n<\/p><\/blockquote>\n<blockquote><p>     (4) The GNCT shall ensure compliance with the<br \/>\n         above directions; if necessary, it shall sanction<br \/>\n         additional sections, wherever required in the<br \/>\n         unaided school, to accommodate the influx of<br \/>\n         the students from the aided school as well as<br \/>\n         teachers and employees from there. It shall<br \/>\n         continue to preserve and protect the status of<br \/>\n         the petitioner employees as employees of an<br \/>\n         aided school.\n<\/p><\/blockquote>\n<blockquote><p>     (5)   A status report disclosing due compliance with<br \/>\n           the above directions, and action taken in that<br \/>\n           regard shall be filed within 6 weeks, before this<br \/>\n           court, by the fourth and fifth respondents, and<br \/>\n           GNCT.\n<\/p><\/blockquote>\n<p>6.   Aggrieved by the above order the society preferred Letters<\/p>\n<p>Patent Appeal No.1307 of 2007 which has been as noticed<\/p>\n<p>earlier dismissed by the Division Bench of the High Court by<\/p>\n<p>the order impugned in this petition with costs assessed at<\/p>\n<p>Rs.75,000\/-.\n<\/p>\n<\/p>\n<p>7.   When the matter came up before this Court on 16th<\/p>\n<p>December, 2009, Mr. Desai, learned senior counsel for the<\/p>\n<p>petitioners made a statement that the petitioner society was<br \/>\n<span class=\"hidden_text\">                               7<\/span><\/p>\n<p>prepared to absorb all the students and the teachers employed<\/p>\n<p>for the school at Tis January Lane, New Delhi, from the next<\/p>\n<p>academic year, provided the students and the teachers were<\/p>\n<p>willing to join the petitioners-school. Mr. Sen, learned counsel<\/p>\n<p>appearing for the NDMC was also granted time to seek<\/p>\n<p>instructions as to whether the NDMC was prepared to absorb<\/p>\n<p>the teachers.\n<\/p>\n<\/p>\n<p>8.   Pursuant to the above direction, Mr. Sen submitted at<\/p>\n<p>the bar that while the NDMC is willing to accommodate<\/p>\n<p>students, who are not willing to join the Indian School of the<\/p>\n<p>petitioner society it has no legal obligation what so ever to<\/p>\n<p>absorb the teachers who were employed by the petitioner<\/p>\n<p>society for running the school at Tis January Lane.      It was<\/p>\n<p>argued that since the teachers had themselves not prayed for<\/p>\n<p>any direction from the High Court for absorption in the service<\/p>\n<p>of NDMC, there was no question of issuing any direction to<\/p>\n<p>that effect especially when the same would go beyond the<\/p>\n<p>prayer made in the writ petition. It was submitted that the<\/p>\n<p>High Court had rightly concluded that the society was obliged<br \/>\n<span class=\"hidden_text\">                               8<\/span><\/p>\n<p>not only to adjust the students but also the teachers employed<\/p>\n<p>in connection with the running of the school at Tis January<\/p>\n<p>Lane.\n<\/p>\n<\/p>\n<p>9.   There is in our opinion considerable merit in the<\/p>\n<p>submission of Mr. Sen. The High Court has after a careful<\/p>\n<p>consideration of the matter correctly held that the society was<\/p>\n<p>obliged to absorb the teachers and the students from Tis<\/p>\n<p>January Lane. The view taken by the High Court does not<\/p>\n<p>suffer from any error of law or jurisdiction to warrant<\/p>\n<p>interference by this Court in exercise of its powers under<\/p>\n<p>Article 136 of the Constitution. In fairness to Mr. Desai, we<\/p>\n<p>must mention that even he did not pursue the challenge to the<\/p>\n<p>orders passed by the High Court in so far as the same directs<\/p>\n<p>the society to adjust and absorb the students and teachers<\/p>\n<p>from the Tis January Lane school. All that Mr. Desai argued<\/p>\n<p>was that direction No.3 issued by the learned Single Judge<\/p>\n<p>and upheld by the Division Bench of the High Court was<\/p>\n<p>totally beyond the scope of writ petition inasmuch as there<\/p>\n<p>was neither any prayer in the petition regarding grant of free<br \/>\n<span class=\"hidden_text\">                                   9<\/span><\/p>\n<p>transportation to the students from Tis January Lane nor was<\/p>\n<p>there any legal justification for the issue of any such direction.<\/p>\n<p>He urged that this Court could delete the said direction and<\/p>\n<p>dispose of the present petition.\n<\/p>\n<\/p>\n<p>10.   Mr. Sen, learned counsel appearing for the NDMC had no<\/p>\n<p>objection to that course of action. Even otherwise, we are of<\/p>\n<p>the view that the direction regarding free transportation to<\/p>\n<p>students from Tis January Lane to the Indian school does not<\/p>\n<p>have any contractual or other legal basis to support the same.<\/p>\n<p>According to the petitioner society also the school is not<\/p>\n<p>providing any transportation to the students nor is there any<\/p>\n<p>obligation to do so. Be that as may be, whether or not free<\/p>\n<p>transport should be offered to students who may be adjusted<\/p>\n<p>in the Indian school was never the matter in issue before the<\/p>\n<p>High Court or in the writ petition filed by the teachers. The<\/p>\n<p>students were also not parties to the proceedings either<\/p>\n<p>individually or collectively. That being the position, we are of<\/p>\n<p>the view that direction No.3 issued by the learned Single<\/p>\n<p>Judge and affirmed by the High Court needs to be deleted and<br \/>\n<span class=\"hidden_text\">                              10<\/span><\/p>\n<p>is accordingly deleted. We may however clarify that this order<\/p>\n<p>would not prevent the students from seeking appropriate<\/p>\n<p>redress in appropriate proceedings before the competent Court<\/p>\n<p>or authority and claiming free transportation to and fro Indian<\/p>\n<p>school established by the petitioner society. In any such<\/p>\n<p>proceedings the prayer regarding transportation shall be<\/p>\n<p>examined uninfluenced by the observations made in this<\/p>\n<p>order.   Beyond the modification indicated above we see no<\/p>\n<p>reason what so ever to interfere with the orders passed by the<\/p>\n<p>High Court. The petition is, with the above observations,<\/p>\n<p>disposed of.
