H a.1n., when the clean' -ant was proc6e\u20ac11I1_ ' g<\/p>\n
smyean the ma side of the road near Shivapura, a<\/p>\n
'A  bearing No.AP-30\/T-7342 came from the opposite<\/p>\n
'elirec\ufb02on with great speed in a rash and negligent<\/p>\n
manner and dashed against the motor cycle on which
\nthe claimant was t1'a.ve1li11g. As a result of that, he<\/p>\n
sustained fractures and several injuries. The petmoner<\/p>\n

was taken to VIMS Hospital for treatment and tiiefeetter<\/p>\n
he was shifted to Sanjeevini Hospital,    <\/p>\n
was treated as in-patient.\n<\/p>\n

4. In the said proceedings, though the<\/p>\n
respondents-1 and 2 entered appearance and fled<\/p>\n

separate written statements, they did not <\/p>\n
evidence. The 2” respondent   _<\/p>\n
documents namely driving licence, _xero–:\u00ab'<f    " = <\/p>\n
permit and xerox copy of  <\/p>\n
the o\ufb01ending lorry. Based  V' on  *<\/p>\n
record and also the  =1par.1'c'e~–d_  said
\nproceedings, the  the claim
\npetition award.ing_   Rs.1,'79,700\/-
\nwitha  pay the same.\n<\/p>\n

\nquantdm  d  awarded preferred this<\/p>\n
  eahanoement of the compensation<\/p>\n
   Tribunal. In this appeal, both<\/p>\n
E  served. However, the 18* respondent<\/p>\n
did x\ufb01ot eontest the matter and the 2nd respondent-<\/p>\n
 \u00bb.   Company is represented by its counsel.<\/p>\n
6. Heard the learned counsel appearing for<\/p>\n
both the parties and perused the judgment and award,
\n“”7<\/p>\n
the depositions and the documents marked <\/p>\n
Tribunal in support of the claimant.<\/p>\n
7. On going through  itis <\/p>\n
the relevant point of time  the.   *<\/p>\n
the claimant was aged 35   In
\nthe said accident   injuries which
\nneeessiated   of 46 days
\nand due    shortem11g’ of his
\nleg by,   thigh and restricition
\nof  it is also seen that he has<\/p>\n
spent  V.  towards medical expenses<\/p>\n
   1$ei*io-z_1___when he was hospitalised and in<\/p>\n
 ‘  same he has examined the Doctor who<\/p>\n
as l  ted’  “as PW2 in Sanjeevini Hospital and<\/p>\n
  Vmediml bills Exs.P6 to P69. The doctor has<\/p>\n
A “ii opined that the claimant has suffered disability to<\/p>\n
l.   the tune of 25% to whole body.<\/p>\n
8. It is seen that the Tribunal while assessing<\/p>\n
the compensation towards loss of future income has<\/p>\n

Rs.60\/- per day and after deducting 1\/3rd H<\/p>\n

\ufb02ed, though the claimant has<\/p>\n

 to the tune of Rs.1,18,500\/-, the<\/p>\n
  rejected the claim of Rs.70,000\/-<\/p>\n
 _on  that the claimant has not examined the<\/p>\n
  J who has treated him and also not confmnted the<\/p>\n

 case, the ciaim\/ant has examined PW?-<\/p>\n
I)r.M.J.Shashidhara Reddy who has clearly stated that

when the claimant was in the hospital, all the <\/p>\n
that were used for his treatment were  <\/p>\n
outside and none of the medicineswere  <\/p>\n
from the hospital and he <\/p>\n
claimant was in hospital me ~ gays and  * %<\/p>\n
expenses towards    ‘iheevelaimant
\nhimself. That the eeeeee  will su\ufb02ice to
\nbelieve the  _ of    he has spent
\nRs. 1, 18,535 and the same
\nare   at Ex.P-6 to 68 and
\nthere  L no  e  ,.:d.isbe1ieve the same and<\/p>\n

   be increased to Rs.1,18,500\/~.<\/p>\n
    of the claimant is taken at Rs. 100\/ ~<\/p>\n
