Gopal Prasad,J.                Heard learned counsel for the appellants and<\/p>\n
                    learned counsel for the State.\n<\/p>\n
                               2. The appellants have been convicted under<\/p>\n
                    Section 307\/149 of Indian Penal Code and have been<\/p>\n
                    sentenced to undgergo rigorous imprisonment for five<\/p>\n
                    years. Appellant No. 5 Arjun Chauhan has further been<\/p>\n
                    convicted for offence under Section 379 I.PC. and<\/p>\n
                    sentenced to undergo imprisonment for one year. Further
\n                 2<\/span><\/p>\n
it has been ordered that all the sentences shall run<\/p>\n
concurrently.\n<\/p>\n
           3. The prosecution case as alleged by the<\/p>\n
informant Chameli Devi (P.W.4) that on 27. 05. 1992 at<\/p>\n
about 6 A.M. while she was working in her house all the<\/p>\n
appellants variously armed with entered into her house and<\/p>\n
abused her. Accused Arjun Chauhan enquired about her<\/p>\n
husband and when she protested then Arjun gave khanti<\/p>\n
blow on her head as a result of which she fell down.<\/p>\n
Thereafter, Kaila Chauhan assaulted her with handle of<\/p>\n
hand pump by which she got injury on her right hand and<\/p>\n
then other appellants have also been assaulted by lathi.<\/p>\n
           4. On basis of Fardbeyan, F.I.R. lodged. After<\/p>\n
investigation, charge sheet submitted. Cognizance taken<\/p>\n
and the case was committed to the Court of Sessions and<\/p>\n
charge was framed for offence under Section 307 and<\/p>\n
other allied Sections.\n<\/p>\n
           5. Six witnesses have been examined by the<\/p>\n
prosecution and one documentary evidence has also been<\/p>\n
adduced.     Ext. 1 and 1\/A is injury report, Ext. 2,<\/p>\n
Fardbeyan, Ext.3 endorsement of the officer-in-Charge<\/p>\n
over the same, Ext. 4, Formal F.I.R. and Ext. 5 is certified
\n                 3<\/span><\/p>\n
copy of judgment. After considering both oral and<\/p>\n
documentary evidence, order of conviction and sentence<\/p>\n
has been passed.\n<\/p>\n
         6. Learned counsel for the appellants, however,<\/p>\n
contends that, though conviction has been recorded under<\/p>\n
Section 307 I.P.C., but report of the Doctor does not<\/p>\n
suggest that injury on the person of the injured was<\/p>\n
dangerous to life.   It has further been contended that,<\/p>\n
though, Injury No. 2 to 6 has been shown to be grievous<\/p>\n
for the reason of its fracture, but X-Ray has not been<\/p>\n
adduced in evidence to infer that injury was grievous in<\/p>\n
nature and hence contends that conviction under Section<\/p>\n
325 or 326 or 307 is not sustainable. It has further been<\/p>\n
contended that appellants Nos. 1, 5 and 7 who have been<\/p>\n
attributed of alleged assault have remained in jail for more<\/p>\n
than a year and allegation against other appellants are<\/p>\n
omnibus and no specific role has been attributed against<\/p>\n
them and hence        conviction and sentence       is   not<\/p>\n
maintainable.\n<\/p>\n
         7. The prosecution case as alleged that accused<\/p>\n
persons came and there is specific allegation about assault<\/p>\n
by Arjun Chauhan and Kaila Chauhan. However, it is
\n                4<\/span><\/p>\n
alleged that after assault the injured fell down and other<\/p>\n
accused persons have also assaulted by lathi. However,<\/p>\n
witnesses have supported the prosecution case.<\/p>\n
         8. P.W. 1 who is Doctor though, found eight<\/p>\n
injuries, but has stated that Injury No. 1 is on the head and<\/p>\n
Injury No. 7 is simple, but reserved the opinion regarding<\/p>\n
Injury Nos. 2 to 6.        However, he has stated that<\/p>\n
supplementary injury report has been prepared after receipt<\/p>\n
of X-ray report on 02. 06. 1992 and has opined that Injury<\/p>\n
Nos. 2, 3, 4, 5, 6 and 7 and 8 shown ribe of right sight<\/p>\n
fractured and injuries are grievous in nature. However, in<\/p>\n
his cross-examination, he has stated X-ray plate not<\/p>\n
appeared before him and X-ray plate is not given in the<\/p>\n
supplementary report as he was not found X-ray plate as<\/p>\n
there was no X-ray Plant in Nawadah Sadar Hospital at<\/p>\n
that time and he can not say the name of X-ray Technician<\/p>\n
or Radiologist and he did not know where the injured got<\/p>\n
the X-ray done and he can not say whether X-ray had been<\/p>\n
done by Government or private technician. He has further<\/p>\n
stated that nature of fracture has not been given.<\/p>\n
         9. Hence in view of evidence of the Doctor that<\/p>\n
X-ray report has not been proved on record nor brought in
\n                5<\/span><\/p>\n
evidence nor was present at the time of X-ray of the<\/p>\n
victim. Hence opinion and injury report with regard to<\/p>\n
Injury Nos. 2 to 6 as grievous is not acceptable and nor<\/p>\n
worthy confidence.\n<\/p>\n
         10. Hence, having regard to the evidence and<\/p>\n
Injury Nos. 2 to 6 can not be held to be grievous without<\/p>\n
any X-ray report. Further regarding fracture, X-ray report<\/p>\n
which was produced before the Doctor on which<\/p>\n
supplementary injury report was given does not inspire<\/p>\n
confidence in absence of X-Ray plate brought and prove in<\/p>\n
evidence.\n<\/p>\n
         11. Hence, having regard to the facts and<\/p>\n
circumstances, since Injury Nos. 1 to 7 are simple and<\/p>\n
Injury Nos. 2 to 6 are held to be grievous has not been<\/p>\n
established and there is no evidence that injuries were<\/p>\n
shown to danger in life and hence conviction and sentence<\/p>\n
recorded under Section 307\/149 I.P.C. is not sustainable.<\/p>\n
Further conviction under Section 325 I.P.C. has also not<\/p>\n
established in view of the fact that injuries pointed out<\/p>\n
could not be       established to be grievous   and hence,<\/p>\n
conviction   under     Section 307\/379    I.P.C.   has   not<\/p>\n
sustainable and hence conviction at best be sustainable
\n                                  6<\/span><\/p>\n
                   under Section 324\/149 I.P.C.\n<\/p>\n
                            12. However, having regard to the facts and<\/p>\n
                   circumstance, that occurrence is of year 1992 and the<\/p>\n
                   appellants who have been attributed role of assault as<\/p>\n
                   appellant nos. 1, 5 and 7 has remained in jail during trial<\/p>\n
                   and after conviction for more than a year. However, other<\/p>\n
                   appellants have also remained in jail after conviction till<\/p>\n
                   bail granted by Hon’ble High Court.\n<\/p>\n
                            13. Hence, in the interest of justice shall serve by<\/p>\n
                   sentencing the appellants for the period have already<\/p>\n
                   undergone and hence, appeal is allowed in part.<\/p>\n
