BHAVADASAN, JJ.\n                   -------------------------------------------\n                       R.F.A.No.270 OF 2006\n                   -------------------------------------------\n              Dated this the 28th day of October, 2010\n\n\n                               JUDGMENT\n<\/pre>\n<p>Thottathil B.Radhakrishnan, J.\n<\/p>\n<\/p>\n<p>1.The first defendant in a suit for compensation is the appellant.<\/p>\n<p>  It is the licensee for supply of electrical energy in the State of<\/p>\n<p>  Kerala. The appellant Kerala State Electricity Board and two<\/p>\n<p>  of its officers were sued on account of the death of Kumari, a<\/p>\n<p>  female, who died on 25.2.2001, leaving behind her husband, a<\/p>\n<p>  daughter aged 19 years and two minors who are then aged 17<\/p>\n<p>  and 15, of which, one is a female. The minor son also suffered<\/p>\n<p>  injuries. The family also lost a cow in the incident.<\/p>\n<p>2.An electric line was ultimately found hanging, to which, the<\/p>\n<p>  cow or deceased Kumari came into contact and later, her<\/p>\n<p>  minor son Pradeesh also came into contact. This is how the<\/p>\n<p>  incident had occurred.\n<\/p>\n<p>RFA.270\/06<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>3.KSEB set up a defence that the incident occurred when a<\/p>\n<p>  snapped dead conductor hanging from a post got entangled<\/p>\n<p>  with a cow which was grassing in a field and due to the<\/p>\n<p>  pressure exerted by the cow, the dead conductor came into<\/p>\n<p>  contact accidentally with a live wire on the opposite side of the<\/p>\n<p>  electric post and got electrocuted. According to the defence,<\/p>\n<p>  deceased Kumari, who was grassing the cow, attempted to<\/p>\n<p>  save the animal and that led to her electrocution. Obviously,<\/p>\n<p>  the son would have attempted to save the mother and thus he<\/p>\n<p>  also suffered.\n<\/p>\n<\/p>\n<p>4.Taking into consideration the different aspects of the matter,<\/p>\n<p>  including the deposition of DW1, the then Assistant Engineer<\/p>\n<p>  of the Board, the court below found that the defendants are<\/p>\n<p>  liable to compensate the plaintiffs. We read the deposition of<\/p>\n<p>  DW1, the Assistant Engineer. He candidly states that there<\/p>\n<p>  was even a departmental enquiry following the accident, in<\/p>\n<p>  which, the officials were found to be guilty and increments<\/p>\n<p>  were barred.\n<\/p>\n<p>RFA.270\/06<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>5.With the aforesaid, we also find formidable support in the<\/p>\n<p>  judgment of the Apex Court in <a href=\"\/doc\/50693703\/\">M.P.Electricity Board v. Shail<\/p>\n<p>  Kumari<\/a> [2002(1) KLT 480], wherein, the principle of &#8216;strict<\/p>\n<p>  liability&#8217; was applied even in a case where the licensee took<\/p>\n<p>  the stand that the electricity accident was a result of<\/p>\n<p>  negligence of third parties.    For the aforesaid reasons, we<\/p>\n<p>  affirm the findings of the court below regarding negligence.<\/p>\n<p>6.On to the question of compensation, the court below took that<\/p>\n<p>  deceased Kumari, who was a construction worker, would have<\/p>\n<p>  a monthly income of Rs.3,000\/-. Her age was appropriately<\/p>\n<p>  determined and compensation fixed.       The only plea urged<\/p>\n<p>  before us, in challenge to this, is that the sole material<\/p>\n<p>  available before the court below was Ext.A3, which is a<\/p>\n<p>  certificate issued by the District Executive Officer of the<\/p>\n<p>  Kerala Building and Other Construction Workers Welfare Fund<\/p>\n<p>  Board, which shows that Kumari was a member of the Fund.<\/p>\n<p>  That document is a statutory order issued by the competent<\/p>\n<p>  authority. It goes a long way in unequivocally establishing<\/p>\n<p>RFA.270\/06<\/p>\n<p><span class=\"hidden_text\">                                4<\/span><\/p>\n<p>  that Kumari was a building construction worker. It also shows<\/p>\n<p>  that she was a member of the Fund. Obviously therefore, the<\/p>\n<p>  court below could not be found fault with for having<\/p>\n<p>  determined her income at Rs.3,000\/-. She was also a house<\/p>\n<p>  wife even going by the defence version that she was grassing a<\/p>\n<p>  cow. The judgment of the court below clearly analysed all<\/p>\n<p>  attendant relevant situations in determining the compensation.<\/p>\n<p>  We do not find any ground to interfere with the quantum of<\/p>\n<p>  compensation fixed by the court below also.<\/p>\n<p>7.For the aforesaid reasons, we dismiss this appeal.
