APP (SJ) No.154 of 2011\n                                  MANOJ PANDIT\n                                         Versus\n                               THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>3.   28.3.2011                   The prayer for bail of the appellant was considered<\/p>\n<p>                 on receipt of the lower court records.\n<\/p>\n<p>                                 Heard both the sides.\n<\/p>\n<p>                                 The appellant is the husband who has been<\/p>\n<p>                 convicted under Sections 304B and 201 of the I.P.C. and<\/p>\n<p>                 sentenced to different terms of imprisonment, the maximum<\/p>\n<p>                 being seven years rigorous imprisonment under Section 304 B<\/p>\n<p>                 of the I.P.C.\n<\/p>\n<p>                                 On consideration of the evidence of three P.Ws<\/p>\n<p>                 and the Doctor, a probability may be there that the lady could<\/p>\n<p>                 have been shifted to the Hospital of D.W.4 Dr. Vinay Kumar<\/p>\n<p>                 Tiwary at Ara from where she was shifted to a Govt. Hospital on<\/p>\n<p>                 account of bleeding and lack of liquid in her body. Some of the<\/p>\n<p>                 prosecution witnesses have also supported during the course of<\/p>\n<p>                 their evidence the above facts and ultimately the death of the<\/p>\n<p>                 deceased.\n<\/p>\n<p>                                 Regard being had to the above facts and the<\/p>\n<p>                 contention, let the appellant, namely. Manoj Pandit be directed<\/p>\n<p>                 to be released, during pendency of this appeal, on furnishing a<\/p>\n<p>                 bond of Rs. 10,000\/-( ten thousand) with two sureties of the like<\/p>\n<p>                 amount each to the satisfaction of the trial court, i.e., Additional<\/p>\n<p>                 Sessions Judge, Fast Track Court-I,Banka in Sessions Trial No.<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>        352 of 2009.\n<\/p>\n<p>                       As regards sentence of fine, realisation of the same<\/p>\n<p>        against the appellant shall remain stayed till further orders.<\/p>\n<pre>Kanth                                         ( Dharnidhar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manoj Pandit vs The State Of Bihar on 28 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
