Justice K.T.SANKARAN\n\n Dated :09\/02\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 5654 OF 2009\n             ------------------------------------------------------\n            Dated this the 9th day of February, 2010\n\n                                O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. Petitioners are accused Nos.2 to 4<\/p>\n<p>in Crime No.762 of 2009 of Karunagappally Police Station, Kollam<\/p>\n<p>District.\n<\/p>\n<\/p>\n<p>      2.   The offences alleged against the petitioners are under<\/p>\n<p>Sections 323, 324, 341, 447, 452, 326 and 308 read with Section 34<\/p>\n<p>of the Indian Penal Code.\n<\/p>\n<\/p>\n<p>      3.    When the Bail Application came up for hearing on<\/p>\n<p>25.1.2010, the following order was passed:<\/p>\n<blockquote><p>             &#8220;When the Bail Application came up for hearing<\/p>\n<p>       on 23.12.2009, the following order was passed providing<\/p>\n<p>       an opportunity to settle the case between the parties:<\/p>\n<\/blockquote>\n<blockquote><p>                    &#8220;Heard      the    learned     counsel      for the<\/p>\n<p>             petitioners, the learned Public Prosecutor and the<\/p>\n<p>             counsel     who      appeared      for    the    de   facto<\/p>\n<p>             complainant.\n<\/p><\/blockquote>\n<p>B.A. NO. 5654 OF 2009<\/p>\n<p>                                   :: 2 ::\n<\/p>\n<p>                   2.   There are disputes between three<\/p>\n<p>            brothers in respect of immovable property. The<\/p>\n<p>            incident occurred on 1\/8\/2009. Two crimes are<\/p>\n<p>            registered in respect of that incident. Crime<\/p>\n<p>            No.762\/2009 of Karunagappally Police Station<\/p>\n<p>            was registered for the offences under Sections<\/p>\n<p>            323, 324, 341, 447, 452, 326 and 308 read with<\/p>\n<p>            Section 34 of the Indian Penal Code. The de facto<\/p>\n<p>            complainant is Adarsh. Accused Nos. 1 to 3 are<\/p>\n<p>            the paternal uncles of Adarsh.\n<\/p>\n<\/p>\n<p>                   3.   In Crime No.775\/2009, the accused<\/p>\n<p>            persons are Adarsh and his mother Pushpalatha.<\/p>\n<p>            The de facto complainant is Dileep Kumar, who is<\/p>\n<p>            accused No.3 in Crime No.762\/2009.           The<\/p>\n<p>            offences alleged in Crime No.775\/2009 are under<\/p>\n<p>            Sections 341 and 324 read with Section 34 of the<\/p>\n<p>            Indian Penal Code.\n<\/p>\n<\/p>\n<p>                   4.   It is common case that the Resurvey<\/p>\n<p>            Officials came to the property for measurement of<\/p>\n<p>            the disputed property. The father of Adarsh was<\/p>\n<p>            not available in station. It is also common case<\/p>\n<p>            that Survey Officials could not complete the work.<\/p>\n<p>            According to Adarsh, this was on their request to<\/p>\n<p>            postpone the work as his father was not available.<\/p>\n<p>            According to the accused in Crime No.762\/2009,<\/p>\n<p>B.A. NO. 5654 OF 2009<\/p>\n<p>                                    :: 3 ::\n<\/p>\n<p>            when the Re-survey Officials demanded to<\/p>\n<p>            produce the title deeds, Adarsh did not do so and<\/p>\n<p>            he provoked his paternal uncles by abusive<\/p>\n<p>            words.\n<\/p>\n<\/p>\n<p>                   5.    It is also common case that some<\/p>\n<p>            incidents took place near the grill in front of the<\/p>\n<p>            house of Adarsh. According to Adarsh and his<\/p>\n<p>            mother, the grill was pushed open and his mother<\/p>\n<p>            was pulled out and the accused committed the<\/p>\n<p>            offence. According to the accused in Crime<\/p>\n<p>            No.762\/2009, the de facto complainant&#8217;s mother<\/p>\n<p>            sustained injuries when the grill came into contact<\/p>\n<p>            with her head.\n<\/p>\n<\/p>\n<p>                   6.    Counsel on either side submitted that<\/p>\n<p>            it would be ideal if the parties settle their disputes<\/p>\n<p>            and differences in respect of the properties and<\/p>\n<p>            also in respect of the incidents which occurred on<\/p>\n<p>            1\/8\/2009. The counsel pray that one month&#8217;s time<\/p>\n<p>            may be granted to see whether the matter could<\/p>\n<p>            be settled.\n<\/p>\n<\/p>\n<p>                   Post after one month.\n<\/p>\n<\/p>\n<p>                   7.    The undertaking not to arrest the<\/p>\n<p>            petitioners will continue to be in force till then.&#8221;<\/p>\n<p>B.A. NO. 5654 OF 2009<\/p>\n<p>                                      :: 4 ::\n<\/p>\n<p>             2. According to the counsel for the petitioners, the de<\/p>\n<p>      facto complainant did not fully co-operate with the<\/p>\n<p>      settlement talks. According to the counsel for the de facto<\/p>\n<p>      complainant, the default was on the side of the petitioners.<\/p>\n<p>             3. In the facts and circumstances, there will be a<\/p>\n<p>      direction to the petitioners to appear before the<\/p>\n<p>      investigating officer at 9 AM on 1st and 2nd February,<\/p>\n<p>      2010. The learned counsel for the de facto complainant<\/p>\n<p>      submitted that the de facto complainant also would be<\/p>\n<p>      present before the investigating officer on 1st and 2nd<\/p>\n<p>      February, 2010. The petitioners shall produce a copy of<\/p>\n<p>      the order before the investigating officer.<\/p>\n<p>             4. Post on 9th February, 2010.\n<\/p>\n<p>             5. The undertaking not to arrest the petitioners<\/p>\n<p>      will continue to be in force till then.<\/p>\n<p>             It is submitted by the counsel on either side that<\/p>\n<p>      the attempts to settle the dispute can be continued in<\/p>\n<p>      the presence of the investigating officer.               This<\/p>\n<p>      submission is recorded.&#8221;\n<\/p>\n<\/p>\n<p>      4. It is submitted by the learned counsel for the petitioners as<\/p>\n<p>well as the learned Public Prosecutor that the direction in the order<\/p>\n<p>dated 25.1.2010      has been complied with by the petitioners.<\/p>\n<p>However, it is stated that the de facto complainant did not appear.<\/p>\n<p>B.A. NO. 5654 OF 2009<\/p>\n<p>                                     :: 5 ::\n<\/p>\n<p>      5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact that<\/p>\n<p>the direction in the order dated 25.1.2010 has been complied with<\/p>\n<p>by the petitioners, I am of the view that anticipatory bail can be<\/p>\n<p>granted to the petitioners. There will be a direction that in the event<\/p>\n<p>of the arrest of the petitioners, the officer in charge of the police<\/p>\n<p>station shall release them on bail on their executing bond for<\/p>\n<p>Rs.15,000\/- each with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>      a)     The petitioners shall appear before the investigating<br \/>\n             officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote><p>      b)     The petitioners shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;<\/p>\n<\/blockquote>\n<blockquote><p>      c)     The petitioners shall not commit any offence or indulge<br \/>\n             in any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<blockquote><p>      d)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p>                                                    (K.T.SANKARAN)<br \/>\n                                                           Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Dinesh Kumar.T vs State Of Kerala on 9 February, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5654 of 2009() 1.
