Sr. Civil Judge, Surat below application Exhibit-35 filed in<br \/>\nRegular Darkhast No.49\/2006 and to direct the executing Court to<br \/>\ndecide &#8220;Mark B&#8221; application filed in the execution<br \/>\napplication; and alternatively, it has also been prayed to direct the<br \/>\nexecuting Court to decide &#8220;Mark B&#8221; application as<br \/>\nexpeditiously as possible.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned counsel Mr. Y.V. Vaghela appearing on behalf of the<br \/>\npetitioners.\n<\/p>\n<p>3.\tAfter<br \/>\narguing the matter, learned counsel Mr. Vaghela states that he is not<br \/>\npressing the present petition so far as the challenge made to the<br \/>\norder passed below application Exhibit-35 filed in Regular Darkhast<br \/>\nNo.49\/2006 dated 15.03.2011 is concerned. He, however, requested that<br \/>\nappropriate directions may be issued to the executing Court to decide<br \/>\napplication &#8220;Mark B&#8221; pending before it as expeditiously<br \/>\nas possible.\n<\/p>\n<p>4.\tIn<br \/>\nview of the admission made by learned counsel for the petitioners<br \/>\nthat he is not assailing the order passed below application<br \/>\nExhibit-35 on merits, this Court is not interfering with the impugned<br \/>\norder and accordingly, confirms the same. However, considering the<br \/>\nalternative relief claimed by the petitioners, it is observed that if<br \/>\nthe petitioners prefer an application requesting the executing Court<br \/>\nconcerned to decide &#8220;Mark B&#8221; application pending before<br \/>\nit expeditiously, the executing Court shall allow the same and shall<br \/>\ndispose of the said application, as expeditiously as possible, being<br \/>\nuninfluenced by the observations made by it in the impugned order<br \/>\ndated 15.03.2011.\n<\/p>\n<p>5.\tWith<br \/>\nthe above observations, the petition stands disposed of.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
