KRUTI M SHAH for\nApplicant(s) : 1 - 4. \nMR MENGDEY APP for Respondent(s) : 1, \nMR\nHARDIK A DAVE for Respondent(s) :\n1, \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH\n\t\t\t \n\n H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/09\/2010  \n \nORAL ORDER<\/pre>\n<p>The present application has been<br \/>\n\tfiled by the applicants for grant of anticipatory bail under section<br \/>\n\t438 of the Code of Criminal Procedure, 1973, in connection with<br \/>\n\tI-C.R.No.65 of 2010 registered with Olpad Police Station, Surat for<br \/>\n\tthe alleged offences under sections 306 and 114 of Indian Penal<br \/>\n\tCode.\n<\/p>\n<p>Learned advocate Ms.Kruti Shah for<br \/>\n\tthe applicants referred to the First Information Report and<br \/>\n\tsubmitted that considering the nature of offence, it is evident that<br \/>\n\tin fact, the deceased, as Mahant of the temple of Trust, was holding<br \/>\n\tthe land and was sought to be dispossessed. On the other hand, the<br \/>\n\tpossession is still with the son of deceased, and the allegations<br \/>\n\tare made with regard to threat, and, therefore, present application<br \/>\n\tmay be allowed. .\n<\/p>\n<p>Learned APP Mr. Mengdey resisted<br \/>\n\tthe application and submitted that there is a prima facie case<br \/>\n\tinasmuch as the letter and the hand-writing which have been<br \/>\n\trecovered are confirmed as that of the deceased, and, therefore,<br \/>\n\tpresent application may not be entertained.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Hardik Dave appearing for the original complainant<br \/>\n\treferred to the affidavit-in-reply and the entry made in the revenue<br \/>\n\trecord to submit that though originally land belonging to the trust<br \/>\n\tas now has been made in the name of deceased&#8217;s father, and,<br \/>\n\ttherefore, when he was sought to be dispossessed, threats were given<br \/>\n\tresulting into incident, and, therefore present application may not<br \/>\n\tbe entertained.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate Ms.Shah for the applicant, learned APP<br \/>\n\tMr.Mengdey and learned advocate Mr.Dave for the complainant and<br \/>\n\tconsidering the nature of offence, role attributed to the applicants<br \/>\n\tand also the fact that still when the possession is with the<br \/>\n\tcomplainant, the present application deserves to be allowed and<br \/>\n\tdiscretion under section 438 of Cr.P.C. requires to be exercised in<br \/>\n\tfavour of the applicants.\n<\/p>\n<p>Accordingly,<br \/>\n\tthe present application is allowed. The applicants are ordered to be<br \/>\n\treleased on bail in the event of their arrest in connection with<br \/>\n\tI-C.R.No.65 of 2010<br \/>\n\tregistered with Olpad Police Station, Surat in<br \/>\n\trespect of the offence alleged against them on their executing bond<br \/>\n\tof Rs.5,000\/- (Rupees Five thousand only) each with one solvent<br \/>\n\tsurety each of the like amount, by them, by the concerned Police<br \/>\n\tOfficer and on conditions that they shall;\n<\/p>\n<p>a)\tremain<br \/>\n\tpresent before the trial Court regularly as \tand when directed on<br \/>\n\tthe dates fixed;\n<\/p>\n<p>b)\tremain<br \/>\n\tpresent at the concerned Police Station on \t27.09.2009 between 11.00<br \/>\n\ta.m. and 4.00 p.m;\n<\/p>\n<p> c)\tmake themselves available for interrogation by Police Officer between 11:00 a.m. to 05:00 p.m. &#8211; before sunset;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the \tCourt or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish their address to the Investigating Officer and the Courts concerned, and shall not change their residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt should be open to the Investigating Officer to file an application for remand if he considers it proper and just; and the learned Magistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the applicant is arrested at any time within<br \/>\n\t90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of her arrest,<br \/>\n\tduring which it will be open to the applicant to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>Rule<br \/>\n\tis  made absolute to the aforesaid extent.
