Munshaw, learned advocate, waives service of Rule for the<br \/>\nrespondent Corporation. On the facts and in the circumstances of the<br \/>\ncase and with the consent of the learned counsel for the respective<br \/>\nparties, the petition is being heard and finally decided today.\n<\/p>\n<p>2.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships be pleased to issue a writ of certiorari or any other<br \/>\nappropriate writ, order or direction to quash and set aside the order<br \/>\ndated 28.10.2010 (Annexure-A) passed by the Commissioner, Bhavnagar<br \/>\nMunicipal Corporation, respondent herein;\n<\/p>\n<p>(B)\tYour<br \/>\nLordships be pleased to declare that the petitioner is entitled to<br \/>\nand is rightly given pay scale of Rs.8000-13500(pay scale of the post<br \/>\nof Deputy Chief Auditor) with effect from 1.8.2005 and that no<br \/>\ncorrection is required to be made in the same;\n<\/p>\n<p>(C)\tYour<br \/>\nLordships be pleased to pass a cease and desist order to permanently<br \/>\nrestrain the respondent herein from revising the petitioner&#8217;s extant<br \/>\npay scale of Rs.8000-13500 to Rs.6500-10500 with effect from 1.8.2005<br \/>\nand from effecting any recovery from the petitioner in this respect.\n<\/p>\n<p>(D)\tPending<br \/>\nadmission and final disposal of the present petition, Your Lordships<br \/>\nbe pleased to stay the operation and implementation of the impugned<br \/>\norder dated 28.10.2010 (Annexure-A) passed by the Commissioner of<br \/>\nBhavnagar Municipal Corporation, respondent herein, and to stay<br \/>\nrecovery of any amount from the petitioner in pursuance of grant of<br \/>\nhigher pay scale of Rs.8000-13500 with effect from 1.8.2005; and <\/p>\n<p>(E)\tYour<br \/>\nLordships be pleased to pass any other appropriate order, as deemed<br \/>\nfit, in the interest of justice.&#8221;\n<\/p>\n<p>3.\tBriefly<br \/>\nstated, the facts of the case are that the petitioner was appointed<br \/>\nas Sub Auditor on 01.06.1989, in the Audit Department of the<br \/>\nrespondent Municipal Corporation. On 01.08.1996, the petitioner was<br \/>\npromoted to the post of Senior Auditor, in the pay scale of<br \/>\nRs.5500-9000. According to the petitioner, there are three<br \/>\ndepartments in the respondent Corporation, viz. Commissionerate,<br \/>\nAudit and Secretariat, which represent separate streams, and no inter<br \/>\nse transfers are made from one department to the other. It is averred<br \/>\nby the petitioner that separate seniority lists are maintained by<br \/>\neach department. It is the case of the petitioner that after<br \/>\ncompletion of nine years on the post of Senior Auditor, he was<br \/>\nentitled to be considered for promotion to the post of Deputy Chief<br \/>\nAuditor. In lieu of promotion, the respondent Municipal Corporation<br \/>\nconsidered him for grant of pay scale of the next promotional post<br \/>\n(Deputy Chief Auditor). By order dated 05.04.2007, the petitioner was<br \/>\ngranted the higher pay scale of Rs.8000-13500 (pay scale of a Deputy<br \/>\nChief Auditor) with effect from 01.08.2005, as per Government<br \/>\nResolution dated 16.08.1994. Arrears of pay, with effect from<br \/>\n01.08.2005, were also paid to the petitioner in the year 2007. The<br \/>\npetitioner was given the benefit of the higher pay scale for more<br \/>\nthan three years. Thereafter, after adoption of the recommendations<br \/>\nof the 6th Central Pay Commission by the respondent<br \/>\nCorporation, order dated 28.10.2010 was issued, directing that the<br \/>\npay scale which was revised from Rs.5500-9000 to Rs.8000-13500 in<br \/>\nrespect of all employees who had been given said benefit, is required<br \/>\nto be corrected.  The impact<br \/>\nof the impugned order dated 28.10.2010 is that the employees,<br \/>\nincluding the petitioner, would now be<br \/>\nentitled to the higher pay scale of Rs.6500-10500, and not the<br \/>\npay scale of Rs.8000-13500. Consequent directions have also been<br \/>\nissued to effect recovery of the excess amount from the petitioner,<br \/>\nfrom the date the pay scale of Rs.8000-13500 was given to him.<br \/>\nAggrieved thereby, the petitioner has approached this Court by filing<br \/>\nthe present petition.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Shalin Mehta, learned advocate for Ms. Viraj Fozdar, learned<br \/>\nadvocate for the petitioner submits that the impugned order dated<br \/>\n28.10.2010 has been passed without issuance of prior show-cause<br \/>\nnotice or affording an opportunity of hearing to the petitioner,<br \/>\nwhich is against the settled principles of law. It is further<br \/>\nsubmitted that the said order is violative of the principles of<br \/>\nnatural justice and on this ground alone, the same may be quashed and<br \/>\nset aside.\n<\/p>\n<p>5.\tAn<br \/>\naffidavit-in-reply has been filed by the respondent Corporation,<br \/>\nwherein it is stated that as per the Government Resolution dated<br \/>\n16.08.1994, as against the pay-scale of Rs.5500-9000, the higher pay<br \/>\nscale to which the petitioner would be entitled is Rs.6500-10500, and<br \/>\nnot Rs.8000-13500, which was wrongly given to the petitioner.\n<\/p>\n<p>6.\tIt<br \/>\nis not denied by the respondent Corporation that no opportunity of<br \/>\nhearing has been granted to the petitioner before passing the<br \/>\nimpugned order, though the learned advocate for the respondent<br \/>\nCorporation has submitted that no representation has been made by the<br \/>\npetitioner, after passing of the impugned order.\n<\/p>\n<p>7.\tWhen<br \/>\nthe matter is taken up today, Mr. H.S. Munshaw, learned advocate for<br \/>\nthe respondent Corporation states, upon instructions from Mr. R.M.<br \/>\nJogarana, Legal Officer, Bhavnagar Municipal Corporation, that as the<br \/>\npetitioner has not been granted an opportunity of hearing before<br \/>\npassing order dated 28.10.2010, he shall be granted such an<br \/>\nopportunity by the respondent Corporation, and a fresh order shall be<br \/>\npassed thereafter.\n<\/p>\n<p>8.\tIn<br \/>\nview of the above statement made by the learned advocate for the<br \/>\nrespondent Corporation, the Court does not find it necessary to go<br \/>\ninto the merits of the case. It is a settled position of law that no<br \/>\norder resulting in infliction of civil consequences should be passed<br \/>\nagainst a person without affording him, or her, a reasonable<br \/>\nopportunity of hearing. In the present case, admittedly, the<br \/>\npetitioner has not been heard before passing the impugned order. It<br \/>\nis not the case of the respondent Corporation that the petitioner is<br \/>\nguilty of fraud or misrepresentation, which may have led to the<br \/>\npassing of the impugned order. As such, the impugned order dated<br \/>\n28.10.2010 deserves to be quashed and set aside, being violative of<br \/>\nthe principles of natural justice.\n<\/p>\n<p>9.\tIn<br \/>\nthis regard, the observations of the Supreme Court in Bhagwan<br \/>\nShukla Vs. Union of India and Others, (1994)6 SCC 154 are<br \/>\nrelevant, and are reproduced hereinbelow:-\n<\/p>\n<p>&#8220;3.\tWe<br \/>\nhave heard learned counsel for the parties. That the petitioner&#8217;s<br \/>\nbasic pay had been fixed since 1970 at Rs 190 p.m. is not disputed.<br \/>\nThere is also no dispute that the basic pay of the appellant was<br \/>\nreduced to Rs. 181 p.m. from Rs. 190 p.m. in 1991 retrospectively<br \/>\nw.e.f. 18-12-1970. The appellant has obviously been visited with<br \/>\ncivil consequences but he had been granted no opportunity to show<br \/>\ncause against the reduction of his basic pay. He was not even put on<br \/>\nnotice before his pay was reduced by the department and the order<br \/>\ncame to be made behind his back without following any procedure known<br \/>\nto law. There, has, thus, been a flagrant violation of the principles<br \/>\nof natural justice and the appellant has been made to suffer huge<br \/>\nfinancial loss without being heard. Fair play in action warrants that<br \/>\nno such order which has the effect of an employee suffering civil<br \/>\nconsequences should be passed without putting the (sic employee)<br \/>\nconcerned to notice and giving him a hearing in the matter. Since,<br \/>\nthat was not done, the order (memorandum) dated 25-7-1991, which was<br \/>\nimpugned before the Tribunal could not certainly<br \/>\nbe sustained and the Central Administrative Tribunal fell in error in<br \/>\ndismissing the petition of the appellant. The order of the Tribunal<br \/>\ndeserves to be set aside. We, accordingly, accept this appeal and set<br \/>\naside the order of the Central Administrative Tribunal dated<br \/>\n17-9-1993 as well as the order (memorandum) impugned before the<br \/>\nTribunal dated 25-7-1991 reducing the basic pay of the appellant from<br \/>\nRs. 190 to Rs. 181 w.e.f. 18-12-1970.&#8221;\n<\/p>\n<p>\tIn<br \/>\nview of the principles of law enunciated by the Supreme Court, which<br \/>\nare fully applicable to the facts obtaining in the present case, the<br \/>\nimpugned order dated 28.10.2010 is hereby quashed and set aside.\n<\/p>\n<p>10.\tThe<br \/>\nCommissioner, Bhavnagar Municipal Corporation shall grant an<br \/>\nopportunity of personal hearing to the petitioner and shall<br \/>\nthereafter pass a fresh, reasoned, order in accordance with law.\n<\/p>\n<p>11.\tThe<br \/>\npetition is partly-allowed in the above terms.
