He also submitted<br \/>\n\tthat as per the decision of the Division Bench of this Court in case<br \/>\n\tof <a href=\"\/doc\/852206\/\">Torrent Power AEC Ltd. v. Gayatri Intermediates Pvt. Ltd.,<\/a><br \/>\n\treported in 2006(2) GLH, 375, the petitioner has alternative<br \/>\n\tremedy of approaching before the Special Court on the aspect of<br \/>\n\tquantum and, therefore, this Court may not entertain the petition<br \/>\n\tand may relegate the petitioner to approach before the Special<br \/>\n\tCourt.\n<\/p>\n<p>Two<br \/>\n\tpeculiar circumstances exist in the present case; one is that the<br \/>\n\tpetitioner is a British National, which is reflected from the copy<br \/>\n\tof the passport and had visited only on 28.8.2007. The case of the<br \/>\n\tpetitioner is that when the petitioner had purchased the property,<br \/>\n\tthe meter was outside the house and for ten years she was out of<br \/>\n\tcountry.  The aforesaid is supported by the calculation of the<br \/>\n\tElectricity Company, which shows that up to the bill of<br \/>\n\tAugust-September, 2007 &#8216;zero&#8217; unit was consumed.  The actual<br \/>\n\tconsumption appears to have started from October-November, 2007 even<br \/>\n\tas per the record of the Electricity Company and the inspection has<br \/>\n\ttaken place on 29.4.2008.  Therefore, at best, the Electricity<br \/>\n\tCompany could charge for the period from October, 2007 to 29th<br \/>\n\tApril, 2008 during which the consumption has continued with the<br \/>\n\talleged tampering the meter.  Prima facie it appears that the action<br \/>\n\tof the Electricity Company would be wholly without jurisdiction if<br \/>\n\tthe period during which the premise was closed and there was &#8216;zero&#8217;<br \/>\n\tconsumption and the person concerned was not even occupying the<br \/>\n\tpremise is to be included.\n<\/p>\n<p>Existence<br \/>\n\tof the alternative remedy in normal circumstances is to be<br \/>\n\tconsidered by way of a self-imposed restriction while exercising the<br \/>\n\tpower under Article 226 of the Constitution of India.  However, such<br \/>\n\twould not operate as a bar to the constitutional jurisdiction of<br \/>\n\tthis Court under Article 226 of the Constitution of India. If the<br \/>\n\tstand of the Electricity Company is to maintain the charges<br \/>\n\tirrespective of the fact that the premise was closed of the person<br \/>\n\tconcerned or none was occupying the premise, that too, in a<br \/>\n\tresidential house, such absurdity deserves to be considered in writ<br \/>\n\tjurisdiction, which Special Court may not be in a position to<br \/>\n\texamine as against the Electricity Code.  It further appears that<br \/>\n\tthe stand on the part of the Electricity is that the bill is as per<br \/>\n\tClause 7.6.5 of the Supply Code, whose validity can be examined, if<br \/>\n\trequired, by this Court only in writ jurisdiction and such may not<br \/>\n\tbe possible for the Special Court.  Therefore, in view of these<br \/>\n\tpeculiar circumstances, the matter deserves consideration.\n<\/p>\n<p>Hence,<br \/>\n\tRule.\n<\/p>\n<p>The<br \/>\n\tlearned Counsel appearing for both the sides are heard on the<br \/>\n\taspects of interim order.\n<\/p>\n<p>The<br \/>\n\tconsumption shown in the bills from October 2007 to May 2008 is in<br \/>\n\tall 788 units for the period during which the petitioner occupied<br \/>\n\tthe house.  If the matter is considered on the bonafide, the<br \/>\n\tpetitioner had moved the Electricity Company for addition of the<br \/>\n\tload since she wanted to get extra load for washing machine and air<br \/>\n\tconditioner.\n<\/p>\n<p>Therefore,<br \/>\n\tkeeping in view the peculiar facts and circumstances and more<br \/>\n\tparticularly the aforesaid aspects that the actual units consumed<br \/>\n\tduring the proceeding period is only 788 units, by interim order, it<br \/>\n\tis directed that the Electricity Company shall charge 1.5 times the<br \/>\n\tregular tariff over the actual units consumed of 788 units.  The<br \/>\n\tfresh calculation shall be made accordingly and the petitioner shall<br \/>\n\tbe intimated within a period of one month from today.  After such<br \/>\n\tintimation the payment thereof shall be made by the petitioner,<br \/>\n\tsubject to the outcome of the present proceedings with the<br \/>\n\tElectricity Company within two weeks therefrom and the petitioner<br \/>\n\tshall further continue to pay the regular electricity bills for the<br \/>\n\tconsumption of the electricity until further orders.\n<\/p>\n<p>Subject<br \/>\n\tto the aforesaid conditions, any action pursuant to the alleged<br \/>\n\tincident by the Electricity Company shall remain stayed, including<br \/>\n\tthe notice based thereon at Annexure &#8216;A&#8217; dated 15.5.2008.
