PUBLIC PROSECUTOR for\nOpponent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 29\/11\/2010\n \n\nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tappellant has preferred the present appeal against the judgment and<br \/>\n\torder of conviction and sentence dated 24th<br \/>\n\tFebruary 2009 passed by the learned Additional Principal Judge,<br \/>\n\tCourt No.2, Ahmedabad, in Sessions Case No.92 of 2008,<br \/>\n\twhereby the appellant has been held guilty for the offences<br \/>\n\tpunishable under Sections 306 and 498(A) of the Indian Penal Code.\n<\/p>\n<p>It<br \/>\n\tis the case of the prosecution that the deceased, her husband and<br \/>\n\tthe appellant were residing together under one roof. It is the case<br \/>\n\tof the prosecution that the deceased and the appellant used to<br \/>\n\tquarrel frequently with regard to work to be undertaken by the<br \/>\n\tdeceased. It is also the case of the prosecution that deceased was<br \/>\n\tsubject to physical and mental cruelty, as a result of which<br \/>\n\tdeceased sprinkled kerosene over her body and set herself at fire.\n<\/p>\n<p>As<br \/>\n\tthe deceased sustained serious burn injuries, Police Officer of<br \/>\n\tRakhiyal Police Station was informed about the incident. Therefore,<br \/>\n\tPSI, Rakhiyal Police Station reached to the hospital and looking to<br \/>\n\tthe health of the deceased, forwarded a Yadi to the Executive<br \/>\n\tMagistrate for recording dying declaration of the deceased. On<br \/>\n\treceiving Yadi, Executive Magistrate reached to the hospital and<br \/>\n\trecorded dying declaration of the deceased. It is further the case<br \/>\n\tof the prosecution that due to the burn injuries, the deceased<br \/>\n\tpassed away.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, PSO, Rakhiyal Police Station, registered the<br \/>\n\tcomplaint on 29th January 2008. Pursuant to the FIR,<br \/>\n\tinvestigation proceeded. Panchnama of seen of offence was drawn.<br \/>\n\tThereafter, statement of various witnesses were recorded and<br \/>\n\tultimately the Investigating Officer filed charge-sheet before the<br \/>\n\tCourt of learned Metropolitan Magistrate, Court No.24, Ahmedabad.<br \/>\n\tThe said case was numbered as Criminal Case No.454 of 2008. As the<br \/>\n\tcase was exclusively triable by the Court of Sessions, the same was<br \/>\n\tcommitted to the Sessions Court, Ahmedabad.\n<\/p>\n<p>After<br \/>\n\tfiling of closing pursis by the prosecution, statement under Section<br \/>\n\t313 of the Code of Criminal Procedure, 1973 of the appellant was<br \/>\n\trecorded. The appellant has denied the case of the prosecution and<br \/>\n\tclaimed to be tried.\n<\/p>\n<p>\tThereafter,<br \/>\n\ttrial was conducted before the learned Additional Principle Judge.<br \/>\n\tTo prove the case of the prosecution, prosecution has produced oral<br \/>\n\tas well as documentary evidence.\n<\/p>\n<p>After<br \/>\n\thearing both the sides, the learned Additional Principle Judge,<br \/>\n\tCourt No.2, Ahmedabad, by his judgment and order of conviction dated<br \/>\n\t24th<br \/>\n\tFebruary 2009 passed in Sessions Case No.92 of 2008, convicted the<br \/>\n\tappellant for the offence punishable under Section 306 of the Indian<br \/>\n\tPenal Code and ordered to undergo rigorous imprisonment for a period<br \/>\n\tof five years and fine of Rs.05,000\/-, and in default of payment of<br \/>\n\tfine, ordered to undergo rigorous imprisonment for a further period<br \/>\n\tof three months. The learned Judge had also convicted the appellant<br \/>\n\tunder Section 498(A) of the Indian Penal Code and ordered to undergo<br \/>\n\trigorous imprisonment for a period of 15 months and fine of<br \/>\n\tRs.01,000\/-, and in default of payment of fine, ordered to undergo<br \/>\n\trigorous imprisonment for a further period of three months. However,<br \/>\n\tit was clarified that both the sentences shall run<br \/>\n\tconcurrently and also clarified that the period, which the appellant<br \/>\n\thas spent in the judicial custody, shall be given as a set of.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said judgment and order of<br \/>\n\tconviction dated 24th<br \/>\n\tFebruary 2009 passed by the learned Additional Principle Judge,<br \/>\n\tCourt No.2, Ahmedabad, the appellant hereinabove has preferred the<br \/>\n\tpresent Criminal Appeal before this Hon&#8217;ble Court.\n<\/p>\n<p>Heard<br \/>\n\tMr.J.K. Parmar, learned counsel for the appellant and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor, appearing on behalf of the<br \/>\n\trespondent-State.\n<\/p>\n<p>Mr.Parmar<br \/>\n\thas contended that he is not arguing the matter on merits, but<br \/>\n\tpraying to release the appellant considering the undergone period as<br \/>\n\tsentence. He has contended that he is arguing the matter only for<br \/>\n\tthe purpose of quantum. He has also contended that the appellant is<br \/>\n\ta lady aged about 14 years. He has also contended that the appellant<br \/>\n\tis behind the bars for almost three years. He has also contended<br \/>\n\tthat looking to the overall facts and circumstances of the case,<br \/>\n\tsome lenient view is required to be taken in the matter and<br \/>\n\ttherefore, the appellant is required to be set at liberty by<br \/>\n\tconsidering the period already undergone by the appellant.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned<br \/>\n\tAdditional Public Prosecutor for the respondent-State. He has<br \/>\n\tsupported the judgment and order of conviction passed by the learned<br \/>\n\tJudge. He has contended that looking to the charge framed against<br \/>\n\tthe appellant, order passed by the learned Judge is absolutely just<br \/>\n\tand proper. He has also read the documentary evidence produced on<br \/>\n\trecord and contended that learned<br \/>\n\tJudge<br \/>\n\thas not committed any error in convicting the appellant-accused. He<br \/>\n\thas also contended that this is an offence against woman and now a<br \/>\n\tdays this is a serious issue. He, therefore, contended that the<br \/>\n\tpresent appeal is required to be dismissed.\n<\/p>\n<p>I<br \/>\n\thave<br \/>\n\tgone through papers produced before me and the judgment and order<br \/>\n\tpassed by the learned trial Court. I have also perused the oral as<br \/>\n\twell as documentary evidence led before the trial Court and also<br \/>\n\tconsidered the submissions made by learned counsel for the parties.\n<\/p>\n<p>Looking<br \/>\n\tto the facts and circumstances of the case and looking to the<br \/>\n\tevidence on record, I am of the opinion that conviction imposed upon<br \/>\n\tthe appellant is very harsh. I have also gone through the jail<br \/>\n\treport produced by Mr.H.L. Jani. Jail report shows that the<br \/>\n\tappellant is behind the bars for almost three years. I am of the<br \/>\n\topinion that when the appellant is behind the bars for more than<br \/>\n\thalf the sentence imposed upon her, if the sentence already<br \/>\n\tundergone by the appellant-convict may be treated as sentence, same<br \/>\n\twould meet with the ends of justice. Even looking to the submissions<br \/>\n\tadvanced by the learned counsel for the appellant and circumstances<br \/>\n\tof the case, sentence imposed upon the appellant is required to be<br \/>\n\treduced and modified on the ground of sympathy also.\n<\/p>\n<p>Hence,<br \/>\n\tin view of the foregoing reasons, present appeal is partly allowed.<br \/>\n\tThe judgment and order of conviction dated 24th<br \/>\n\tFebruary 2009 passed by the learned Additional Principle Judge,<br \/>\n\tCourt No.2, Ahmedabad in Sessions Case No.92 of 2008, is hereby<br \/>\n\tconfirmed.  However, the judgment and order of conviction dated 24th<br \/>\n\tFebruary 2009 passed by the learned Additional Principle Judge,<br \/>\n\tCourt No.2, Ahmedabad in Sessions Case No.92 of 2008 is hereby<br \/>\n\treduced and modified to the extent of sentence which the appellant<br \/>\n\thas already undergone. The appellant shall be set at liberty<br \/>\n\tforthwith, if he is not required to be detained in any other case.<br \/>\n\tThe rest of the judgment and order of conviction dated 24th<br \/>\n\tFebruary 2009 shall remain unaltered.
