Justice P.Q.BARKATH ALI\n\n Dated :21\/05\/2009\n\n O R D E R\n           PIUS.C.KURIAKOSE &amp; P.Q.BARKATH ALI, JJ.\n                        - - - - - - - - - - - - - - - - - - - - -\n                             L.A.A.No. 442 OF 2009\n                    - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      Dated this the 21st day of May, 2009\n\n                                  JUDGMENT\n<\/pre>\n<p>Pius.C.Kuriakose, J.\n<\/p>\n<p>      This appeal preferred by the Government pertains to acquisition<\/p>\n<p>of land in Vanchiyoor village pursuant to a notification under Section<\/p>\n<p>4(1) published on 14\/05\/1997.              The purpose of the acquisition was<\/p>\n<p>widening of the road from over bridge to Pazhavangadi                      in<\/p>\n<p>Thiruvananthapuram city corporation. It goes without saying that the<\/p>\n<p>acquired property was situated in the most important area of the<\/p>\n<p>Thiruvananthapuram Corporation in terms of trade and commerce. It is<\/p>\n<p>fairly conceded by the learned Government Pleader that the<\/p>\n<p>enhancement presently granted by the reference court i.e. from<\/p>\n<p>Rs. 547289\/- per Are to rs. 1731306\/- per Are was confirmed by a<\/p>\n<p>Division Bench of this court.                The learned Government Pleader<\/p>\n<p>submitted that against that judgment, the Government has preferred a<\/p>\n<p>Special Leave Petition before the Supreme Court and hence requested<\/p>\n<p>that this appeal also be admitted.\n<\/p>\n<p><span class=\"hidden_text\">LAA.No.452\/09                      2<\/span><\/p>\n<p>      Having regard to the location and lie of the property, we are of<\/p>\n<p>the view that the enhancement granted by the reference court is<\/p>\n<p>reasonable. More over, a Division Bench of this court has approved<\/p>\n<p>the above enhancement. We do not find any justification for admitting<\/p>\n<p>this appeal.
