Justice V.GIRI\n\n Dated :28\/01\/2008\n\n O R D E R\n                                V.GIRI, J\n\n                              -------------------\n\n                          W.P.(C).2154\/2008\n\n                              --------------------\n\n            Dated this  the  28th day of January, 2008\n\n\n                              JUDGMENT\n<\/pre>\n<p>       The   challenge   in   this   writ   petition   is   essentially<\/p>\n<p>against   Ext.P5   which   is   a   provisional   seniority   list     of<\/p>\n<p>Officers   in   the   cadre   of   Rationing   Inspectors   for<\/p>\n<p>deputation to the   Kerala State Civil Supplies Corporation<\/p>\n<p>as on 31.12.2007.  Learned Government Pleader points out<\/p>\n<p>that Ext.P5 is only a provisional list and the petitioner has<\/p>\n<p>filed   his   objections   thereto.     Learned   counsel   for   the<\/p>\n<p>petitioner,     Mr.   Rajasekharan   Pillai,   points   out   that   the<\/p>\n<p>petitioner   is  entitled  to   be   promoted as   Assistant     Taluk<\/p>\n<p>Supply Officer   and actually his juniors have already been<\/p>\n<p>promoted.  He further submits that  he had been promoted<\/p>\n<p>as Assistant Taluk Supply Officer,  he would not have been<\/p>\n<p>included   in   Ext.P5   list.     It   is   further   submitted   that   once<\/p>\n<p>his   seniority   is   finalized,   it     is   quite   possible   that   the<\/p>\n<p>petitioner would be excluded therefrom.<\/p>\n<p>2.     After   having   heard     both   sides,     Writ   petition   is<\/p>\n<p>disposed   of   directing   the   third   respondent   to   finalize   the<\/p>\n<p>W.P.(C).2154\/2008<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>seniority   list   of   the   officers   in   the   Cadre   of   Rationing<\/p>\n<p>Inspectors   for     deputation   to   the   Kerala   State   Civil<\/p>\n<p>Supplies   Corporation   within   a   period     of   two   months<\/p>\n<p>from the date of receipt of a copy of this judgment, after<\/p>\n<p>hearing the petitioner and  any other affected person.<\/p>\n<p>3.      It is made clear that if the petitioner is deputed to<\/p>\n<p>the Civil Supplies Corporation, in the meanwhile,  it shall<\/p>\n<p>be   subject   to   the   final   seniority   list.
