J.\n<\/p>\n<p>The appellant has been convicted under\tSection\t 25<br \/>\nof  the\t Arms  Act  and Section 5 of the TADA Act as he was<br \/>\nfound in possession of one DBBL gun.  12 bore and five live<br \/>\ncartridges on 17\/18.3.1992.  The trial court  relying  upon<br \/>\nthe  evidence  of  ASI &#8211; Balbir Singh and P.W.4 &#8211; Man Singh<br \/>\nwho were the members of the Police party held that  it\twas<br \/>\nproved\tby  the\t prosecution  that  the\t appellant  was\t in<br \/>\npossession of those articles.  The trial court further held<br \/>\nthat as the gun was found loaded, it can be  presumed  that<br \/>\nit was in working order.  Taking this view it convicted the<br \/>\nappellant, as stated above.\n<\/p>\n<p>Admittedly,  no evidence was led by the prosecution<br \/>\nto prove that the gun was in working condition and that the<br \/>\ncartridges  which  were\t found\tfrom  the  person  of\tthe<br \/>\nappellant were live cartridges.\t Neither ASI &#8211; Balbir Singh<br \/>\nhad stated so nor any report from an expert was obtained to<br \/>\nestablish  that\t the  gun was in working condition and that<br \/>\nfive cartridges were live.  What was found in the gun  were<br \/>\ntwo  empties and not live cartridges and, therefore, it was<br \/>\nnot proper to presume that it was in working condition.\t In<br \/>\nabsence of any evidence to that effect, the  conviction\t of<br \/>\nthe appellant under both these aforesaid Sections cannot be<br \/>\nupheld.\t  We,  therefore,  allow this appeal, set aside the<br \/>\njudgment  and  order  passed  by  the\tAdditional   Judge,<br \/>\nDesignated  Court,  Sangrur,  in  Special Sessions Case No.<br \/>\n55\/92 and acquit the  appellant.
