THE ACCOUNTANT GENERAL BIHAR, BIRCHAND PATEL PATH,\n         PATNA\n                               -----------\n<\/pre>\n<p>2.   24.9.2010              Heard learned counsel for the petitioner, for<\/p>\n<p>                 the State and the Accountant General.\n<\/p>\n<p>                            While the petitioner was posted as the Section<\/p>\n<p>                 Officer in the office of D.I.G. Magadh Range, Gaya, he<\/p>\n<p>                 was charge sheeted on 25.6.2005 on two grounds.          It<\/p>\n<p>                 primarily related to certain alleged interpolations made<\/p>\n<p>                 permitting a candidate to appear a second time in the<\/p>\n<p>                 physical test during the selection process after he had<\/p>\n<p>                 failed to qualify on the 1st occasion and laxity in co-<\/p>\n<p>                 ordinating with the local lawyer in sending a reply to the<\/p>\n<p>                 legal notice received on behalf of such candidate.<\/p>\n<p>                            Learned counsel submits that the petitioner<\/p>\n<p>                 on 14.7.2008 had requested to drop the charges in view<\/p>\n<p>                 of the fact that the entire selection process was cancelled<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>subsequently for other reasons.         The petitioner has<\/p>\n<p>superannuated on 31.7.2007. No illegal benefit accrued<\/p>\n<p>to anyone by reason of the alleged act attributed to the<\/p>\n<p>petitioner. It cannot be classified as a case of serious or<\/p>\n<p>grave   misconduct      causing   pecuniary    loss   to   the<\/p>\n<p>Government so as to invite an order of punishment for<\/p>\n<p>withholding 20% of his pension for 10 years in exercise of<\/p>\n<p>powers under Rule 43(b) of the Pension Rules.<\/p>\n<p>           Counsel for the State points out that the<\/p>\n<p>petitioner has admitted the charge. His defence has been<\/p>\n<p>disbelieved.\n<\/p>\n<p>           This Court from the documents on record is<\/p>\n<p>satisfied that the petitioner admitted the charge.         His<\/p>\n<p>defence has been disbelieved. Once the charge has been<\/p>\n<p>admitted, this Court does not consider it necessary to<\/p>\n<p>deal with the submissions of alleged irregularities in the<\/p>\n<p>departmental proceedings, about which also the Court in<\/p>\n<p>any event has its reservations.\n<\/p>\n<p>           In (2008)5 SCC 569 (Chairman &amp; Managing<\/p>\n<p>Director V.S.P. &amp; Ors. Vs. Goparaju Sri Prabhakara Hari<\/p>\n<p>Babu, dealing with a punishment in a departmental<\/p>\n<p>enquiry where charges were admitted it has been held at<\/p>\n<p>Paragraph 16 as follows:-\n<\/p>\n<blockquote><p>                          &#8220;16. &#8230;&#8230;..He in his explanation,<br \/>\n               in answer to the charge sheet pleaded guilty<br \/>\n               admitting the charges. In terms of Section<br \/>\n               58 of the Evidence Act charges having been<br \/>\n               admitted were not required to be proved. It<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>             was on that premise that           the   enquiry<br \/>\n             proceeding was closed&#8230;..&#8221;<\/p><\/blockquote>\n<p>        The only issue surviving now is of quantum of<\/p>\n<p>punishment.      That normally is the prerogative of the<\/p>\n<p>employer.    The proper course for the Court was            to<\/p>\n<p>remand the matter unless for reasons of its satisfaction<\/p>\n<p>to be explained in the order, the Court itself considers<\/p>\n<p>proper to substitute the punishment with the appropriate<\/p>\n<p>quantum.\n<\/p>\n<p>            It has been noticed that the alleged selection<\/p>\n<p>process in which the petitioner attempted to favour a<\/p>\n<p>candidate came to be cancelled. The alleged attempted<\/p>\n<p>favour did not result in any illegal appointment causing<\/p>\n<p>pecuniary loss to the Government.        The petitioner has<\/p>\n<p>retired on 31.7.2007 and in the evening of his life has no<\/p>\n<p>other   source   of   income    except   his   pension.   The<\/p>\n<p>misdemeanor by him can therefore be euphemistically<\/p>\n<p>described as an attempt.       He additionally deserves to be<\/p>\n<p>left in solitude after retirement considering his 33 years<\/p>\n<p>of unblemished service.\n<\/p>\n<p>            The Supreme Court (2005)3 SCC 501 dealing<\/p>\n<p>with 5% cut in pensionary benefits under 43(a) of the<\/p>\n<p>Bihar Pension Rules has held at Paragraph- 17 as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>                       &#8220;17. If the pensioners benefit is<br \/>\n            cut at 5% out of the total amount of<br \/>\n            pension payable to the appellant the<br \/>\n            appellant will suffer an irreparable loss and<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>                       injury   since,   after   retirement, the<br \/>\n                       pensionary benefit is the only amount<br \/>\n                       available to eke out a livelihood for the<br \/>\n                       retired employees of the Government.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                  This Court therefore in the entirety of the matter<\/p>\n<p>           is satisfied that to impose a punishment of withholding<\/p>\n<p>           20%   of    the   pension    for   10   years   is   grossly<\/p>\n<p>           disproportionate. This Court therefore modifies the final<\/p>\n<p>           order of the revisional authority dated 11.2.2010 by<\/p>\n<p>           directing withholding of 5% pension of the petitioner for<\/p>\n<p>           one year.\n<\/p><\/blockquote>\n<blockquote><p>                       The writ application is allowed.\n<\/p><\/blockquote>\n<pre>P.
